Emotional court hearing as State opposes bail for alleged cop killer

There was drama at the Cape Town Magistrate's Court on Monday as traffic officers and family members packed the court to witness the bail hearing of alleged cop killer Craig 'Krake' de Lilly.
The 41-year-old taxi driver stands accused of murdering traffic officer Walton van Rooyen in March 2020, and also faces charges of illegal possession of a 9mm pistol and 14 cartridges.
De Lilly, his taxi assistant and two other men were arrested shortly after the shooting in Acre Road, Kensington, but the case was provisionally withdrawn just a month later.
On Monday, family members of Van Rooyen and a group of traffic cops gathered outside before court proceedings to oppose bail after the court previously heard that the State wasn't planning to oppose De Lilly's release, despite him facing a Schedule 6 charge.
However, things took a turn when the court heard that the State has now changed its tune and will in fact oppose bail, a move that shocked De Lilly's family.
His lawyer told the court he has witnesses lined up to testify at the next appearance, and the matter was postponed to August 11.
De Lilly's family said they were sad and disappointed by the State's sudden shift, but still had empathy for Van Rooyen's loved ones, however, said De Lilly is innocent.

His aunt told the Cape Argus sister publication, the Daily Voice that when De Lilly was convicted of rape and robbery, he was a minor, and while he got gang tattoos in prison, he was never actually part of a gang.
'He never wanted that life, but he didn't have a choice,' she said.
'If justice is fair we just hope they give him a fair chance to get bail. We feel for [Van Rooyen's] family, but Craig also has a family and he is a different person.'
Mayco member for Safety and Security JP Smith said justice has been a long time coming.
'Just over a week ago we were informed that the suspect was re-arrested and many of us felt relieved. It has been a five-year wait for justice,' said Smith.
'I visited Walton's family at the time of his death and I can recall the heartache in the eyes of his relatives and friends. His death had a profound impact on the entire directorate.
'We believe that the State would not have recharged the suspect haphazardly and we have faith that they have applied their minds when assessing the docket.

Advertisement Next Stay Close ✕ Ad loading Mnisi, who was on parole at the time of the incident, was linked to the case through a single witness who later became uncooperative, as there was no forensic or additional evidence tying him to the crime, with the court finding the State's case too weak to proceed. On July 2, Mnisi's girlfriend, Pinky Gantso, testified at his bail hearing to provide an alibi for the day Likhona disappeared. Gantso detailed Mnisi's movements on May 31, painting a picture of a man following his normal routine, with Gantso saying Mnisi had visited her in Daveyton, Ekurhuleni, on the same day that Likhona disappeared, and on his return, proceeded to travel to Dobsonville, Soweto. The 39-year-old parolee, who faced several charges, including premeditated murder, appeared in the court on Wednesday where he was visibly relieved over the decision to withdraw charges. "I am so happy that the charges have been dropped against me, I was innocent all along because I was not involved in this," he said. The teen's mutilated body was discovered in an open field in Durban Deep, west of Johannesburg, on June 1, following Likhona's disappearance on May 31. Mnisi was charged with the murder and during his application to be released on bail, Mnisi raised an alibi that he did not know the deceased and that his phone records would prove that he was in Daveyton on May 31. In a statement, NPA spokesperson Phindile Mjonondwane stated that subsequent to Mnisi's bail hearing, the NPA had given instructions to the investigating officer to probe his alibi, and indeed, his phone was linked to a tower in Daveyton. "Furthermore, there were more statements obtained from other witnesses that confirmed that Minisi could not have been the last person to be seen with the deceased. The decision to withdraw charges is therefore fair and responsible under these circumstances. "The investigation continues to unearth what transpired on the day Fose was brutally killed. Zuma's lawyers dismiss Ramaphosa's reasons for suspending Mchunu as fallacy
JOHANNESBURG - Lawyers for former President Jacob Zuma have dismissed President Cyril Ramaphosa's reasons for suspending Minister of Police Senzo Mchunu as a fallacy that has proven unsuccessful in the past. The uMkhonto weSizwe (MK) Party, its leader, Zuma, and Ramaphosa battled it out on Wednesday in the Constitutional Court. ALSO READ: The party wants the president's decision to suspend Mchunu and appoint an acting police commissioner set aside. They are also challenging the judicial commission of inquiry that was necessitated by bombshell allegations made by KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi. Ramaphosa's argument in the Constitutional Court case against him by the MK Party is that it is rational that Mchunu be investigated for the allegations made before he decides to fire him. However, the MK Party's lawyer advocate, Dali Mpofu, said judging by the lack of prosecution of high-profile politicians implicated in the State Capture Commission of Inquiry, that is a fallacy, as many were rewarded with ministerial positions and seats in Parliament. Mpofu has used Gwede Mantashe as an example: 'The president to sustain that argument would have to pass the Mantashe test, and he fails dismally because, as we speak now, despite the tested allegations that were in the Zondo commission, what did the president do? He has appointed Mantashe acting minister of police, as we speak today.' While it noted the urgency of the matter with Professor Firoz Cachalia expected to take office as acting minister on Friday, the court has reserved its judgment.

Lusikisiki massacre: Delay sees court proceedings postponed again
LUSIKISIKI - There has been yet another delay in the Lusikisiki massacre case in the Eastern Cape, as the matter has once again been postponed. Six men are accused of the gruesome mass murder where 18 people were shot and killed at Ngobazana Village. On Wednesday, the matter returned to the Mthatha High Court sitting in the Lusikisiki Magistrate's Court for trial proceedings, with the State expected to lead evidence from its first witness. However, following a long adjournment, the matter was set aside for Thursday. Wednesday's proceedings started late due to one of the legal representatives having arrived late in court due to civil unrest. And when proceedings finally started, the State submitted affidavits and post-mortem results. The post-mortem results, which have been medically proven, show that the victims were shot and killed with high-calibre firearms. All defence lawyers, including accused 1, Mzukisi Ndamase, who is legally representing himself, did not oppose. However, due to some outstanding issues between the State and the defence, the court took a long adjournment for discussions in chambers. The case continues on Thursday.
