ICC public counsel dismisses Duterte camp's challenge on jurisdiction

The International Criminal Court's (ICC) Office of the Public Counsel for Victims dismissed the defense challenge submitted by the camp of former President Rodrigo Duterte regarding the court's exercise of jurisdiction.
Duterte's lawyers earlier argued that preconditions for the exercise of jurisdiction in the Situation of the Philippines were not met at the time the Pre-Trial Chamber authorized the opening of an investigation on September 15, 2021.
They noted that the Philippines' withdrawal from the Rome Statute took effect on March 17, 2019 and the Pre-trial Chamber issued its decision, more than two years later.
ICC Principal Counsel Paolina Massida pointed out that the Philippines' withdrawal has no legal effect as the Prosecutor's preliminary examination started even before the withdrawal took effect.
'The preliminary examination conducted by the Office of the Prosecutor in the Situation in the Republic of the Philippines must be considered as 'a matter' that was 'already under the consideration of the Court' prior to the date on which the State's withdrawal became effective and thus the Court may exercise its jurisdiction over the case against Mr Duterte,' according to the 27-page document dated June 9.
Duterte pulled the Philippines out of the Hague-based ICC's Rome Statute in 2018, with the withdrawal taking effect in 2019, after the tribunal began a preliminary probe into his administration's drug war.
In 2021, Supreme Court ruling said the Philippines has the obligation to cooperate with the ICC despite its withdrawal from the Rome Statute, noting that the exit does not affect criminal proceedings pertaining to acts that occurred when a country was still a state party.
Duterte was arrested and is detained at the Hague Penitentiary Institution or the Scheveningen Prison while awaiting trial in March this year.
With Duterte's arrest, the ICC principal counsel noted that the government's surrender of the former president shows that 'the Government of the Philippines still considered itself to be bound by the Statute when complying with the Arrest Warrant and surrendering the suspect into the custody of the Court.'
'This further provides an irrefutable proof to the effect that the Republic of the Philippines does consider that the Court still can exercise its jurisdiction over the crimes committed in its territory as described in the Warrant of Arrest against Mr Duterte, pursuant to articles 12 and 127 of the Statute,' the document further read.
'For the foregoing reasons, the Principal Counsel respectfully requests the Chamber to dismiss the Defence Challenge,' it concluded.
The confirmation of charges has been set for September 23, 2025. — BAP, GMA Integrated News

Senate President Francis "Chiz" Escudero, who sits as presiding officer of the impeachment court, said Thursday the Senate has yet to receive any pleading from the House of Representatives regarding the impeachment of Vice President Sara Duterte. In an ambush interview in Malolos, Bulacan, Escudero emphasized that all communications regarding the impeachment should be submitted through pleadings—not through social media, press conferences, or press releases—considering that the impeachment court has already convened. The House of Representatives on Wednesday night certified that Duterte's impeachment complied with the 1987 Constitution. The House plenary also deferred acceptance of the articles of impeachment until the Senate impeachment court has responded to the queries sought by the House prosecution panel regarding the return of the articles of impeachment. According to Escudero, however, the impeachment court did not receive any documents pertaining to the matter by the time the Senate adjourned sine die on Wednesday at about 9 p.m. "Hindi ko nais komentaryuhan 'yan dahil una, balita lang 'yan. Ni hindi ko alam kung totoo dahil wala pa naman kaming natatanggap. Lahat ng komunikasyon, sa ngayon na may impeachment court na, sa pamamagitan na ng pleading at hindi press release o ang presscon," the senate president said. The Senate, sitting as an impeachment court, voted 18-5 on Tuesday night to return the articles of impeachment to the House of Representatives without dismissing or terminating the case until such time that: The House of Representatives certified to the non-violation of Article XI, Section 3, paragraph 5 of the Constitution, which provides that "No impeachment proceedings shall be initiated against the same official more than once within one year; include the circumstances on the filing of the first three impeachment complaints"; and The House of Representatives of the 20th Congress communicated to the Senate that it was willing and ready to pursue the impeachment complaint against the Vice President. On Wednesday evening, Speaker Martin Romualdez described the Senate impeachment court's move as "deeply concerning." Despite this, Romualdez said the House "will comply with the requirements of the impeachment court" to ensure that the process continues. Escudero, meanwhile, reiterated that the House prosecution panel has no option but to accept the returned articles of impeachment. "'Yun ang pasya ng impeachment court bilang mga taga-usig. The Alliance of Concerned Teachers (ACT) expressed support Wednesday for a House committee's recommendation to file charges against Vice President Sara Duterte and other officials over the alleged misuse of confidential funds in the Office of the Vice President (OVP) and the Department of Education (DepEd). In a statement on Wednesday, ACT described the report by the House Committee on Good Government and Public Accountability and its subsequent adoption by the House plenary as a "crucial step toward upholding integrity and transparency in public service." The recommended charges against Duterte relate to technical malversation, perjury, bribery, and plunder. ACT said the proposed charges "represent a significant stride toward holding public officials accountable for corruption, plunder, betrayal of public trust, and culpable violations of the Constitution." The teachers' group renewed its call to abolish confidential and intelligence funds across all civilian government agencies. "These unaccountable and discretionary funds must instead be rechanneled toward strengthening social services, increasing the salaries of government workers, and expanding support for the agricultural sector," ACT said. On Tuesday, the House of Representatives adopted the Committee on Good Government and Public Accountability's report recommending charges against Duterte and other officials. Speaking at the House plenary, committee chair Manila Representative Joel Chua noted that exhaustive deliberations were held regarding obstruction of inquiry, misuse of confidential funds, and interference and bribery, among others. The recommendations were based on the committee's investigation into the alleged misuse of confidential funds amounting to P500 million in the OVP and P112.5 million in the DepEd from 2022 to 2023. The House plenary's decision came on the same day that the Senate convened as an impeachment court to try Duterte over alleged misuse of confidential funds and other high crimes.
