The Bombay High Court on Monday questioned the Maharashtra government over the manner in which erstwhile Special Public Prosecutor (SPP) Pradip Gharat was removed from the trial in the case related suicide of Dr Payal Tadvi in 2019, allegedly due to harassment by her seniors.
The court asked the government lawyer to check with Gharat and inform if he was willing to come back to represent the state as SPP in the case.
A bench of Justices Ravindra V Ghuge and Gautam Ankhad was hearing plea by Abeda Tadvi, mother of late Payal, who had challenged the March 7, 2025 notification issued by state law and judiciary department that removed Gharat as SPP with immediate effect and appointed another lawyer Mahesh Mule.
The mother alleged that the decision was 'arbitrary and illegal' and will lead to delay in trial and risk of losing crucial evidence' and violative of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Payal's three seniors at TN Topiwala National Medical College and BYL Nair Hospital Dr Bhakti Mehare, Dr Ankita Khandelwal and Dr Hema Ahuja are named as accused in the case.
Gharat in February had filed an application before sessions court to add the then head of gynaecology department at the Hospital Dr Yi Ching Ling as accused for overlooking the harassment and ragging complaint by Tadvi. The trial court on February 28 ordered Ling's addition as an accused in abetment of suicide case.
'It is very easy to say that the public has great trust in the judiciary. These are testing times These are examples where it is tested. Now the impression of the petitioner is, for some reason, because Mr. Gharat acted strictly, he was removed. When order comes in your favour, Gharat is back and when order is adverse, Gharat is removed,' Justice Ghuge orally remarked.
Additional Public Prosecutor (APP) SV Gavand for the government submitted that the state government was well within its right and domain to take a decision of removal and claimed that Gharat's appointment too was made by state on its own and not at the mother's instance.
However, advocate Lara Jesai for the petitioner mother denied the same and submitted that she too had filed an application for his appointment.
The bench expressed displeasure over the justification given by the government to remove Gharat as SPP and said that the same was 'not in a good taste'.
The judges questioned the government lawyer, 'Gharat is a seasoned prosecutor. Such a senior advocate who has worked so hard for the state, got you (state government) so many convictions… He put so much hard work in that journalist's (J Dey murder) case. That time he was nice… Entire trial was conducted by him and you got a conviction for nine accused. Who is this officer who writes like this? Therefore, the petitioner wants us to scrutinise the decision (to remove Gharat as SPP) because her faith in the law is shaken.'
'We know it is in your domain but should be done judiciously,' the HC remarked.
'Show him what is written (justification for removal) and make an impression whether he would want to come back,' it told APP Gavand.
The court also sought to know who had made an application for Gharat's removal as SPP in January, and along with the file of such correspondence and posted further hearing to August 13.

Though the judge was not present at the time the fire occurred at his residence, a three-member in-house judicial inquiry later concluded that he exercised 'secret or active control' over the stash, prompting the Chief Justice of India to recommend his removal. The impeachment motion was read out in the House by Speaker Om Birla, who also announced the formation of a statutory committee to investigate the charges. As per the Judges (Inquiry) Act, 1968 and related rules, the panel will include a sitting Supreme Court judge, a Chief Justice from a High Court, and a distinguished jurist. He said, 'I have found substance as per the rules in the motion and have admitted it for discussion. I have also constituted a three-member committee to investigate the matter, which includes: Justice Arvind Kumar, Supreme Court; Justice Manindar Mohan Shrivastava, Chief Justice of Madras High Court; and Mr V.V. Acharya, senior high court, Karnatka High Court. The committee will soon give its report, and till then the motion will remain pending.' Justice Varma had challenged the inquiry's findings in the Supreme Court, arguing procedural unfairness and constitutional overreach. However, the apex court dismissed his plea last week, stating that the process was 'transparent and constitutional', and criticised his decision to participate in the inquiry while later questioning its legitimacy. If the committee finds merit in the allegations, the motion will require a special majority in both Houses -- a two-thirds vote of members present and voting, and a majority of the total membership -- before being sent to the President for final approval. This marks only the third time in independent India's history that impeachment proceedings have been initiated against a sitting judge, underscoring the gravity of the charges and the institutional resolve to uphold judicial integrity.

