2022 arrest of Valpoi bizman with PFI ‘link' unlawful: HC

The HC of Bombay at Goa has declared the arrest of businessman Sarfaraz Sayad in 2022 as 'unlawful'.
The Valpoi Municipal Council member was arrested on the premise that he was a member of the
Popular Front of India
, which was declared an unlawful association under the UAPA Act.
Three other persons were also arrested along with him.
The division bench of Justices Bharati Dangre and Nivedita Mehta said that mere apprehension that a person may indulge in illegal activities in the future and the possibility of a breach of peace in the locality or commission of any cognisable offence is not sufficient ground to justify his arrest.
It said that there is also no concrete material establishing a link between him and the PFI or that he indulged in activities of the unlawful association in the past, giving rise to an apprehension that he may indulge in the activities in the future.
'The power conferred on the police officer necessarily must be discharged with accountability and responsibility,' the court said.
'…when we test the arrest in the backdrop of Article 21, i.e. 'right to life and liberty', which has considered a right to reputation as a cherished right and an important facet of Article 21 of the Constitution of India, as the term 'life' is of wider amplitude and necessarily conveys life with dignity and involves the reputation of a person, with the petitioner (Sayad) enjoying a position in society, he definitely has a right to contend that his image in society has been tarnished on account of the action of his wrongful arrest without sufficiency of the material justifying such an arrest under Section 151 of the CrPC,' the court said.
The court observed that Sayad was immediately released after being produced before the magistrate and that he can approach an appropriate forum to seek compensation if he desires.

Berhampur: The special Pocso court in Phulbani, Kandhamal district, on Thursday sentenced a 26-year-old man to 20 years of rigorous imprisonment for the kidnap and rape of a 15-year-old girl last year. Manoranjan Das, additional district judge-cum-special judge of the Pocso court, also imposed a fine of Rs 55,000 on the convict. He would undergo an additional nine months in jail if he fails to pay the fine, the court ordered, special prosecutor Asim Praharaj said. On Feb 7, 2024, the girl was found missing from home. Family members later learned she had been kidnapped by a person near the village. Her mother lodged a case at the local police station on Feb 10. Berhampur. Tumudibandh police in Kandhamal district on Sunday arrested three persons, two of them from Ganjam district, and seized huge quantities of explosive materials. The accused were identified as Albut Kumar Patra (18) of Asurabandh and Hemant Sethi (31) of Ambapua, Berhampur and Shakti Ranjan Dash (50) of Bhawanipatna in Kalahandi district. Around 6.9 tones of gelatin sticks, 2.5 tones of apex booster, 4,000 pieces of detonators, 43 electric wires, 38 cordex, two batteries, two vehicles, one of them a pick-up van, six mobile phones and Rs 2.80 lakh cash were seized from the accused. Ramendra Prasad, sub-divisional police officer, Baliguda, said police found a pick-up van loaded with apex booster at Rampur Chowk under Tumudibandh police station limits during routine checking. NCBC to hold OBC inclusion hearing in capital city

Bhubaneswar: National Commission for Backward Classes (NCBC) will conduct a public hearing on Aug 20 regarding the inclusion of castes in the Centre's OBC list. The hearing will be held in Bhubaneswar under the chairmanship of NCBC chairman Hansraj Gangaram Ahir. Representatives of the castes and communities proposed for inclusion will be invited to attend. The status of the disposal of grievances forwarded by the commission will also be reviewed separately. Chief secretary Manoj Ahuja has been asked to bring complete information along with full facts and all relevant original records and documents pertaining to the matter.
