Man accused of driving almost 200mph before crash that killed passenger
A man is to stand trial accused of driving at almost 200mph before a passenger in his car later died in a fatal crash.
Josh Buchan faces an allegation of causing the death of Ben Taylor, 19, after losing control of his Audi RS3 on the B9077 in Aberdeen on September 25, 2022.
Buchan is first charged with culpable and reckless conduct in the months before the incident.
Prosecutors state the now 25-year-old drove the Audi, which had been 'modified by means unknown' to travel at more than 155mph.
The indictment claims Buchan went on to go at speeds of up to 194mph and drive on the wrong side of the road while he had passengers in the vehicle.
This is said to have occurred on various occasions between June 12 and September 20, 2022, including on Anderson Drive in Aberdeen.
The death by dangerous driving charge goes on to state that Mr Taylor and another young man were in Buchan's car on September 25, 2022.
Buchan is again alleged to have gone at excessive speed – this time up to 118mph.
It is claimed he failed to keep the motor 'under proper control,' which resulted in him hitting a grass verge, leaving the road, and colliding with bushes and trees.
Mr Taylor is said to have been so badly hurt that he passed away.
The other passenger is also alleged to have been seriously injured.
The case called for a hearing at the High Court in Glasgow.
Lawyers for Buchan, also of Aberdeen, pleaded not guilty on his behalf.
A trial was fixed and is scheduled to begin next March in Aberdeen.
The case could last around six days. Buchan is on bail.
Following his death, Mr Taylor's employers Cargo Carrier Solutions said the world would be 'an empty place' without the teenager's 'big smile and laughter'.

Relatives and friends of Abdullah said he was devoted to his family and would 'light up their faces with a big smile'. He arrived in the UK from Yemen two or three months ago, and had devoted himself to learning English ahead of starting at college in September. Abdullah's relative Saleh Alsirkal runs the corner shop on Staniforth Road which the teenager visited just before the crash. He said he had had a hospital appointment earlier in the afternoon and popped into the store, as he often did, before heading off to find some food. Mr Alsirkal said: 'His dad brought him over to change his life, to get a better future for his son, but this has happened and destroyed everything. 'God bless him. He's is in a better place than this place. Good has chosen him.' Mr Alsirkal said Abdullah was a 'kind boy' who just wanted to look after his family, including his three sisters. He said he was really enjoying learning English. 'Every time he had a new word to learn he was so excited about it,' he said. 'It meant a lot to him and he learned quick. Sometimes he would stay in the shop just so he could talk to people. He tried to be friends with everyone.' He said: 'He wanted to be the main guy for the family. He was 16-years-old but he was a clever man. I would call him a man.' Abdullah's friend Oasmah Thabet said: 'What I can tell you for certain about him is that he really cared for his family. 'You can really tell the character of somebody by the support they give to their family. 'It just shows the gratitude he had, and he spread that gratitude to the people around that community. 'To the people who would come around and just say hello to him, he would light up their faces with a big smile.' Mr Thabet said: 'He was here for a few months and was starting the learn English as well. 'I'd like to think that we related in the sense that both our families migrated from Yemen to here. 'The reason our family came here was for a better life – to live the dream. Detectives have said they believe a grey Audi drove towards three electric bikes, colliding with one rider, who suffered serious injuries which are not thought to be life-threatening, before hitting Abdullah. Detective Chief Inspector Benjamin Wood said: 'This is a heartbreaking case in which a completely innocent boy has lost his life. 'Our thoughts remain with Abdullah's family and our priority is securing justice for them. 'A murder investigation has been launched and we have a team of detectives working around the clock. 'I am renewing our message to not share footage of this incident which may cause further distress to Abdullah's loved ones.' Mr Wood asked for anyone with footage or information to contact officers and said he was keen to hear from the riders of two electric bikes who were in the area at the time. Two people, a man, aged 46, and a woman, aged 45, arrested on suspicion of assisting an offender have both been bailed pending further inquiries, police said.

Police find person sleeping in cupboard under stairs during search of properties
Police found a resident of a house of multiple occupancy (HMO) in Haddington sleeping in the cupboard under the stairs, it has been revealed. The landlord of two neighbouring properties in the East Lothian town is applying to have his licence to operate it renewed. But a report due to go to next week's East Lothian Council licensing sub committee reveals the houses have not had a valid HMO licence for more than three years. And it was revealed that in a scene reminiscent of the Harry Potter books, someone had been sleeping in the under-stairs cupboard of one or the properties. The report said the landlord 'admitted that a single person had been sleeping in the understairs cupboard of one of the properties (reported by Police Scotland following their visit of August 19, 2022)'. In the first of the Harry Potter books the wizarding schoolboy lives in the cupboard under the stairs of his aunt and uncle's house. The report on the HMO properties said that during a visit by licensing, police and fire officers, it was found 14 people were living in the two houses which had a limit of between six and ten tenants. Single beds were discovered in garden sheds at both properties and one tenant told officers they paid their rent in cash and received no receipts. Historic complaints about the HMO use of the houses, on Hope Park, saw neighbours accuse tenants of taking drugs in the garden, anti-social behaviour, and disturbances day and night. The report also said a meeting at council headquarters between the landlord, the licensing officer and homelessness team had been held in December 2023 where concerns were raised that tenant/lodger agreements were not in place for those living in the houses. It added there was 'frequent presentations to the homelessness team from former tenants of (the properties) and potential presentations from current lodgers due to both properties being in breach of HMO legislation'. The report outlined a timeline of events over the last two years including enforcement action over unauthorised use of the homes as HMOs, application forms which were incomplete and breaches of a rent suspension order. The sub committee will consider new applications which have now been lodged for the properties to operate as HMOs however its own planning department has lodged an objection saying both houses are the subject of an 'ongoing enforcement investigation' relating to planning permission for the use. The committee will meet to decide the licences next Thursday, June 12.
