Govt inspecting books of Colliers Int'l (India) Property Services: Minister

New Delhi, Aug 4 (PTI) The Ministry of Corporate Affairs (MCA) on Monday said inspection is underway of the books of Colliers International (India) Property Services Ltd.
Minister of State for Corporate Affairs Harsh Malhotra told the Lok Sabha that the services of Colliers International (India) Property Services as a valuer of structures related to the Farakka-Raiganj section of NH-12 were terminated due to deficiency in services by the NHAI on April 10, 2015.
'The said firm was also debarred for any on-going / future projects of NHAI in the State of West Bengal in January, 2018. Further, on examination of three years Directors' Report for the FY 2017-2018 to 2019-2020 no such instance has been disclosed / reported in the Board's Report to the members of the company," he said in a written reply.
Under the jurisdiction of NHAI, the minister said that no work was allotted to the company from 2014 to March 2025.
'Further, the Ministry of Corporate Affairs has ordered an Inspection under section 206(5) of the Companies Act, 2013 on 30.03.2024 which is underway," he added.

Under Section 206, the ministry has the power to inspect the books of a company and conduct inquiries.
The minister was responding to queries, including whether the government has initiated any review of monitoring, observation or compliance of the working of the company in view of the complaints received/lodged. New Delhi: Adani Ports and Special Economic Zone Ltd (APSEZ) -- part of the Adani Group -- on Tuesday said billionaire Gautam Adani has been redesignated from executive chairman to non-executive chairman with immediate effect. APSEZ in an regulatory filing said, based on the recommendation of nomination and remuneration committee, the board has approved redesignation of Gautam Adani from executive chairman to non-executive chairman with effect from August 5, and consequently he would cease to be a key managerial personnel of the company. The company appointed Manish Kejriwal as additional director (non-executive, independent) of the company for an initial term of three years from August 5, subject to the approval of shareholders within three months. In a statement, APSEZ said this change ensures compliance with the applicable provisions of the Companies Act, which restrict key managerial personnel from holding executive positions in more than one company simultaneously. "Given that APSEZ already has two executive directors - a Managing Director and a Whole-Time Director & CEO - this re-designation will also enable Mr Adani to devote greater attention to the strategic direction and growth of other entities within the Adani Group. Mr Adani continues to serve as the Chairman of APSEZ," the company said. APSEZ is part of the globally diversified Adani Group, with a national footprint of 15 ports and a presence in four ports outside India.

New Delhi, Aug 5 (PTI) The Supreme Court on Tuesday upheld the January 29 notification of the Ministry of Environment, Forests and Climate Change, but struck down the contentious clause exempting certain large building and construction projects from prior environmental clearance. The Supreme Court order said it would not be possible for the union ministry to consider projects across the country and therefore the issue could be considered on a state-to-state basis(Vipin Kumar/Hindustan Times) A bench comprising Chief Justice B R Gavai and Justice K Vinod Chandran held projects with a built-up area above 20,000 square meter, whether industrial, educational, or otherwise, cannot be exempted from the environment impact assessment (EIA) 2006 regime. The court clarified that the notification would also apply to Kerala. Dictating the order, the CJI said, 'It has been consistently held that natural resources are to be held in trust for the next generation. At the same time, courts have always taken note of development activities and the country cannot progress without it.' Observing the apex court had always focused on sustainable development, the CJI said, 'The court while ensuring that development is permitted has also required precaution to be taken so that least damage is caused to the environment and has even ordered costs to be paid for such development activities.' 'If any construction activity in any area more than 20,000 sq km is carried out it will have environmental impact even if it's for industrial or educational purposes and discrimination cannot be made with similar such institutes,' it said. It also said that no exemption can be granted to the education sector in this regard. The bench upheld the notification except clause 8 of the January 29 notification which grants exemptions to industrial sheds, schools, colleges, and hostels with built-up areas up to 150,000 square meter. The bench said it was impractical for the MoEFCC to appraise every project nationwide, noting the Central Expert Appraisal Committee (CEA) could handle state-wise evaluations. On February 25, the top court stayed the notification on a PIL filed by Mumbai-based NGO Vanashakti, which argued that the exemption diluted the EIA's safeguards and threatened eco-sensitive zones. Senior advocate Gopal Sankaranarayanan, appearing for the NGO, said similar attempts in 2014, 2016, and 2018 had been struck down or stayed by courts, including the Kerala High Court, the National Green Tribunal, and the Delhi High Court. The petition claimed that bypassing EC for projects of such magnitude, exceeding 1.6 million square feet, would cause irreversible damage to land, water, and air quality, violating the precautionary principle entrenched in Indian environmental law. A follow-up office memorandum on January 30 expanded the scope of exemptions to include private universities, warehouses, and industrial sheds housing machinery or raw material.
