How DWP powers mean your landlord can take money from benefits payments

The Department of Work and Pensions (DWP) has announced it will reassess a controversial computer program that has deducted millions of pounds of rent payments from universal credit claimants without their consent.
Work and pensions secretary Liz Kendall said she would "right the wrongs" of the system after a legal challenge saw a judge rule that the system processing tens of thousands of deduction requests each year was unlawful.
The case was brought by tenant Nathan Roberts, who was shocked to discover that the DWP did not ask him before docking £500 from his benefits at the request of his landlord, Guinness Partnership, whom he was in a dispute with over repairs.
Up to 10.3 million deductions from claimants' payments for rent and service charge arrears, worth £479m, have been made via the DWP's process since 2017, a freedom of information request made by i news has shown.
When it was introduced under the roll out of universal credit in 2013, the then-Conservative government said it would prevent claimants being evicted from their homes because of overdue arrears.
Here's what we know about the system, its current powers, and what to do if a deduction has been made.
The DWP has the power to automatically deduct up to 20% of someone's monthly universal credit payments for outstanding rent repayments using the controversial program.
While the concept of benefit deductions for the likes of rent arrears has been a part of the UK benefits system since the 1970s, it was automated under the Conservative government when universal credit was introduced.
The deductions can be made without the person being consulted by either their landlord or the DWP.
This affects people in both social housing and private tenants.
In the case of the private tenant, since 2017 they have been able to challenge the application for the direct payment within seven days if they do not have rent arrears or are engaged in a formal disrepair dispute with their landlord and are withholding rent.
This is not the first time automated payments like this have been ruled unlawful.
In 2022, a similar program that allowed utility companies to automatically deduct hundreds of pounds a year from individuals' benefits without their consent was also declared unlawful by the High Court.
Helen Timson, a disabled former police officer, brought a case against the government after her utility company repeatedly deducted payments from her universal credit — including £81 a month for a year-and-a-half for a non-existent debt, the Guardian reported.
While the DWP was required to make deductions only if they were in the "interests of the claimant", the court heard workers green-lit the deductions without consulting or informing the claimant – meaning they could not be in a position to decide whether the deduction was in the claimants' interests.
However, the right for the DWP to make deductions on behalf of a utility provider are still in place today. As of April 2025, deductions for utility bills fall under the category of third-party deductions, which will be set at 5% of the standard allowance from April 2025.
The DWP can take more than the general limit if it would prevent a claimant's fuel supply from being cut off.
The general limit for all debt deductions is currently 25% of your universal credit standard allowance. This will go down to 15% from April 2025.
It's important to note that while the system is being reviewed, it has not yet been scrapped or halted.
If you notice a deduction from your universal credit payment that you don't recognise or suspect to be rental related, you can take the following steps:
Check your universal credit online account for any messages or notifications about the deduction.
Contact the universal credit helpline immediately at 0800 328 5644 to inquire about the deduction and its reason.
If you disagree with the deduction, you can challenge the decision by asking for a 'mandatory reconsideration' within one month of the decision date. You can do this by writing a message in your universal credit online account, filling out a CRMR1 mandatory reconsideration request form on gov.uk, writing a letter to the DWP at the address on your decision letter, or calling the number on the decision letter (if near the deadline).
When requesting a mandatory reconsideration, include the date of the decision, specific reasons why you disagree, and your name, address, and national insurance number.
The DWP has said it will now look at this process and consider better ways of ensuring landlords get the rent they are owed in a fair and proportionate way while benefit claimants are protected from falling into debt.
The work and pensions secretary also confirmed the DWP will not appeal this decision. In response to the ruling, Kendall said she was "determined to right the wrongs that have persisted in the benefits system for too long", adding that the rental payment deductions "is one of these".
"As well as urgently reviewing this system, I am bringing forward major changes to the health and disability benefits system so that it works for everyone, underpinned by the biggest employment reforms in a generation.
