
'Consider ground realities': SC hears plea for restoration of J-K statehood
A Bench comprising Chief Justice of India BR Gavai and Justice K Vinod Chandran was hearing an application by college teacher Zahoor Ahmed Bhat, represented by Senior Advocate Gopal Sankarnarayanan, urging the Union Government to fulfil its assurance of restoring statehood.
'It has been 21 months since the judgment in the Article 370 case, and there has been no movement, despite the Union's statement before this Court that statehood would be implemented,' Sankarnarayanan told the Bench.
The application, filed as a miscellaneous plea in the disposed matter in regarding Article 370 of the Constitution, arises from the Court's 2023 verdict upholding the abrogation of Jammu and Kashmir's special status.
In that ruling, the Bench had refrained from examining the constitutionality of the Jammu and Kashmir Reorganisation Act, 2019 which bifurcated the erstwhile state into the Union Territories of J-K and Ladakh in view of Solicitor General Tushar Mehta's assurance that statehood would be restored 'at the earliest.'
The judgment had directed the Election Commission to conduct Assembly polls in J&K by September 30, 2024, and restore statehood 'as soon as possible,' but without fixing a binding timeline.
Senior Advocate Sankarnarayanan pointed out that the Court's own words in the Article 370 verdict contemplated restoration post-elections, yet no tangible step had been taken.
During today's hearing, SG Tushar Mehta opposed the plea, arguing it was 'not maintainable' and noting that in the past, the Court had imposed costs on similar petitions.
'Elections are held in a unique context in this part of the country, and several considerations inform decision-making,' he said. Another counsel stressed that 'the reality of the assurance is also important' and urged practical implementation.
CJI Gavai interjected to note, 'You also have to take into consideration the ground realities; you cannot ignore what has happened in Pahalgam,' referencing the recent terror attack.
Senior Advocate Maneka Guruswamy, appearing for applicant Irfan Lone, supported the call for restoration.
Other counsels suggested that a separate Bench be constituted to hear all connected pleas together.
The matter has now been listed after eight weeks, with the Court directing the Union to file its response before the next date.
'Let them file the response; immediately after eight weeks,' the CJI said.
The applicants, including activist Khurshaid Ahmad Malik, argue that the Union's failure to restore statehood in a time-bound manner undermines the basic feature of federalism.
They contend that peaceful Assembly elections have removed any plausible impediment such as security concerns or unrest.
'Therefore, there is no impediment of security concerns, violence, or other disturbances which would hinder or prevent the grant/restoration of statehood to Jammu & Kashmir as had been assured,' their plea states.

Manipur Governor gets additional charge of Nagaland after La Ganesan's death
Following Nagaland Governor La Ganesan's death, Manipur Governor Ajay Kumar Bhalla has been given the additional charge of discharging those functions. The Rashtrapati Bhavan made the announcement Saturday evening. La Ganesan, a veteran organiser for the Rashtriya Swayamsevak Sangh and one of BJP's longest-serving leaders in Tamil Nadu, died in Chennai Friday. Bhalla, who was formerly Union Home Secretary, was appointed Manipur governor in December 2024, less than two months ahead of President's Rule being imposed in the state in February this year. He had been the Union Home Secretary when the ongoing conflict in the state had begun on May 3 2023, and with the imposition of President's Rule — which has now been extended for another six months — is effectively in charge of administering the state. While there has been a significant decrease in active violence between Manipur's Meitei and Kuki-Zo communities — the last major cycle of violence between the two communities was in November last year — there is yet to be a breakthrough in dialogue between representatives between of the two communities, and they are currently not in talks with each other. Under his charge, the government in Manipur has aimed to address several key challenges in the state. This includes a call for people on both sides to surrender arms and ammunition looted from the state's armouries and an attempt to open up the state's highways for free movement of both communities through areas where the other community is in the majority. While the former was met with limited success, the latter misfired, with the state witnessing violence on the first day itself. The government is also currently trying to facilitate the resettlement of people displaced by the conflict. As Union Home Secretary, he oversaw the security situation after the scrapping of Jammu and Kashmir's special status in 2019, and the anti-CAA protests across the country. He was the chief nodal officer overseeing the COVID-19 lockdown.

Fishermen blame Centre; to go ahead with rail blockade agitation in Ramanathapuram district
Blaming the Union government squarely for the arrests and impounding of trawlers by Sri Lankan Navy, the Tamil Nadu fishermen on Saturday said that they would intensify their agitations. The fishermen have not been venturing into the sea for the last week due to the 'continued' arrests under charges of poaching. On Independence Day, they observed a token fast in Thangachimadam with families and children. On Saturday, the Ramanathapuram district administration had invited the striking fishers for a talk. However, it failed, they claimed. Speaking to media persons, fishermen leaders Emerit, Jesu Raj and among others said that the Union government had not taken any tangible steps to solve the issue with Sri Lankan government over the last five years or a decade. As a result, hundreds of fishermen were arrested and trawlers impounded. Under such circumstances, they told the officials that without any assurance from the governments, they would not withdraw the stir. In the last two months alone, 64 fishermen were arrested. On top of it, the fishermen were also jailed for six months to two years depending on the charges of repeating the offence. Hence, they announced to go ahead with the rail blockade stir on August 19.

Police's work not limited to maintaining law and order: Yogi
