High Court Judge Roz Mawar recused from presiding suit against ex-AG

By: Bernama Text Size: PUTRAJAYA: The Court of Appeal today allowed the appeal by former attorney-general (AG) Tan Sri Tommy Thomas to recuse a High Court judge from presiding over Tan Sri Shahrir Abdul Samad's malicious prosecution suit against him. A three-member bench comprising Justices Datuk Supang Lian, Datuk Faizah Jamaludin and Datuk Ahmad Fairuz Zainol Abidin set aside the High Court's decision.
Advertisement In January, the High Court judge, Roz Mawar Rozain, dismissed Thomas's application to recuse her from hearing the case. In today's proceeding, Justice Faizah, who delivered the court's unanimous decision, said there was a real danger of bias on the part of the High Court judge if she continues to hear the case, although it may be unintentional. 'The learned High Court judge is to be recused from hearing all future proceedings and the trial in the civil suit,' she said. Justice Faizah said the High Court judge's findings and observations during her ruling on Thomas's striking-out application revealed her views on the merits of Shahril's case against Thomas. 'As an informed and fair-minded bystander, given the facts and circumstances of the case, we perceive that these findings and observations do give rise to a risk of real danger of bias by the learned judge,' she said. The court ordered a legal cost of RM30,000 to be awarded to Thomas for proceedings in the High Court and the Court of Appeal. In July last year, Roz Mawar rejected Thomas' application to strike out Shahrir's lawsuit and ordered the case to go for a full hearing. Shahrir had filed the suit against Thomas, former Malaysian Anti-Corruption Commission (MACC) chief commissioner Latheefa Koya, the MACC and the Malaysian Government. The former Johor Bahru Member of Parliament's lawsuit concerns a RM1 million cheque he received from former prime minister Datuk Seri Najib Tun Razak for restoration work on the Puri Langkasuka housing project in Larkin, Johor. Thomas, who served as AG from June 2018 to February 2020, refuted Shahrir's allegations of abuse of power, describing them as 'unsustainable'. Thomas further explained that he resigned on Feb 28, 2020, and that Shahrir's criminal trial for the charges began on July 26, 2022. KUCHING (July 4): A total of 195 residents from Bario took part in the Integrity and Anti-Corruption Outreach Programme held at SMK Bario recently, organised by the Malaysian Anti-Corruption Commission (MACC) Sarawak in collaboration with the Bario Secondary School Alumni Association (BSSAA). The programme began with three concurrent knowledge-sharing sessions, each tailored to students, educators, and community leaders. The first session, held in the school hall and conducted by MACC senior superintendent Maini William, focused on instilling integrity values among youths while emphasising their role in cultivating a corruption-free culture from a young age. The second session, conducted by MACC Sarawak deputy director (prevention) Wan Ahmad Nidzam on the first floor of the public library, targeted teachers from SMK Bario and SK Bario. The session highlighted the responsibility of educators as agents of change in shaping a culture of integrity within schools and the wider community. Simultaneously, the third session was held on the ground floor of the public library for local community leaders and government department heads. Led by MACC Sarawak director Hasbilah Mohamad Salleh, the discussion centred on strengthening clean, ethical, and corruption-free governance at the community and departmental levels. The event continued with speeches from SMK Bario principal Robin Amir, BSSAA president Datin Pearl Masna Mohan, and Bario Sub-District administrative officer Richard Usah, representing Deputy Minister in Sarawak Premier's Department (Labour, Immigration and Project Monitoring) and Mulu assemblyman Datuk Gerawat Gala, also an alumnus of SMK Bario. The programme's official launch was performed by Hasbilah, who also officiated at the opening of 'The Lentern Nook', an open reading corner established in SMK Bario. Souvenirs were presented to the school and BSSAA, followed by a Corruption-Free Pledge (Ikrar Bebas Rasuah) led by the community and witnessed by Richard. In the evening, the MACC Sarawak delegation led by Hasbilah visited the Bario Asal Longhouse upon special invitation from the BSSAA. Pearl, hailing from the longhouse community, facilitated the visit. Mohd Azam Ahmad appointed as new Education DG
KUALA LUMPUR: Deputy director-general of Education (Professionalism Development Sector) Dr Mohd Azam Ahmad has been appointed as the new director-general of Education, effective July 7. He replaces Datuk Azman Adnan who will go on mandatory retirement effective July 5. Chief Secretary to the Government Tan Sri Shamsul Azri Abu Bakar, in a statement today, said he is confident that with over 35 years of experience in the education sector, Mohd Azam will be able to further strengthen the country's education system and drive it towards greater excellence. ESSCOM boosts security and community benefits in Sabah's ESSZone
TAWAU: The Eastern Sabah Security Command (ESSCOM) has upheld its dual role of ensuring security and fostering community development in the Eastern Sabah Security Zone (ESSZone) over the past 14 years. Home Minister Datuk Seri Saifuddin Nasution Ismail highlighted ESSCOM's commitment to peace, enabling initiatives like the MADANI Adopted Village Programme in Kampung Inderasabah. Saifuddin noted that ESSCOM allocated RM1 million for infrastructure projects in the village, including physical and non-physical upgrades. The programme, part of a nationwide RM200 million initiative by Prime Minister Datuk Seri Anwar Ibrahim, aims to benefit 200 villages, with 12 to 13 under the Home Ministry. ESSCOM CEO Datuk Dr Jamaluddin Mohd Ali explained that Kampung Inderasabah was chosen due to its unique security challenges, eco-tourism potential, and proximity to Indonesian waters. Approved projects include a village entrance gate, pavilion upgrades, a school hall, futsal court, and mosque improvements.