"We will continue to listen to people's concerns, and transform our benefits system to one of fairness, not punishment," she added.

When a news story bursts into the headlines in the U.K. and consumes all the oxygen for several days, it can be difficult to know whether it is a domestic uproar or something that is reaching an international audience. For all the fevered debate here, it seems that what we are calling 'the Afghan data leak scandal' has not attracted much notice in America. Perhaps we should be grateful. To sum up, in February 2022, a Royal Marine at U.K. Special Forces headquarters emailed a spreadsheet that he thought contained the names of around 150 Afghan nationals who had applied to come to Britain, having assisted U.K. forces in Afghanistan. In fact, it had the details of 18,714 Afghans, as well as some Special Forces personnel, senior defense officials, members of Parliament and intelligence officers. In the wrong hands, it could have been a pre-prepared Taliban kill list. This was a catastrophic breach of data security. The Ministry of Defence was unaware of this loss of data for 18 months, until some of the information appeared in a Facebook group in August 2023. Defence Secretary Ben Wallace applied to the High Court for a temporary injunction on reporting the leak so that the security implications could be assessed and appropriate measures put in place to protect those at risk. Wallace was, however, standing down. His successor, Grant Shapps, who took on responsibility for the issue. Astonishingly, the High Court judge who considered the Ministry of Defence's application, Justice Robin Knowles, went even further: He granted what is referred to as a 'super-injunction,' which not only prevents reporting of the issue covered by the injunction, but disclosure of the existence of the injunction itself. The use of this kind of measure by the government is unprecedented, and it meant that there was no public or parliamentary scrutiny of the data loss, because very few people even knew it had occurred. Those who knew the full extent of the situation were extremely few: Shapps as defence secretary and the armed forces minister, James Heappey; Prime Minister Rishi Sunak and his deputy, Oliver Dowden; Labour's defense spokesman, John Healey, who is now defence secretary; the speaker of the House of Commons, Lindsay Hoyle; the media organizations whom it silenced; precious few others. The current prime minister, Keir Starmer, was not informed at that point. Under the cloak of secrecy — the super-injunction's duration was extended twice in 2024 — a new resettlement scheme was hastily introduced which extended to 900 individuals affected, along with 3,600 family members. When Starmer's Labour government took office in July 2024, only Healey, the incoming defence secretary, knew the full situation. Although he told the House of Commons when the super-injunction was lifted that 'it has been deeply uncomfortable to be constrained from reporting to this House,' it was in place for slightly longer under Labour than it had been under the previous Conservative government. A review was conducted by Paul Rimmer, a former deputy chief of defence intelligence, which concluded that 'there is little evidence of intent by the Taliban to conduct a campaign of retribution against' those who assisted U.K. and coalition forces. The various resettlement schemes for Afghan nationals have now been closed down. Inevitably, the current government is seeking to blame its predecessor. But that will not wash. Not only did Starmer and Healey have a year to rescind the injunction, but the prime minister's office will not rule out seeking such an instrument in the future. The government did not inform the Intelligence and Security Committee, the independent oversight body of these kinds of issues, and it has not been frank with the National Audit Office, the U.K.'s public spending watchdog. The Ministry of Defence is a secretive organization by instinct. It parts with even the most harmless information under duress. Many will find it hard to avoid the conclusion that when a judge offered such a wide-ranging court order to prevent scrutiny or comment, it was as if Christmas had come early. Not only could challenging questions be avoided, they would never even be asked, because most legislators were unaware there was anything to ask questions about. The eventual cost of the debacle is not clear, but it will be billions of pounds. That it touches on the ultra-sensitive subject of immigration compounds the damage done. Some have called it the worst data breach in British history; sadly it is part of a pattern at the Ministry of Defence, which reported 569 incidents of data loss in 2023 to 2024. The most damaging aspect, however, is the corrosive effect on public trust, already at a historic low. Those inclined to believe overblown tales of 'the deep state' have been provided with fresh ammunition — the government using the courts to prevent parliamentary scrutiny and media reporting of an issue for two years. It should not have happened. It cannot happen again. But the government will struggle to make voters believe that. OTTAWA - Reproductive health advocates say the federal government's failure to commit to funding pharmacare in all provinces and territories is leaving people with a lot of uncertainty, and could create inequality across the country. 