SC to examine plea asking if convicted politician can head political party

New Delhi, Aug 12 (PTI) The Supreme Court on Tuesday said it would examine the question whether a politician can be denied the constitutional right to head a political party or association on the basis of conviction and being disqualified to vote.
A bench of Justices Surya Kant and Joymalya Bagchi termed the issue raised in 2017 PIL as an 'interesting question".
According to the top court, the question — should a constitutional court direct that irrespective of your right under Article 19, you will not be entitled to form an association of political ideology only because you are not entitled to cast vote — was to be considered.
The bench posted the PIL filed by Ashwini Kumar Upadhyay raising the issue for November 19.
'Merely because a person has been disqualified for a statutory right, you can't ipso facto deprive him of his constitutional right," Justice Kant said.
Upadhyay, appearing in person, said a person disqualified from casting vote cannot distribute party tickets to the candidates.
'This issue needs to be examined as it is a grey area. Several commissions including the law commission has emphasised on the need for not allowing the convicted to head a political party," he said.
The bench called the issue 'worth consideration" and noted it had 'something in mind" but required a detailed hearing.
'Suppose tomorrow Parliament enacts a law that no person will hold public office beyond the age of 80 years, can you also deprive him from leading a political party?" Justice Kant asked.
Upadhyay has sought banning convicted persons from forming political parties and becoming their office bearers for the period they are disqualified. PTI MNL MNL AMK AMK

SC tells EC to publish Bihar's deleted voters list with reasons by Aug 19
The Supreme Court on Thursday directed the Election Commission of India (ECI) to publish, before 19 August, the names of voters excluded from the draft electoral roll after the special intensive revision (SIR) exercise in Bihar. The Court said the reasons for the omission of about 65 lakh voters must be provided, and the names should be searchable online using Electors Photo Identity Card (EPIC) numbers. It directed that a soft copy of the deleted voters list be available on district electoral officers' websites. 'The list of 65 lakh voters, whose names appeared in the 2025 list but are not included in the draft list, shall be displayed on the websites of district electoral officers. The information would be booth-wise but can be accessed by referring to EPIC numbers. The lists shall also be published on the website of the Chief Electoral Officer, Bihar,' the Court said. The apex court also told the ECI to accept Aadhaar cards as an acceptable document for establishing identity. 'Your list of 11 documents seems citizen-friendly, but Aadhaar and EPIC are readily available… Your notice can say that those who have not submitted so far can submit their Aadhaar and EPIC also,' Justice Bagchi said. A Bench of Justice Surya Kant and Justice Joymalya Bagchi is hearing petitions challenging the EC's 24 June directive ordering an SIR of Bihar's electoral roll. The directive requires voters not listed in the 2003 electoral roll to submit documents proving their citizenship. Those born after December 2004 must also furnish the citizenship documents of both parents, with additional requirements if a parent is a foreign national. Apart from the above directions, the Bench on Thursday also ordered the ECI to publicise the deleted voters list via newspapers, electronic media, and social media. A printed booth-wise list of deleted voters, with reasons for deletion, must also be displayed at panchayat and block development offices, the Court said. All these directions must be complied with before Tuesday. 'For a migrant worker who has been deleted as dead, even if he is illiterate, his neighbours or friends would alert him… It is only fair to have a procedure that does not block a person from exercising his right to adult franchise. There are civil consequences involved here,' Justice Kant told Senior Advocate Rakesh Dwivedi, appearing for the ECI. The Court said voters have a right to know, and a high degree of transparency is required to inspire confidence. 'People have a right to know. On Wednesday, the top court had observed that while the exclusionary argument against Aadhaar is understood, the option of 11 documents in Bihar's SIR to prove citizenship is 'voter-friendly rather than restrictive'. It had earlier said that if there was 'mass exclusion' of voters in the SIR exercise in Bihar, it would 'step in'. The petitioners include the Association for Democratic Reforms (ADR), People's Union for Civil Liberties (PUCL), Yogendra Yadav, Trinamool Congress MP Mahua Moitra, Rashtriya Janata Dal MP Manoj Jha, Congress leader K C Venugopal, and Mujahid Alam.

List of deceased voters, those with multiple cards shared with parties: EC
New Delhi, Aug 14 (PTI) On a day the Supreme Court directed the Election Commission to publish details of 65 lakh deleted names from the voters list of Bihar, the poll authority on Thursday said it has been sharing the list of deceased electors and those with multiple voter cards with political parties. It also said that the enumeration form of special intensive revision already asks for the Aadhaar number as a proof of identity. The EC said list of deceased voters at two places and permanently shifted is being shared with political parties since July 20. Unity key to making India worlds greatest nation: Ladakh MP
Agency: New Delhi, Aug 14 (PTI) Ladakh MP Mohmad Haneefa on Thursday said all communities and religious groups contributed to India's freedom struggle, and unity is key to making India the world's strongest nation. In a message a day ahead of the 79th Independence Day, the Ladakh MP paid tributes to the brave soldiers who laid down their lives for the nation. 'I congratulate everyone on the 79th Independence Day. This freedom was not easy to get, many sacrifices were made by people," Haneefa told PTI. 'Every time there has been a war, our brave soldiers sacrificed their lives on the borders. I salute all the soldiers who have laid down their lives for the country," he said. Haneefa, who is from the Kargil region of Ladakh, said he has spent his childhood around soldiers of the Indian Army. 'I know in what situation our Army guards our borders. I come from a border area, Kargil in Ladakh, where we have spent our childhood amid soldiers — whether snow, heat or rain, they stay there guarding the border," he said. 'I appeal to the people, there are many sacrifices behind this freedom," he said. The Ladakh MP said people of all communities and religions have sacrificed for the nation. 'We should contribute towards protecting the unity in the country. To make it the world's strongest nation, we should rise above narrow differences," he said.
