Landlords threaten legal action as NSFAS fails to pay R62m in student accommodation fees

The National Student Financial Aid Scheme (NSFAS) has left private accommodation providers in crisis after not paying R62-million in rent, which in some cases dates back to January 2024, causing landlords to default on municipal bills and delay staff salaries, increasing the risk of student evictions.
The NSFAS has once again found itself in financial trouble with private accommodation providers after landlords claimed they are owed R62-million in unpaid accommodation fees dating back from January 2024. According to the landlords, this affects 2,797 beds across a wide range of universities and Technical and Vocational Education and Training colleges.
Earlier this year, Daily Maverick reported that the Private Student Housing Association (PSHA), which represents developers, institutional owners, and operators managing more than 80,000 student beds nationwide, said members were owed R44-million in overdue rental fees; this has now increased to R62-million.
PSHA CEO Kagisho Mamabolo told Daily Maverick that the delays in NSFAS accommodation payments stemmed from a combination of systemic inefficiencies, including unresolved validations, data mismatches and institutional delays in uploading accommodation confirmations.
'The impact has been financially devastating for many providers, particularly small and black-owned operators who lack access to working capital. Delayed payments have hindered maintenance, security, and student support services. Landlords are defaulting on municipal bills, mortgages or staff salaries. Several members have signalled possible closure, and new developments in the sector have been stalled or cancelled,' said Mamabolo.
He added that on 28 July 2025, PSHA held a formal consultation and reconciliation meeting with a NSFAS team, led by the acting senior manager for student accommodation, Sivuyile Tshiwula. Mamabolo said NSFAS would begin a validation process of the arrears, and that they would give NSFAS until the end of the month to process the outstanding arrears.
'Should NSFAS fail to meet its obligation to validate and settle verified arrears within 30 calendar days, as committed in the 28 July 2025 consultation, PSHA will instruct legal counsel to initiate litigation proceedings and apply to attach NSFAS assets and bank accounts to recover the debts owed to our members. This action will be taken to protect the financial sustainability of housing providers and the continued accommodation of thousands of NSFAS-funded students across the country,' said Mamabolo.
Lack of communication
Daily Maverick spoke to the landlords who own Urban Circle, a private accommodation that houses students from the University of Johannesburg and the University of the Witwatersrand. Saul Mayers and Rowan Lewis said that the arrears owed from 2024 were approximately R14.2-million. One of their buildings, Drivelines, had a monthly rent of R745,000.
'In instances where University of Johannesburg and Wits distribute the money, we get paid. So in the instance where NSFAS has to distribute the money, we're getting no funds. I've got 134 students in a specific building who are University of Johannesburg NSFAS students. And University of Johannesburg cannot allocate the money for them; it has to come directly from NSFAS, and it's just not being paid,' said Lewis.
Mayers added: 'Since there's a new board of directors at NSFAS, they have been sending emails and official communications confirming that 2024 arrears will be paid by a certain date, and now they have stopped sending notices, and we haven't received any of the 2024 arrears.'
Mamabolo told Daily Maverick that no formal student evictions had been reported, but the risk was increasing. Without urgent intervention, student accommodation in some areas may become severely constrained.
NSFAS's 5% commission system
In May 2025, MPs grilled NSFAS over the use of four service providers who were meant to conduct the accreditation of properties whose owners had applied to the scheme's accommodation platform. The service providers received a 5% commission from landlords for every NSFAS transaction. Mamabolo said this reduced the net income received by landlords.
NSFAS mandates property registration (names, locations, images) for student housing. It then accredits and grades properties. Frustration arises from intermediaries charging landlords 5% of NSFAS payments.
'This model has caused delays in payment processing, confusion over disbursement timelines, and reduced financial viability for providers already operating under capped rental limits. The Private Student Housing Association strongly opposes this model and continues to advocate for direct landlord payments, coupled with rigorous compliance monitoring,' said Mamabolo.

