Thane man convicted of sexually assaulting 6-year-old girl; sentenced to 20 years of rigorous imprisonment

THANE: A special court in Thane under the Protection of Children from Sexual Offences (POCSO) Act convicted a 48-year-old man from Wagle Estate for the sexual assault of a six-year-old child, sentencing him to two decades of rigorous imprisonment. Tired of too many ads? go ad free now Judge DS Deshmukh also ordered the convict, Anwar Babu Sheikh, to pay Rs 10,000 in fines, which will be awarded to the survivor as compensation. The court's decision came after the prosecution successfully proved all charges under the POCSO Act and Indian Penal Code. Prosecutor Sandhya Mhatre presented evidence showing that the April 2022 incident occurred when the child was playing near her home. The accused, a neighbour, enticed the child into his residence where the assault took place. The case came to light when the child disclosed the incident to her mother, prompting an immediate police complaint. The prosecution's case was strengthened by the child's testimony, medical evidence, and witness accounts. The trial featured testimony from ten prosecution witnesses, including the young survivor. A crucial witness, a neighbour, confirmed seeing the child enter and exit the accused's home, supporting the survivor's account. Constable Sushant Shelar provided consistent support to the prosecution throughout the legal proceedings. In delivering the verdict, Judge Deshmukh noted that the prosecution established guilt beyond reasonable doubt, justifying the conviction and substantial punishment under POCSO provisions. The judge pointed to the importance of the survivor's courageous testimony and the corroborating medical reports in securing this conviction. Judge Deshmukh referred the case to the District Legal Services Authority for additional compensation consideration.

Man let off in 2022 rape case as ‘guilt not established'

Thane: A 49-year-old man accused of raping a widow over eight years under the pretext of marriage and cheating her of Rs 5 lakh was acquitted by additional sessions judge D S Deshmukh as the prosecution failed to establish guilt beyond reasonable doubt. In 2022, Kapurbawadi police booked the man for allegedly raping, cheating and threatening the woman between July 2012 and March 2020. The woman alleged he exploited her sexually while extracting money, including Rs 60,000 for his wife's sarpanch poll campaign. When he began avoiding her in 2022, she filed a complaint. The judge noted that the woman's testimony suggested they were in a consensual live-in relationship and asked why she waited for 10 years to report the alleged crimes if they were indeed against her will. tnn

Man accused of raping 17-yr-old girl acquitted as she admits to consensual relation

Thane, A Thane court has acquitted a 25-year-old man accused of raping a minor girl in 2019 under the pretext of marriage, after she admitted that their relationship was consensual. The victim, who was 17 years old at the time of the incident, was mature enough to understand the nature and consequences of the act she indulged in, special judge D S Deshmukh said in the order on June 2, a copy of which was made available on Thursday. The case was registered against Aakash Sachin Sathe in 2019 under sections 376 , 376 , 323 and 504 of the Indian Penal Code as well as provisions of the Protection of Children from Sexual Offences Act. The prosecution alleged the man engaged in sexual acts with the victim, both residents of Thane in Maharashtra, between March and June 2019 under the pretext of marriage and later refused to marry her. After hearing the case, judge Deshmukh observed that the "admissions given by the victim in cross-examination clearly show that she and the accused had consensual sex and now she has no grievance against him. Such admissions given by her are fatal to the case of the prosecution." The court also considered the victim's statement under section 164 of the CrPC wherein she said she lodged the complaint on the say of the accused's aunt because she wanted to marry the man, but no longer wished to proceed with the case. "Therefore, considering her age at the time of incident and considering the admissions given by her, there appears a love affair between both of them and at that time, the victim was almost 17 years old and was mature enough to understand what is right and wrong," the court said. "In such circumstances, there is no reason to hold the accused guilty of the commission of offence," it added.