'It's really disappointing, honestly,' said Liz Thompson, advocacy lead for Cover Contraception. 'It seems like they don't really know what they're going to do.' The first phase of the Pharmacare Act, which was passed last fall by the Liberals and the NDP, calls for the federal government to fund the cost of contraceptives and diabetes medications for patients. It also calls on the government to study the best way to create a universal pharmacare program to cover all medications. The Trudeau government signed deals with B.C., P.E.I., Yukon and Manitoba to cover the cost of certain medications for four years. It also set aside $1.5 billion in the last budget to fund the first phase of the program — but the new Liberal government will not commit to signing deals with the remaining jurisdictions. Health Minister Marjorie Michel was asked about the lack of new pharmacare negotiations with the provinces last week. She did not commit to getting the remaining deals done. 'It's a new government, and we are in a new context, and we have to have discussions with the provinces to see how we can support them,' she said at a press conference in Fredericton. During the spring election campaign, the Liberals pledged in their platform to 'protect dental care and pharmacare — two critical services and key parts of a strong public health care system that (Conservative Leader) Pierre Poilievre would cut.' A spokesperson for Prime Minister Mark Carney said in response to questions that the Liberal leader promised during the campaign 'that we wouldn't cut or abolish any of the existing deals.' 'That's incredibly disappointing and demonstrates a fundamental lack of leadership on this issue,' said Teale Phelps Bondaroff, the chair and co-founder of the Access B.C. campaign, which has been advocating for prescription contraceptive coverage since 2017. Phelps Bondaroff said the Liberals do not seem to be prioritizing 'people's health and well-being and equity and equality' as they focus on the threat of U.S. tariffs. 'You have a government that's hyper-focused on these macro issues and I worry that they're forgetting about everyday Canadians in that process,' he said. B.C. became the first province to offer contraceptive coverage in 2023 and was among the first to sign a federal funding agreement. Access B.C. now has sister organizations in a number of other provinces, including Cover Contraception in Ontario. Dr. Amanda Black, past president of the Society of Obstetricians and Gynecologists of Canada, said if the government does not sign new agreements, it will be a step backward for women's health in Canada. 'I think we need to pressure both at the provincial level as well as at the federal level,' she said. The Canadian Press reached out to Diabetes Canada for comment but has not heard back. Julie Veinot, the executive director of South Shore Sexual Health in Nova Scotia, said people across the country should expect to have equal coverage. 'It is quite a shock to me that there is even the possibility that some provinces won't get this coverage,' she said. Veinot said she expected the Liberals would continue their own program. 'Unfortunately, we know the cost of living is super high right now, so we don't want folks to have to pick between paying rent and buying birth control,' she said. The Canadian Labour Congress celebrated the passage of the Pharmacare Act last fall, calling it a victory and a first step toward something unions have been advocating for years. Elizabeth Kwan, a senior researcher at the congress, said if the government does not reach deals with the remaining provinces and territories, it is 'breaking a promise to Canadians.' 'The government needs to understand that nation-building means also nation-building with the social programs that define us as Canadians. And I believe that that's part of what makes us a sovereign country,' she said. Kwan added that many Canadians depend on coverage for medications through their workplace insurance plans, and 'a lot of people in Canada are losing their jobs these days' — from the thousands laid off due to the closure of Hudson's Bay, to the 10,000 jobs lost at Ontario colleges due to cuts and program cancellations. Layoffs and job losses are expected to rise in tariff-exposed sectors like manufacturing and industries related to steel and aluminum, she said.