Haryana rights panel seeks report on 27 govt schools in Hisar in unsafe buildings

The Haryana Human Rights Commission on Tuesday took suo motu cognizance of 27 government schools functioning in unsafe buildings in Hisar district and directed officials to make safe arrangements for students within eight weeks. The commission said after seven students were killed and 28 injured when a building collapsed in neighbouring Rajasthan recently, the state government should take proactive measures to ensure no such tragedy occurs in Haryana. (PTI file) 'Multiple government schools continue to function in buildings that have been officially declared condemned due to their unsafe structural condition. Children, some as young as six years old, are being exposed daily to unsafe structures, many of which include broken staircases, damaged water tanks, sealed toilets and unstable walls and roofs,' the three-member commission, led by justice Lalit Batra (retd), said. The panel said that the ground situation in Hisar district reveals not merely administrative negligence but threat to the safety, dignity and psychological well-being of schoolchildren. It observed that the absence of safety protocols amounts to a direct and deliberate compromise with the lives of the students. 'Such conditions not only violate the physical safety of the students but also result in mental trauma, fear, and academic disruption undermining their right to education in a safe environment,' said justice Batra, adding 'During monsoon, there is a risk of exposure to snakes and other threats due to the lack of proper infrastructure. In severe instances, entire school buildings, including toilets, staircases and kitchens, have been rendered unusable.' The panel said it is the constitutional duty of the state government and the department of education to ensure the safety of students. It said that the failure to provide basic infrastructure, including structurally safe buildings, toilets, water and classrooms, particularly after buildings have been officially declared unsafe, constitutes criminal abdication of duty and gross violation of child safety norms under the Right of Children to Free and Compulsory Education (RTE) Act, 2009. It directed the principal secretary, school education, director general of secondary education, Hisar deputy commissioner and additional deputy commissioner along with the district education officer to submit a report about the status of each condemned building and safe arrangements for students within eight weeks. The panel also sought a timeline for reconstruction and budget allocation, number of students impacted, alternate accommodation provided or proposed and explain the delay in the reconstruction/relocation despite condemnation of buildings.

The Election Commission of India (ECI) has initiated proceedings to delist another 476 Registered Unrecognised Political Parties (RUPPs) for failing to contest elections for six consecutive years. By delisting inactive parties, the ECI aims to promote transparency and accountability in the electoral process.(PTI File Photo) This move is part of the ECI's ongoing efforts to clean up the electoral system and ensure that only active and engaged parties are registered. "As part of a comprehensive and continuous strategy of the Election Commission to clean up the electoral system, ECI has been conducting a nationwide exercise to identify and delist Registered Unrecognised Political Parties (RUPPs) that have failed to fulfil the essential condition of contesting even a single election for 6 years continuously, since 2019," ECI said on Monday. In the first round of this exercise, the ECI delisted 334 RUPPs on August 9, 2025, reducing the number of listed RUPPs from 2,854 to 2,520. "The Election Commission of India (ECI) has initiated proceedings to delist another 476 Registered Unrecognised Political Parties (RUPPs) for failing to contest elections for six consecutive years. This move is part of the ECI's ongoing efforts to clean up the electoral system and ensure that only active and engaged parties are registered," added ECI. Political Parties (National/State/RUPPs) in the country are registered with the ECI under the provisions of Section 29A of the Representation of the People Act 1951. Under provisions of the Act, any association once registered as a political party, gets certain privileges and advantages such as symbol, tax exemptions amongst others. Guidelines for registration of Political Parties mention that if the party does not contest elections continuously for 6 years, the party shall be taken off the list of registered parties. "As part of the second round of the exercise, another 476 RUPPs have been identified, which are from different States and UTs across the country," added ECI. The ECI has directed the Chief Electoral Officers (CEOs) of respective states and union territories to issue show-cause notices to the identified RUPPs, giving them an opportunity to respond and participate in a hearing. Based on the reports of the CEOs, the ECI will take a final decision regarding the delisting of these RUPPs. The ECI's objective behind this exercise is to maintain the integrity of the electoral system and prevent dormant parties from misusing the privileges and advantages granted to registered political parties. By delisting inactive parties, the ECI aims to promote transparency and accountability in the electoral process.
