Hartalega shares fall on tax bill, weaker quarterly earnings

KUALA LUMPUR: Shares in glove manufacturer Hartalega Holdings Bhd fell in early trade on Wednesday after it disclosed a RM101.36 million additional tax bill from the Inland Revenue Board (LHDN) and reported weaker first-quarter earnings.
At 10.07 am, the counter dropped six sen, or 4.55 per cent, to RM1.26, with 12.08 million shares changing hands.
In a filing to Bursa Malaysia on Tuesday, the company said its wholly owned subsidiary, Hartalega NGC Sdn Bhd, had received a notice of additional assessment from LHDN for the years of assessment 2017 to 2022.
Hartalega said it is seeking legal advice and evaluating its options, which may include filing a formal appeal.
For the first quarter ended 30 June 2025, the group posted a lower net profit of RM12.61 million, compared with RM31.93 million a year earlier. Revenue declined to RM553.11 million from RM583.84 million previously.
Public Investment Bank Bhd said it expects Hartalega to remain under pressure due to rising operating costs, persistent overcapacity in the sector, and intense price competition from regional players, particularly in China.
"Pricing pressure is expected to persist, especially in non-US markets, where Chinese manufacturers continue to offer products at a steep discount of a cumulative US$14-15 per 1,000 pieces,' it said in a note today.

(Bernama pic) PETALING JAYA : MCA president Wee Ka Siong has defended his call for the tax appeals system to be reformed, which led to a call for him to be referred to Parliament's rights and privileges committee. The Ayer Hitam MP had cited the legal dispute between Tenaga Nasional Bhd and the Inland Revenue Board (LHDN) yesterday when calling for LHDN to be made an independent statutory body reporting to Parliament. He said such an approach would be a key reform to ensure LHDN was free from political interests or pressure. TNB is facing a RM5.05 billion tax bill following a Federal Court ruling that it is not eligible to claim reinvestment allowance. The apex court had earlier overturned a Court of Appeal ruling that found TNB to be in the business of manufacturing electricity. The Federal Court said TNB should actually have been considered a utility company under Schedule 7B of the Income Tax Act 1967 (ITA). The dispute arose when LHDN disallowed TNB's claim under Schedule 7A of the ITA on the basis that the generation, distribution and transmission of electricity was not manufacturing of electricity. In a statement today, Wee said that no one was disputing the court's ruling that TNB should have applied under Schedule 7B, nor was it about the company's status as a utility or manufacturer. 'The real issue is the fate of RM5 billion in rakyat's savings,' he said. He said what DAP's Chong Zhemin 'conveniently ignores' was that TNB was majority-owned by public savings funds through Amanah Saham Nasional Bhd, EPF, the Retirement Fund Inc (KWAP), Lembaga Tabung Haji and others. If the government, via LHDN, enforced the court ruling, the RM5 billion would go into its coffers, he said. He said the law clearly gave the finance minister absolute power to approve TNB's appeal and re-application under Section 7B to waive the disputed amount. Yesterday, Wee and Chong, who is the Kampar MP, traded bards in the lower house when Wee claimed that it would be 'daylight robbery' if the government decided to enforce the ruling. This led to Chong claiming that the 'daylight robbery' remark was inaccurate, and accused Wee of misleading the house. Chong also demanded Wee retract the claim and threatened to refer him to the rights and privileges committee.

KUALA LUMPUR : Lim Guan Eng (PH-Bagan) has proposed the formation of a special taxpayer tribunal to address what he describes as growing dissatisfaction and complaints from individuals and small and medium-sized enterprises (SMEs) over unfair treatment by the Inland Revenue Board (LHDN). When debating the 13th Malaysia Plan, Lim said that while LHDN's efforts to boost government revenue were commendable, they must also be balanced, with fair and reasonable enforcement. 'I propose the formation of a special taxpayer tribunal to protect individuals and SMEs from feeling that they are being treated unreasonably, victimised or subjected to double standards in enforcement,' he told the Dewan Rakyat. Lim, a former finance minister, said taxpayers often complained that they were being pressured by unreasonable tax assessments by LHDN. 'Even though LHDN's efforts to increase national revenue are appreciated, these must be balanced with reasonable action so that bank accounts are not frozen arbitrarily,' he said. Lim also highlighted delays in tax refunds. He said this was a recurring issue, particularly for individuals or companies that have overpaid or made advance estimated tax payments. 'Why are they not getting their refunds within the stipulated 30-day period? Some companies have complained that they had to wait more than three years to get their tax refunds. What is the total amount of these overdue refunds?' He also raised concerns about confusing enforcement practices, such as those related to transfer pricing. 'One example is that companies are now required by LHDN to impose interest on funds transferred to subsidiaries, which is then treated as income and taxed accordingly,' he said.

Kota Kinabalu: The Government is strongly urged to rescind its move to tax the fundraising activities of community organisations and associations because the funds raised by them and other voluntary bodies are badly needed for the associations' own needs. The new tax rule is also causing confusion, distress and anxiety to society and community leaders, said former Chief Minister Datuk Seri Yong Teck Lee. Advertisement The Practice Note 1/2025, issued on March 24 by the Inland Revenue Department, extended the definition of taxable person as a 'body of persons' that includes community associations. 'I echo the views of Tan Sri T.C. Goh, President of the Gabungan Persatuan Cina Sabah (HuaZhong), that this new tax will create unnecessary burden for 10 of thousands of active NGOS nationwide. 'Any excess from fundraising activities is not for commercial purposes but for long-term community programmes.' Non-compliance could expose community leaders to criminal charges, Yong said. Advertisement He said adding to the burden of yet another new tax is the scary hazard of having to comply with new tax regulations because any misstep or mistake or non-compliance, however unintended, could expose the association leaders to criminal charges of tax evasion. 'It is a fact that most, if not all, associations cannot afford the professional services of accountants and auditors and tax planners. 'Associations leaders consist mainly of selfless people who spend their own time and money on social and community service,' said Yong who is Sabah Progressive Party (SAPP) President. He said community fundraising itself is already a very arduous task, with community leaders literally having to beg sponsors. 'The community leaders and sponsors are the same ordinary business people who have recently been hit by SST (Sales and Services tax), e-invoicing on all transactions and stamp duties on employment contracts. 'In spite of optimistic statements coming from ministers, the reality is that the business environment is subdued. 'Ministers, please do something.