(Photo: Lindsey Schutters) Darling Breweries' managing director Tewie Roos still remembers the day the pandemic lockdown's unintended consequences arrived by the truckload. Retailers, barred from selling alcohol under Covid-19 regulations, sent back perfectly good beer, demanding credit. It stacked up on the brewery floor, eating into cash flow. Some of it was days from its best-before date; some had already ticked over. Excise officials, locked down like everyone else, weren't around to supervise destruction. The only legal path to recovery was to spend even more money and turn it into something else. Read more: As tariffs loom, alcohol brands toast a new era 'People thought I was crazy,' Roos says, recalling his plan to distill the beer into whisky. 'Here we were, making a loss, and I wanted to incur more costs. But I saw a long-term opportunity.' Partnering with master distiller George Dalla Cia, Roos shipped 30,000 litres of returned beer to a still in Stellenbosch. The result, five years later, is Reminisce. An unfiltered, naturally coloured, limited-edition whisky, packaged like a storybook (library card and all) and sold in numbered bottles. Feeling the squeeze Roos tells the tale of regulatory reality facing small brewers: 'The challenge that we see in the market is that legislation and excise is currently driven so high that approximately 20% of liquor in any store is illicit liquor, not paying excise.' He gives Daily Maverick a back of the envelope calculation: 'If we take a bottle of brandy… your excise tax component at 42% will be in the region of R92 a bottle. Then you get guys who sell brandy at R90. How do you do that? It's not possible unless you don't pay excise tax.' What this means for you The Department of Trade, Industry and Competition has updated the Liquor Act, with ripple effects likely to hit your wallet and your choice of local brands. For local producers: Stricter licensing requirements and more detailed reporting mean higher admin and legal costs, which small producers can least afford. With excise increases still linked to inflation-plus hikes, small brewers and distillers will continue to fight margins that are already wafer thin. For the shelf price: Compliance costs, higher excise, and potential moves toward minimum unit pricing (already trialled overseas) could nudge retail prices up, especially for entry-level spirits and beer in large formats. If small producers can't absorb costs, some may cut product lines or exit the market entirely, leaving shelves dominated by big, well-financed players. For consumers: Expect more limited-edition, higher-margin products like Reminisce (R3,500 per bottle) aimed at premium buyers, while budget-conscious consumers may see fewer affordable craft options. With Heineken and AB InBev dominating production, their pricing strategies will carry more weight, and less local competition could mean slower innovation. Regulatory tweaks designed to formalise and control the industry could make your weekend drink pricier and less local, unless policymakers heed calls to give smaller producers a break. Roos needs some mathematical grace for his numbers, but the point is that this creates what economists call a policy paradox — high excise rates designed to curb consumption and raise revenue instead incentivise tax avoidance. For craft producers like Darling Brew, a beer excise of R145.07 per litre of absolute alcohol sometimes exceeds production costs. 'Don't charge me as a small [producer] a maximum excise; incentivise me,' Roos argues. 'I employ much more people per litre than a major player. Rather incentivise the small guys because that creates real jobs on the ground.' First, do no harm But the industry's calls for lower excise rates run headlong into a stark public health reality. Dr David Harrison, CEO of the DG Murray Trust, challenges the narrative that regulation punishes the poor. 'The fact is that the legal liquor industry is a major contributor to injury, disease and death in South Africa,' Harrison argues in a statement shared with Daily Maverick. 'Alcohol is a factor in about half of all homicides, traffic accidents and gender-based violence in this country.' Even if the claims about illicit trade are accurate — that illegal products represent a fifth of the market — Harrison points out that 'legally manufactured alcohol contributes up to four-fifths of the total alcohol harm in South Africa'. Read more: SA's resilient wine industry learns to adapt and survive The trust's data reveals a troubling pattern: alcohol-related mortality in poorer communities runs 4.5 times higher than in wealthier areas. 'Many people in poorer communities drink to escape the hardships of daily life,' Harrison notes. 'The alcohol industry capitalises on their misery, flooding their communities with large quantities of liquor at lower prices.' This isn't just about excise rates — it's about design choices that shape consumption patterns. Consider SAB's one-litre Castle Lager bottles, which Harrison notes contain 'enough pure alcohol to push a drinker's blood alcohol content well above the legal driving limit'. These large containers sell for 2.5 times less per litre than equivalent amounts in smaller bottles — a pricing strategy that Harrison argues 'suggests a deliberate design to promote excessive consumption'. Legacy by design Research supports this concern. South African studies show that larger containers encourage people to drink more, making them a prime target for minimum unit pricing policies that have shown success in Scotland and Wales. South Africa's liquor landscape has always been shaped by law, rarely in ways that favoured small producers or public health. The dop system kept farm workers dependent on alcohol until 2003. The 1928 Liquor Act formalised racial prohibition, pushing black South Africans into illicit shebeens. The 1924 KWV Act gave white wine farmers monopolistic powers to fix prices, regulate surpluses and monopolise exports for 70 years. Today's market concentration — dominated by AB InBev and Heineken — represents the latest chapter in this story of regulatory capture and economic control. How Reminisce was made Master distiller George Dalla Cia used a discontinuous salamander still to transform beer into whisky. (A 'salamander still' is named after the amphibian due to the visual similarity of the radiant heat source to a salamander's back.) The returned beer, averaging 5% alcohol, went through bain marie distillation, a gentle process that never exceeds 100°C. The vapour passes over marble chips to neutralise preservatives, then through fractional distillation to concentrate flavour. From 800 litres of beer, about 60 litres of whisky at 70-75% alcohol emerge, later diluted to 46% for bottling. Aged five years in re-charred bourbon casks, Reminisce carries a distinct honey aroma with a clean finish, almost IPA-esque (India Pale Ale) and oddly fruity. A spirit born of crisis, patience and a bit of lockdown alchemy. Dalla Cia, who helped transform the returned beer into whisky, sees echoes of his family's Italian experience. His father left Italy in the 1970s amid Mafia influence, corruption and bureaucratic sabotage. A shipment of grape skins for grappa (the family's legacy spirit) was deliberately blocked until it rotted, thanks to competitors bribing port officials. 'I'm done. I'm out of here. I don't want to raise my children in this kind of environment,' his father declared before moving to South Africa. The same forces of entrenched monopolies, skewed regulation and the vulnerability of small producers are still here, just in different guises. For Dalla Cia, that means innovating and lobbying for a system that doesn't punish the smallest players. 'It's about teaching people how to fish,' Dalla Cia says. 'Not just collecting the fish.' DM

