Ungaludan Stalin and Nalam Kaakkum Stalin: Madras High Court to wait for Supreme Court orders on naming schemes after living personalities

The Madras High Court on Monday (August 4, 2025) decided to wait for the orders to be passed by the Supreme Court on Wednesday (August 6) on an appeal preferred by the Dravida Munnetra Kazhagam (DMK) against the High Court's July 31 interim order prohibiting the use of the name of any living personality in the nomenclature of government schemes. Appearing before the first Division Bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan, senior counsel Vijay Narayan, representing All India Anna Dravida Munnetra Kazhagam (AIADMK) Member of Parliament Shanmugam, said, the DMK had filed an appeal and made a mention before the top court on Monday. The Supreme Court had agreed to take up the appeal for hearing on Wednesday, the Bench was told. Immediately, the Chief Justice decided to adjourn a modification/clarification petition filed by the Tamil Nadu government before the High Court to Thursday (August 7), since it was the same interim order that had been taken on appeal to the top court. Senior counsel Abhishek Manu Singhvi and Advocate General P.S. Raman tried to persuade the Chief Justice's bench that the clarification/modification petition filed by the State government could be heard by the High Court dehors the appeal filed by the DMK before the Supreme Court. However, the Chief Justice felt it would be better to await the top court's decision. The Bench had passed the interim orders on July 31, following a public interest litigation petition filed by Mr. Shanmugam questioning the use of Chief Minister M.K. Stalin's name in the public outreach programme titled 'Ungaludan Stalin.' After the release of the order on August 1, the Tamil Nadu government sought a clarification that it would not apply to 'Ungaludan Stalin' and 'Nalam Kaakkum Stalin' schemes. Since the Chief Justice's bench agreed to hear the modification/clarification petition on August 4, the government went ahead and launched the 'Nalam Kaakkum Stalin' scheme on August 2. This prompted Mr. Shanmugam to file a contempt of court petition too, through his counsel K. Gowtham Kumar, against Public Department Secretary Rita Harish Thakkar and Health Secretary P. Senthil Kumar on Monday. In the meantime, the DMK preferred an appeal against the High Court's interim order and also obtained permission from the top court to get it heard on August 6.

Tamil Nadu challenges HC order barring use of former CMs' photos, party symbols in scheme ads

The Tamil Nadu government has moved the Supreme Court against a Madras High Court order restraining it from naming welfare schemes after living politicians and using the photographs of former chief ministers, ideological leaders and political party symbols in advertisements, Live Law reported on Monday. Chief Justice BR Gavai agreed to hear the plea on Wednesday after advocate Mukul Rohatgi, appearing for the state, sought an urgent listing, calling the matter 'extremely unusual', Bar and Bench reported. On Thursday, the High Court passed the order on a public interest litigation filed by All India Anna Dravida Munnetra Kazhagam MP C Ve Shanmugam. He had sought directions to stop the Dravida Munnetra Kazhagam government from using Chief Minister MK Stalin's name in public outreach programmes such as Ungaludan Stalin (With You, Stalin) and Mudhalvarin Mugavari (Chief Minister's Address). Shanmugam had argued that such practices violated the Supreme Court's earlier directions as well as the Government Advertisement Content Regulation Guidelines, 2014. The court referred to an earlier Supreme Court ruling that allows using the current chief minister's photo in government ads, but said including former leaders or party icons could be seen as political misuse of public funds, the Hindustan Times reported.

Nalam Kaakkum Stalin scheme: AIADMK MP C.Ve. Shanmugam files contempt plea against T.N. Health, Public dept. secretaries

All India Anna Dravida Munnetra Kazhagam (AIADMK) Member of Parliament Shanmugam has filed a contempt of court petition against Tamil Nadu Public Department Secretary Reeta Harish Thakkar and Health Secretary P. Senthil Kumar for having used the nomenclature 'Nalam Kaakkum Stalin' for a health scheme launched on August 2, 2025, despite an interim prohibitory order passed by the court on July 31, 2025. The contempt plea is expected to be listed before the first Division Bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan. In an affidavit filed through his counsel K. Gowtham Kumar, the MP stated the Bench had passed a detailed interim order last week making it clear the nomenclature of no government scheme should bear the name of a living personality. Within hours after the order was released on August 1, 2025, the Public Department Secretary filed a petition seeking a clarification that the interim order would not apply to 'Ungaludan Stalin' and 'Nalam Kaakkum Stalin' schemes. The clarification/modification petition was not listed for hearing on August 1, 2025, and the court had not passed any order either clarifying/modifying its orders. Yet, the government machinery had gone ahead and launched the 'Nalam Kaakum Stalin' scheme on August 2, 2025, in blatant violation of the interim orders passed by the court, the MP complained. He said, the filing of the modification/clarification petition by itself was sufficient to prove the officials were well aware of the prohibition imposed by the court on naming government schemes after living personalities. 'In effect, the respondents have reduced the modification petition to a mere formality and an eyewash to escape the clutches of contempt and have proceeded to use the name of the scheme (Nalam Kaakkum Stalin) in contravention to the orders passed by the court. The respondents have used the modification petition as a shield against their illegallties. They cannot be allowed to blow hot and cold at the same breath,' the contempt affidavit read.
