Siti Bainun's final appeal in Bella abuse case dismissed

PUTRAJAYA: Rumah Bonda founder Siti Bainun Ahd Razali has failed in her final appeal to overturn her conviction for neglecting and abusing a teenager with Down Syndrome known as Bella. A three-member Court of Appeal bench led by Justice Azman Abdullah today unanimously dismissed her bid to set aside the conviction and 12-year jail sentence imposed by the sessions court on May 3, 2023. 'We find that the prosecution has proven its case against the appellant beyond reasonable doubt. 'Accordingly, the conviction is safe to uphold and the appeal is dismissed,' Azman said. Justices Azmi Ariffin and Hayatul Akmal Abdul Aziz also heard the appeal. The court upheld the 12-year sentence imposed by the lower court, with Azman remarking that 'even animals would not think of inflicting such injuries as those seen on Bella'. Azman said there was no denying that the injuries sustained by Bella, who was 13 when the offence took place in 2021, were non-accidental and not self-inflicted, as supported by witness testimony. He said photographs tendered in court showed wounds on her arms, old injuries on her head, face, neck and back, as well as burn marks. The sessions court had sentenced Siti Bainun, 33, to 10 years' jail for neglecting the girl and 12 years for abusing her, with both sentences to run immediately and concurrently. Siti Bainun was also ordered to sign a RM5,000 good behaviour bond for five years with one surety, and to perform 200 hours of community service within six months of her release. On May 2 last year, the High Court upheld both conviction and sentence. Siti Bainun was represented by Haijan Omar, Nurul Hafidzah Hassan, Nur Aminatul Mardhiah Nor, Tun Laila Tun Rafaee, Asyraaf Abu Bakar Hamzah and Putri Ainaa Amiera Megat Mustaffa Al-Bakri. Student-for-sex ring busted in Keningau

KENINGAU: Police crippled a human trafficking syndicate that targeted students for sexual exploitation following operations conducted from July 24 to 29. District Police Chief Supt Yampil Garai said investigations uncovered the syndicate's operations, which involved recruiting teenage girls, including two Form Two students, to be offered to clients at several hotels around Pekan Keningau. The case came to light after parents of victims filed a police report on July 24. Acting on information received, the police rescued four victims aged between 13 and 21 years, while eight individuals were detained to assist investigations. Among those arrested, an 18-year-old woman known as 'Elly', suspected of acting as a procurer, has been charged in court under Section 14 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007. The remaining seven suspects were released and will serve as prosecution witnesses. Investigations revealed the syndicate solicited clients through social media applications, charging RM200 per service before directing victims to predetermined hotels. Payment was split between the suspects and victims. All victims have been sent to the Keningau Hospital for medical examination and are currently housed at the Women and Children's Protection Home. For the two underage victims, the court has approved a three-month Protection Order and they have been placed at a Protection Home in Ampang, Selangor until Nov 13. Cops nab man for reckless driving after chase in Segamat
SEGAMAT: A 20-year-old man has been arrested for reckless driving and hitting several vehicles after failing to comply with police instructions to stop. The Segamat Police District car patrol unit (MPV) officers were patrolling the Jalan Labis-Chaah stretch when they spotted a missing silver sedan. "The car was reported missing in Labis on Aug 12," said Segamat OCPD Supt Ahmad Zamry Marinsah. The MPV unit followed the suspect until he reached the traffic light junction near the Chaah police station. Supt Ahmad Zamry stated that the suspect refused to stop when ordered by the police and sped off towards Yong Peng. "Our officers managed to catch the suspect at KM3, Jalan Yong Peng-Segamat after a chase," he said. Initial investigations revealed that the suspect has a previous criminal record and is on a wanted list for a narcotics case. The suspect has been remanded until Aug 8 to assist with the investigation. The case is being investigated under Section 379A, Section 186, and Section 279 of the Penal Code. Section 379A of the Penal Code relates to the theft of motor vehicles or their components, punishable by imprisonment for a term of not less than one year and not more than seven years, and a fine. Section 186 deals with obstructing a public servant in the discharge of their duties, with penalties including imprisonment of up to two years, a fine of up to RM10,000, or both. Section 279 covers rash or negligent driving on a public way, which can result in a jail term of up to six months, a fine of up to RM2,000, or both. A video of the car chase went viral on social media platforms. Breach of conditions: Cargo boat detained in Tawau

Tawau Maritime Zone Director Captain (Maritime) Ariffin Ghazali said it took place in the waters off Wallace Bay, Sebatik Island, on Wednesday night. 'The vessel was first detected 2.1 nautical miles northwest of the Sungai Tongkang estuary during Ops Pluto Timur, Ops Sejahtera and Ops Tiris around 8.20pm,' he said, Thursday. Ariffin said preliminary checks revealed that the vessel was operated by three local men, aged between 40 and 66, serving as skipper and crew members. A check on the documentation showed the skipper had failed to report a change of crew, as one of the individuals was not listed in the crew register stated on the vessel's operating licence. 'The vessel and its skipper were brought to the Tawau Maritime Zone Jetty for investigation under the the Merchant Shipping Ordinance 1952 (MSO 1952) for breaching the conditions of a valid licence,' he said. The palm fruit was not seized as it had a valid licence certified by the Malaysian Palm Oil Board (MPOB). The case has been referred to the Marine Department for compound action, as all crew members must hold competency certificates to operate the vessel safely. Ariffin reminded vessel owners and operators to adhere to the conditions of their valid licence, stressing that no compromise would be made regarding such violations. 'The maritime community must remain vigilant and ensure that all licensing conditions are met, failing which stern action will be taken against them,' he said. He added that the MMEA will continue to strengthen enforcement within Malaysian maritime zones, particularly in the Eastern Sabah Security Zone (Esszone), to combat unlawful activities.