IDT CEO Tebogo Malaka's mansion and the unpaid EPWP workers: key takeaways

A months-long Daily Maverick investigation exposes financial ties between suspended Independent Development Trust CEO Tebogo Malaka and an IDT contractor. We also shed light on a simmering scandal involving unpaid Expanded Public Works Programme workers. This, by all indications, is the story that Malaka so desperately hoped to quash. A contractor to the Independent Development Trust (IDT) paid at least R200,000 towards a new house in an upmarket residential estate currently being built for suspended IDT CEO Tebogo Malaka. Daily Maverick's months-long investigation identified two transfers from businessman Collen Mashawana towards the construction of Malaka's new house inside Gauteng's Waterfall Country Estate. At the time of the first transfer, Malaka was still firmly in her job as CEO, and the IDT was on the verge of appointing Mashawana's charitable foundation for an employment scheme funded by the government's Expanded Public Works Programme (EPWP). Read the full investigation The Collen Mashawana Foundation (CMF) ended up getting by far the largest portion of the IDT's EPWP spend for the previous and current financial years, trumping more than 400 other nonprofits. The foundation was appointed to employ and manage nearly 1,800 EPWP workers across five provinces. The allocations shocked stakeholders familiar with the IDT's EPWP initiatives, seeing as the CMF has no track record in managing an employment scheme of this magnitude. Our investigation unearthed two alarming sets of developments that unfolded in the same timeframe. First, the CMF short-changed or failed to pay hundreds of its EPWP workers. Second, Collen Mashawana himself became directly involved in a R16-million project to build the IDT CEO's new house in the Waterfall Country Estate, acting as something of a project manager. Mashawana also made at least two payments towards Malaka's property. The EPWP workers' outstanding salaries, and Mashawana's simultaneous involvement in the Waterfall development, raises serious questions. Were the workers' hard-earned wages perhaps diverted to the IDT CEO's new mansion? The foundation has come out to strongly deny any impropriety. 'The Collen Mashawana Foundation (CMF) strongly refutes the misleading implications published in a recent article by the Daily Maverick, which seeks to connect the Foundation's implementation of the Expanded Public Works Program (EPWP) to alleged irregularities involving the suspended IDT CEO, Ms. Tebogo Malaka,' it said in a statement released on Monday, 11 August 2025. However, our investigation identified several transactions and related factors that raise alarm bells. Satellite images of Malaka's stand, coupled with WhatsApp correspondence and other records, helped us to craft a reliable timeline of progress at the building project. Thanks to our bundle of evidence, we know that all major works for the new house only kicked off after the IDT had transferred millions of rands to the CMF. The CMF, meanwhile, was not using these funds for its intended purpose, namely paying the EPWP workers their rightful salaries; Collen Mashawana made at least two payments towards Malaka's property, totalling R200,000. The payments were made through two different companies controlled by the businessman. Mashawana made the first payment in July 2024, while the IDT was still considering his foundation's EPWP bid. The businessman made the second known payment in April this year, shortly after the CMF had banked substantial payments from the IDT; and Mashawana appointed a company called Two Putswa Maeba Construction and Projects as the main contractor for Malaka's new house. Two Putswa had to pay for all manner of materials and services related to the project. The contractor on several occasions settled invoices shortly after the IDT transferred funds to Mashawana's foundation. In one instance, Two Putswa fell behind on its payments for leasing a construction container. It later settled the bill, the very next day after the CMF received R1.1-million from the IDT. As progress continued at Malaka's Waterfall property, the CMF's EPWP workers started taking the nonprofit and the IDT to task over the problems with their wages. To date, the IDT has transferred at least R23-million to the foundation, but much of this money was not used for its intended purpose. The alleged misappropriation of these funds is seemingly affirmed by a Commission for Conciliation, Mediation and Arbitration (CCMA) probe. A group of more than 200 EPWP workers from Kgotsong in the Free State took the Collen Mashawana Foundation to the CCMA. The CCMA considered the group's evidence and in April this year ruled that the foundation had failed to pay them for five months. The CMF collectively owes this group nearly R1.7-million in outstanding salaries. To date, however, the foundation has failed to comply with the CCMA's decision, further fuelling the group's resentment and frustration. In all, the CMF had nearly 1,800 workers on its payroll for the IDT initiative. They were from Gauteng, Limpopo, North West, the Free State and KwaZulu-Natal. The group worked at rubbish dumps, cleaned streets, parks and other public spaces, among other tasks assigned to them. On average, the workers were supposed to earn about R1,700 per month. Daily Maverick also identified scores of workers from Limpopo and elsewhere in the Free State who received only small portions of their rightful salaries. In some instances, the CMF failed to pay the workers anything at all. Malaka chose not to respond to any of the queries we put to her. Collen Mashawana received a set of nearly twenty detailed queries but provided only a broad denial of any impropriety. 'It will not be appropriate for me to defend myself in the media on unsubstantiated and untested allegations,' said the businessman.
