Thane: A 13-year-old girl's testimony proved crucial in securing a conviction for a 50-year-old who sexually assaulted and harassed her, reports Nishikant Karlikar. Special judge D S Deshmukh of Thane special court convicted and sentenced the accused to the time already served in jail since his 2019 arrest.
The accused, a neighbour, allegedly lured the girl into his home while her mother was at work.
Special public prosecutor Rekha Hiwrale said the girl, then seven years old, told her mother upon her return that the accused dragged her into his house, promising her a "big chocolate". The child alleged he removed their clothes, touched and kissed her, and attempted more serious sexual acts.
During the trial, the prosecution presented four witnesses, including the victim and her mother. The court found sufficient evidence for sexual assault and harassment, and convicted the accused under the Pocso Act.

VARANASI A home guard posted at Mubarakpur police station in Azamgarh for over two decades has been found facing eight serious criminal cases, including charges under the NDPS Act, Pocso Act, rape and theft, police said on Tuesday. In 2003, the first case was registered against him under the NDPS Act for allegedly possessing a large quantity of diazepam tablets and 'intoxicated laddoos'. (Pic for representation) Nirankar Ram, a native of Azamgarh's Damodarpur village, was appointed to the home guards department in 2001 and allegedly embarked on a crime spree soon after. He was found to have been booked in six cases at the very police station where he had been serving for the past 22 years, an officer said. According to the police, six cases related to alleged smuggling of marijuana were registered against Nirankar Ram. In 2003, the first case was registered against him under the NDPS Act for allegedly possessing a large quantity of diazepam tablets and 'intoxicated laddoos'. Between 2003 and 2017, he was booked in eight cases, including theft and sexual assault. Since his suspension a month ago, Nirankar Ram is not engaged in any kind of duty, the police clarified, after a section of social media reported that he was on the job. 'There's a news from a social media platform in which it has been said that home guard Nirankar Ram, a resident of Damodarpur in Azamgarh, is posted at Mubarakpur police station and is doing duty there,' said SP (city) Madhuban Singh. 'Many cases are registered against him. Earlier, information was received about this home guard's activities, after which a detailed report was sent by the Mubarakpur police station to the home guard commandant. Based on that, the commandant suspended the home guard. For the last one month, Nirankar Ram is not on any kind of duty. Further action is being taken against him,' he added. Inputs from PTI

33-year-old man raped and murdered his minor cousin after she tied Rakhi on his wrist. He staged it as suicide, but police found evidence. Rakshabandhan, a festival where a brother promises to protect his sister, was shamed after a cousin allegedly raped and murdered his minor sister hours after she tied Rakhi on his wrist. The disturbing news was reported from Uttar Pradesh's Auraiya. As per the police, after killing the girl, he hung her body from a noose to make it look like suicide. As per a report by NDTV, after celebrating Rakshabandhan on Saturday, 33-year-old Surjeet went back to his home upon consuming a lot of alcohol. He raped the girl while she was asleep and then killed her. As per the police, the girl's father was asleep in the next room but couldn't hear anything. The girl's body was found hanging the next day. After the gruesome killing, Surjeet started misleading the investigation. Police got suspicious when he did not let any other family member answer the questions. As the police reached the murder spot, they were sure it was not a suicide case because there were bloodstains in several places. Her body was sent for a post-mortem, which confirmed rape. NDTV further reported that Surjeet was held and he confessed to the crime during interrogation. PTI report, the police have arrested the 29-year-old relative, the husband of the class 10 student's paternal aunt, under various sections of the BNS and POCSO Act. The police further said, the accused was remanded to judicial custody after a local court rejected his bail application. Police also detained four other accused who also video recorded the rape. As per the girl's complaint, the relative visited their residence on Raksha Bandhan on August 9, and took her to a deserted place where she was gang-raped. Noida: A special Pocso court on Tuesday convicted and sentenced a former swimming pool lifeguard at a wellknown school chain's Greater Noida campus to life imprisonment "till the last day of his natural life" for sexually assaulting a three-year-old student in 2018. Tired of too many ads? go ad free now The court, which pronounced a double life term under IPC and the protection of Children from Sexual Offences (Pocso) Act, also held the school's management financially liable for failing to protect the child and ordered the two investigating officers of the case to stand trial for "abetting the assault". Judge Vijay Kumar Himanshu of the additional district and sessions court cum special Pocso court convicted the former lifeguard, Chandidas, under Section 376AB of IPC and Section 5(m) of Pocso (aggravated penetrative sexual assault on a child under 12). Chandidas, who is currently out on bail, was also handed another seven-year term under Pocso Act Section 9(f), read with Section 10, for abusing his position as a school employee. The court imposed a fine of Rs 24,000 on the convict and ordered the school's managing society to pay Rs 10 lakh in compensation to the girl for rehabilitation within one month, as directed by National Legal Services Authority. The child, then a nursery student, was raped by the lifeguard during swimming class at the school's splash pool on July 12, 2018. She had told her class teacher about the incident. On returning home, she complained of stomach pain and discomfort. She later told her mother that the "swimming pool uncle" had touched her private parts. A medical examination at Delhi's Guru Teg Bahadur Hospital confirmed penetrative sexual assault. An FIR was lodged the next day at Surajpur police station. Chandidas was arrested from the school principal's chamber. Tired of too many ads? go ad free now Special public prosecutor (Pocso) Chhavanpal Singh said the prosecution presented 12 witnesses and 14 documentary and electronic exhibits and sought the harshest sentence not just for Chandidas but also for the school, which "failed to act as a custodian of its students". The defence argued that the child's family had a grudge against the school and had "tutored" her into making allegations that were unsupported by medical evidence. The court, however, found the child's statements to police, a magistrate and in court consistent and credible, and corroborated by medical findings from GTB Hospital. The testimony of her parents further supported her account. The court described the school management as a "joint tortfeasor" (legal term for an entity committing a tort or a wrongful act), noting that its inaction and suppression attempts directly contributed to the child's trauma. It cited its powers under Section 33(8) read with Section 9 of the Pocso Act to impose the Rs 10 lakh penalty on the school. "Their attempt to suppress and influence the machinery is clearly apparent and palpable, which cannot be done without the active connivance of the school management society. Hence, the court feels that the school management shall be made vicariously liable for the lapses in terms of awarding compensation for the mental trauma suffered by the victim and her family," the judge noted. The court found the roles of the two IOs, Sita Singh and Rashmi Chaudhary, dubious in the investigation. The IOs had filed a closure report against the principal and class teacher despite evidence available on record. "This court finds there is sufficient evidence available on record to show that to shield the co-accused, the principal and class teacher, both the IOs conducted defective and motivated investigation. Therefore, through deliberate and intentional omission in discharge of duty, they have abetted the offence of sexual assault amounting to rape against the child," the court said in its ruling, declaring the two IOs co-accused under Section 17 of the Pocso Act.
