Plans to upgrade A5 road rejected as they do not comply with Northern Ireland climate targets

A judge has ruled that the £1.2bn first phase of the A5 project cannot go ahead in its current form because the plans do not comply with climate change targets in Northern Ireland.
A summary of the 100 page document was presented by Judge McAlinden to a packed courtroom that included the Minister for Infrastructure, campaigners, those against the proposed scheme, and the press.
Last year the Department for Infrastructure (DFI) announced it was going to build the controversial dual carriageway that would link Derry with Tyrone.
Preparatory work had already started on the new route near Ballygawley, including the clearing of land.
However, a group known as the A5 Alternative Alliance brought a legal challenge against the decision claiming the plan breaches climate change legislation set out in the Climate Change (Northern Ireland) Act 2022 to achieve net-zero greenhouse gas emissions by 2050.
The judge ruled there was an "inadequacy of information for the purpose of lawful decision making" when it comes to the methodology of estimating greenhouse gas emissions.
"It would appear that overall, Northern Ireland may have difficulty staying within the first carbon budget that has now been set".
The judge also made reference to concerns over human rights saying that the DFI "patently failed to address the human rights concerns" of some of those affected who live along the route of the new proposed road.
It is estimated the project will temporarily affect direct access to more than 130 residential properties and will necessitate the demolition of three resident dwellings.
Since 2006, more than 50 people have been killed on the road and campaigners claim the upgrade would save lives.
Justice McAlinden said he was aware the decision will bring "fresh anguish to the doors of those who have been injured and maimed and those who have lost loved ones".
"However the decision to proceed with the scheme must be in accordance with the law and and the principle of the rule of law cannot be subverted even if the motivation for doing so is to achieve what is deemed to constitute a clear societal benefit."
The judge added that the "shortcomings" and "short cuts" highlighted in this decision are capable of being remedied and should be done sooner rather than later so a new and safer A5 dual carriageway could be built.

Most global governments have failed to act on the 2023 UN pledge to triple the world's renewable energy capacity by the end of the decade, according to climate analysts. The failure to act means that on current forecasts the world will fall far short of its clean energy goals, leading to a continued reliance on fossil fuels that is incompatible with the target of limiting global heating to below 1.5C. A report by the climate thinktank Ember found that only 22 countries, most within the EU, have increased their renewable energy ambitions since more than 130 signed up to the renewables pact at the UN's Cop28 climate talks in Dubai almost two years ago. This means that the global sum of national renewables targets is now just 2% higher than at Cop28. While this could be enough to double the world's renewable energy capacity from 2022, to reach 7.4 terawatts (TW) by 2030, governments would fall well below the 11TW needed to meet the UN goal of tripling renewables, according to the analysts. 'Tripling global renewables capacity by 2030 is the single biggest action this decade to stay on track for the 1.5C climate pathway,' the report said. 'Yet, despite the landmark Cop28 agreement to reach 11,000GW of renewables by 2030, national targets remain largely unchanged and fall short of what is needed.' The report found that beyond the EU only seven countries have updated their renewable energy goals since the pact was signed, including Mexico and Indonesia, which have watered down their targets. Countries that have failed to act include the US, China and Russia, which are some of the world's largest energy users and together are responsible for almost half of the world's annual carbon emissions. The fate of the world's renewable energy deal may depend on the actions of Beijing, which is expected to finalise its 15th five-year plan for energy later this year, covering the period 2026-30. Washington and Moscow do not have renewable energy targets for 2030, and according to Ember their political leaders are not expected to set any. In India, clean energy targets have also remained unchanged, but the country's ambition to build 500GW of renewables by 2030 is already aligned with the global goal to triple renewable energy capacity, the thinktank added. Australia and Brazil have promised to increase their homegrown renewables by 18GW and 15GW. The UK upgraded its renewable energy plans last year with a pledge to build an extra 7GW of renewable energy by 2030 to reach the Labour government's target to create a virtually carbon-free electricity system. In Korea, renewables are expected to grow by 9GW by 2030.

Companies may face tougher regulations in the wake of the UN court's landmark climate change ruling, but polluted states are likely to face an uphill battle for compensation. Environmental groups, small island nations and other climate change campaigners welcomed last week's 'advisory opinion' from the International Court of Justice (ICJ) in the Netherlands, which said that countries were obliged under the climate change treaty regime and customary international law to protect the environment from greenhouse gas (GHG) emissions and limit global warming. States that breach these obligations may be required to cease their wrongful conduct, offer guarantees of non-repetition and pay compensation to those affected. The court affirmed that climate change is an urgent and existential threat that is 'unequivocally caused by human activities'. Giving the ruling, the court's president, Iwasawa Yuji, a judge from Japan, said that a 'failure of a state to take appropriate action to protect the climate system from GHG emissions — including through fossil fuel production, fossil fuel consumption, the granting of fossil fuel exploration licences or the provision of fossil fuel subsidies — may constitute an internationally wrongful act which is attributable to that state'.
