Sagar Dhankhar murder case: Supreme Court cancels bail of Olympic wrestler Sushil Kumar

Indian Express4 days ago
The Supreme Court Wednesday cancelled the bail granted to Olympic wrestler Sushil Kumar, facing trial in the 2021 murder of wrestler Sagar Dhankhar in Delhi's Chhatrasal Stadium.
A bench of Justices Sanjay Karol and P K Mishra gave Kumar a week to surrender.
The order came on an appeal filed by the father of Sagar Dhankhar challenging the March 4, 2025, order of the Delhi High Court granting him bail. While granting him bail, the HC noted that only 30 of the 186 prosecution witnesses have been examined in the three years since the trial began.
Dhankar, who had competed in the 97-kg Greco-Roman category, was beaten to death in a clash involving two groups at the stadium on May 4, 2021. Sushil Kumar's name cropped up when a video of the incident purportedly featuring him came to light. He was arrested after a lookout notice was issued for him as he was on the run.
In October 2022, the sessions court framed murder charges against Kumar and 17 others in connection with the killing of 27-year-old wrestler Dhankhar. The court said there was a strong case of murder and attempt to murder after a conjoint reading of witness statements, along with the location chart, medical evidence and other evidence mentioned in the chargesheet.
The court also framed charges under Indian Penal Code (IPC) sections 323 (voluntarily causing hurt), 120 B (criminal conspiracy), 142 (being a member of unlawful assembly), 148 (rioting armed with a deadly weapon) and 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object).
The Delhi Police have accused Sushil Kumar of conspiring with his associates from Delhi and Haryana and asking them to attack Dhankhar.

Court allows man 1.8 crore damages plea in dowry case

Gurgaon: A district court has awarded Rs 1.8 crore in damages to Gurusharan Lal Awasti, a UK citizen, who was falsely implicated in a dowry harassment case by his wife. The court's decision comes after Awasti was acquitted of all charges in 2017, prompting him to file a suit for "malicious prosecution" against his wife, Shalini Vashisht. The legal battle began in 2008, when Awasti — an Indian-origin British citizen — married Shalini, a city resident. Awasti later discovered discrepancies in Shalini's educational qualification, which led to tension between the couple. In 2009, Shalini filed a dowry harassment complaint against Awasti and his family, accusing them of cruelty, criminal breach of trust, and intimidation. An FIR was also registered against him for domestic violence and other IPC sections. Awasti was arrested during a visit to India in 2014. He spent 31 days in Bhondsi jail before being granted bail. He frequently travelled between London and Gurgaon for the trial, pleading for a speedy resolution. In 2017 — after an arduous eight-year legal battle — the district court acquitted Awasti and his family, citing inconsistencies in Shalini's statements and insufficient evidence from the prosecution. Her lawyer, Rishi Raj Yadav, argued that the damages suit was baseless, as the acquittal was under appeal in the high court and Awasti had not paid the required court fee. However, Awasti's lawyer, Kirti Sejwal, clarified that the court fee would be paid based on any decree awarded for damages. On Aug 13, civil judge (senior division) Manish Kumar ruled in favour of Awasti, stating that the pending appeal did not negate the trial court's acquittal, which formed the basis of the damages claim. Consensual sex with girl on verge of turning 18 not offence: HC

Madras high court CHENNAI: A man's consensual sex with a girl, who was just 19 days short of turning 18 years old, cannot be an offence under the Pocso Act, ruled Madras high court, acquitting the man of all charges. He had been sentenced to undergo rigorous imprisonment for five years by a trial court in Coimbatore. Reversing the trial court ruling, Justice GK Ilanthiraiyan said the girl was capable of understanding the consequences of her actions and that her age at the time of the incident could not be proved beyond doubt. "There is nothing in the evidence to show that the appellant took away or enticed the victim to flee with him. Therefore, the charge under section 363 of IPC is not made out against the appellant. Further, the family members of the victim were aware that the victim was having a love affair with the appellant,' said the judge. The criminal appeal was filed against the order pronounced by the Pocso court in Coimbatore, where the man, who was her boyfriend, was convicted on charges of having sex with her at her house and later at his grandparents' house. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Benefits of Trading Bitcoin CFDs IC Markets Learn More Undo Citing a Bombay high court order acquitting a man in a similar case, Justice Ilanthiraiyan noted that nowhere in the trial did the victim testify that the sexual intercourse was forcible and without her consent, thus allowing the appeal. Mohali court rejects anticipatory bail of accused in Rs 32 lakh flat fraud case

The Mohali district court has delivered a significant ruling, with the court of the Additional Sessions Judge rejecting the anticipatory bail plea of accused Gurmeet Singh in a high-value property fraud case. The case was registered by the Kharar police under sections 420 (cheating) and 120-B (criminal conspiracy) of the IPC. According to the complainant, she wanted to buy a flat in Mohali for her daughter's better education. Her husband came in contact with Vijay Singh, Sanjeev Kumar, and Gursevak Singh, who later introduced him to Gurmeet Singh. The accused allegedly showed them flat no. 348-A in Sector 115, Gunjan Land Developers, and finalised the deal at Rs 32 lakh. The complainant paid the amount in instalments. However, when the time for registry came, the accused and his associates started making excuses. Later, it was discovered that the same flat had already been sold to another party. The public prosecutor argued in court that 'serious allegations are pending against the accused and custodial interrogation is necessary'. However, the defence counsel claimed that Gurmeet was innocent and ready to cooperate with the investigation. After hearing both sides, the court observed that the allegations were of a grave nature and, therefore, anticipatory bail could not be granted. Consequently, Gurmeet's bail plea was dismissed.
