The bench of Justice Praveer Bhatnagar, however, granted bail to Katara's nephew, Vijay Damor, citing the relief already extended to other similarly placed accused by the Supreme Court.
Katara, arrested on April 18, 2023, sought bail on grounds that he was in custody for an extended period and the trial was likely to take longer. His counsel argued that prolonged incarceration without the conclusion of the trial warranted bail.
Rajasthan govt, however, opposed the plea, stating that Katara played a key role in the leak while serving as an RPSC member. According to the Special Operations Group (SOG), he misused his official position by obtaining the exam paper and taking it to his residence, where it was shared with others involved.

RPSC files FIR against steno for fake disability cert
Ajmer: Rajasthan Public Service Commission (RPSC) Thursday registered an FIR against its office stenographer, Arun Sharma, for having used a fake disability certificate to secure the job in the recruitment exam of 2018. According to the FIR, the exam was conducted on July 4, 2018, with five posts of stenographers reserved for candidates blind or with low vision. The FIR stated that Sharma applied for this category and submitted a certificate purportedly prepared by a medical board for permanent low vision, showing 70% damage in the eyes. During verification of documents on April 4, 2022, based on the medical certificate, RPSC approved provisional selection of Sharma. He was directed to submit his medical certificate to JLN Medical College for verification. On June 24, 2022, Sharma joined duties as stenographer in RPSC. On June 6, 2024, RPSC decided to re-check certificates of all those who had been given appointments in the last five years. An internal committee sent a request to JLN Medical College to reconfirm the certificates. This time, Sharma skipped appearing before the medical board. After legal notices were served on him, Sharma appeared before the board at SMS Hospital Jaipur on April 23 this year, and the medical board conducted a test. The report was submitted on May 20, showing that Sharma had low visibility but only less than 30 percent, and, therefore, did not fall in the category of blind or low vision. "Not Going To Lose Our Cool": Supreme Court On Another Faulty High Court Order
Days after controversy over Allahabad High Court judge's faulty order, the Supreme Court bench of Justices JB Pardiwallah and R Mahadevan on Wednesday set aside a Rajasthan High Court order denying anticipatory bail to a couple in a case which was found to be a civil dispute but was given a criminal colour. Justice JB Pardiwallah remarked that he was "controlling like anything" and would laugh it off this time. "We are not going to lose our cool today. Today, we are controlling like anything. The medicine is to laugh," he said, before bursting into laughter on reading the case file with the same mistake that had triggered him to bar a high court judge from hearing criminal cases till he retires. The Supreme Court last week slammed Justice Prashant Kumar of the Allahabad High Court for his remarks made in a judgment suggesting that criminal prosecution may be permitted to recover money as an alternative remedy in a civil suit. The same bench of Justice JB Pardiwallah had ordered the removal of criminal cases from Justice Kumar's roster after finding that he had allowed criminal prosecution to continue in a purely civil dispute. This move had sparked controversy as 13 judges from the Allahabad High Court then wrote to Chief Justice of India BR Gavai, saying that a Chief Justice of a high court is the master of the roster in the high court and Justice Pardiwallah's order was a judicial overreach. CJI Gavai then sent the case back to Justice Pardiwallah's bench of reconsideration. On August 4, the bench of Justice Pardiwallah rolled back the directive that had barred the Allahabad high court judge from hearing any criminal cases for the remainder of his tenure and ordered him to sit with a senior colleague to "learn the nuances of law." The controversy had barely subsided when another such case, this time from the Rajasthan High Court, came in front of the same bench. The top court was hearing an appeal by a couple against the Rajasthan High Court's refusal to grant them anticipatory bail in a case arising from an alleged unpaid amount for a plywood consignment. The complaint claimed Rs 3.5 lakh had been paid, but the balance of Rs 12.5 lakh remained unpaid. A first information report (FIR) was registered against the couple under Sections 420 (cheating), 406 (criminal breach of trust), and 120B (criminal conspiracy) of the Indian Penal Code. The top court noted that even on a plain reading of the case, the only possible allegation was cheating. It was observed that the offence of criminal breach of trust could not arise once there was a sale transaction. "It is but obvious that the only submission before the High Court could be that it is a case of civil dispute. There is no question of criminal breach of trust once there is a sale transaction. This is a settled position of law," the court said. The judges expressed disappointment with the reasoning in the High Court order, particularly the part that recorded the submission of the public prosecutor that recovery of the Rs 12.5 lakh balance could not be effected because the accused were protected from arrest. Justice Pardiwallah laughed again and said, "What we have understood is that according to the State, police machinery is required for the purpose of recovery of the balance amount. We need not say anything further in the matter. Ordinarily, we do not set aside orders of the High Court denying bail. But this is an order we deem fit to set aside."

Can't hold student union elections this academic year, Rajasthan govt tells High Court, citing NEP
The Bhajan Lal Sharma government has submitted in the Rajasthan High Court that it can't hold student union elections in the current academic year. The submission has been made in the matter of a Public Interest Litigation (PIL) filed by a Rajasthan University post-graduate student Jai Rao. Rao's counsel, advocate Shantanu Pareek, said that the state government 'submitted its reply today in the student union election PIL where it has submitted that it won't hold student union elections for 2025-26 (academic year)'. 'The state government has cited the meeting of Vice Chancellors on August 6 and April 12, where the VCs said that they are focusing on implementation of the National Education Policy (NEP). They said that if student union elections are held, they will not be able to implement the NEP and hence, the VCs submitted that student union elections should not be held in the current circumstances,' Pareek said. As per the VCs' meeting on August 6 — where at least nine VCs were present – one of the VCs said that the student union elections will be a hindrance to timely implementation of NEP. Another VC said that the elections will adversely affect the semester system. A third VC said that elections affect studies and the semester system, which in turn delays the results, and deprives students from taking admission in other states. Other VCs said that student union elections affect about two months' time-table and that a mandatory 90 days' teaching in each semester under the Choice Based Credit System (CBCS) makes it difficult to hold student union elections. Interestingly, the Bhajan Lal Sharma government has followed a pattern similar to the Ashok Gehlot government in 2023, a state election year, when the Congress party was still smarting from NSUI having failed to win any president post in the student union election held a year ago in 2022. Like the Gehlot government, the Sharma government has cited the NEP and violation of Lyngdoh Committee Recommendations. In his petition, Rao had said that the 'right to choose representative through the student union elections has been categorized as a fundamental right by the Hon'ble Supreme Court.' He had said that as per the Lyngdoh Committee recommendations, the state government and Rajasthan University are 'constitutionally duty bound to issue such circular/notification within 6-8 weeks from the commencement of the academic session' with regards to the student union election but that none has been issued yet. Apart from Rao, at least two other petitions were filed with regards to student union elections. The matter is scheduled to come up for hearing on Thursday, August 14.
