SINGAPORE – Two employees of an eldercare services provider were helping clients board its van when one of the senior citizens fell off the vehicle's wheelchair lift platform and his head struck the ground.
Mr Hassan Mohamed Karchi Arsan Osman, 76, was unconscious when he was taken to the National University Hospital, and he died of a head injury at 9.35pm on Feb 3, 2021.
On June 3, Active Global Respite Care was fined $7,000 after it was convicted of an offence under the Workplace Safety and Health (Risk Management) Regulations.
Court documents stated that the company had failed to implement safety control measures and safe work procedures governing the use of the wheelchair lift at the rear of the van.
Two people, who were working for Active Global Respite Care when the incident took place, were each fined $10,000 in December 2023.
Myanmar national Moe Thadar, then 49, was a health care assistant at the time while Singaporean Kwa Kim Seng, then 67, was employed as a van driver.
They had failed to ensure that the brakes of Mr Hassan's wheelchair were engaged, causing his death.
For the current case, Ministry of Manpower prosecutor Kimberly Boo told the court that Active Global Respite Care owned two vans used for transporting elderly clients between their homes and a senior care centre located at Block 31A, Ghim Moh Link.
A health care assistant would be present in each van to assist with the transportation of such elderly clients.
Each van was installed with a wheelchair lift at its rear. This lift allowed wheelchair users to be loaded onto the vehicle through a platform that could be raised.
At around 4.40pm on Feb 3, 2021, Moe Thadar and Kwa were at work, helping the company's elderly clients board one of the vans at the senior care centre's pickup point.
Ms Boo said: 'When Moe wheeled ( Mr Hassan) from the pickup point onto the wheelchair lift platform, she failed to engage the brakes of (his) wheelchair.
'As Moe was walking away, she told Kwa 'uncle, hold', in order to inform him that (Mr Hassan) was ready to be lifted. Kwa proceeded to raise the wheelchair lift platform while chatting with a colleague.'
As the platform was reaching the top of the lift, in line with the van, Kwa did not wait for a health care assistant inside the van to grab hold of the wheelchair.
Kwa released his grip off Mr Hassan's wheelchair, which then rolled backwards and off the platform. Mr Hassan's head struck the ground when he fell. He was pronounced dead later that day .
Ms Boo told the court that prior to the incident, Active Global Respite Care had no documented risk assessment on the transportation of their clients using a van with a wheelchair lift.
She added that on the day of the incident, multiple control measures to minimise safety risks to Mr Hassan were also not implemented.
These included ensuring that wheelchair brakes were engaged before activating the wheelchair lift.
Defence lawyers Gloria James-Civetta and Noelle Teoh, who represented Active Global Respite Care, on June 3 pleaded for their client to be given a fine of not more than $5,000.
The pair from Gloria James-Civetta & Co added: 'The incident was an isolated and unprecedented occurrence that tragically resulted in the passing of the late Mr Hassan.
'Prior to the incident on Feb 3, 2021, Active Global had operated in Singapore for several years without any record of similar serious incidents or accidents. It is also noted that the late Mr Hassan had successfully completed nearly 500 rides with Active Global over the course of his engagement, without issue.'
The lawyers stated in court documents that since the incident, their client has taken immediate and proactive measures to address any gaps in its safety protocols.
This includes updating its standard operating procedure in June 2021 to further enhance the clients' safety during transportation.
The company has also deployed additional manpower to act as traffic marshals at the drop-off and pick-up points of its centres, the court heard.

PHOTO: ST FILE SINGAPORE – Investigations are underway into what a support group for migrant workers brands a 'job scam' centred on misuse of work passes. Training Employment Passes give foreign students and intra-corporate trainees the right to work here for three months, but they have allegedly been used to employ foreign workers in lower-skilled roles that are not allowed under the pass. Some of the probes surrounding breaches of the pass requirements have already been completed with more to come, noted the Ministry of Manpower (MOM) on June 6. It did not disclose how many reports it had received. The pass allows foreign students or trainees from a company's overseas office or subsidiary to undergo practical training for professional, managerial, executive or specialist jobs here for up to three months. Trainees must earn a minimum fixed salary of $3,000 a month. The work attachment f or student applicants must be tied to their studies. T hey must either be studying in an 'acceptable institution' or earning at least $3,000 a month. The investigation comes after 13 TEP holders sought help in recent months from advocacy group Transient Workers Count Too (TWC2). They were hired by employers to take up various roles with a lower skill level than the pass appears to allow. Five of the 13 were put to work in a food and beverage establishment, five in a warehouse, two in cleaning companies while one ended up in a 'tour coach agency',TWC2 said on its website last month. The 13 people had turned to TWC2 over a period of about five months starting in December 2024. 'We have never before seen so many workers on this kind of work pass in such a short time,' TWC2 said. The group added that nearly all the 13 complained about salary irregularities, including being paid below the $3,000 stated minimum, though at least one found long working hours to be the biggest problem. 'However, when we found out more about the circumstances which led to their working in Singapore, we could see the contours of a rapidly widening job scam,' TWC2 noted. The workers had been designated as 'management executives' despite performing menial tasks such as washing dishes, it added. They were often not sent to the MOM to have their TEP issued until nearly 30 days after arrival, effectively meaning they worked an additional fourth month without a pass being issued. TWC2 executive director Ethan Guo told The Straits Times that a common feature was that most of the workers were coming to work for the first time in Singapore and had arrived relatively recently. 'This showed that these were young, impressionable and vulnerable foreigners with little or no knowledge of employment laws in Singapore,' Mr Guo noted. He added that the group could not confirm if there has been a sudden uptick in the number of TEP holders reporting salary irregularities. 'What has happened of late was a concerted effort by TWC2 to educate migrant workers on the correct payment of their salaries, and this could have resulted in more workers with such problems coming forward to seek help from us,' he said. They may have been many more victims in the past who did not realise they have been scammed, or did not have an avenue for assistance. Mr Guo said TWC2's concern lies with workers who have been misled into jobs they paid huge sums to agents for and then put into 'legal jeopardy once they agree'. He noted that the attempts to dodge the TEP requirements may have arisen as a work-around for industries 'desperate for cheap foreign labour'. 'A more holistic response would be a review of work permit quotas for these industry sectors like logistics, cleaning and food and beverage.' However, Mr Guo added that TWC2 is not advocating a massive liberalisation in foreign workforce policy, as making cheap labour too easily available could blunt the incentive for employers to pursue automation and productivity improvements. The MOM also said it performs additional checks and audits on selected TEP applications, such as requesting proof of training programmes and foreign offices or subsidiaries. It noted that it will take action against errant employers, including suspending their work pass privileges, imposing financial penalties or even prosecution. SINGAPORE: At least S$379,000 has been lost to scammers impersonating officers from the Ministry of Manpower (MOM) since May, the police reported on 3 June. The losses are linked to at least six cases. The scam typically begins when victims receive unsolicited calls from individuals pretending to be MOM officers. The scammers inform the victims that they employ workers involved in criminal activities or immigration-related issues, such as money laundering, overstaying in the country, or having an expired work permit or visa. When victims deny any knowledge of employing such workers, the call is transferred to another person claiming to be an officer from a different agency, such as the police or the Immigration and Checkpoints Authority (ICA). This second scammer then accuses the victims of being involved in criminal activities. Victims are coerced into making bank transfers or handing over cash for 'investigation' and 'safekeeping.' In some instances, they are told to declare their financial assets, report to the scammers daily, and avoid speaking to anyone about the ongoing situation. The scam is typically discovered when victims are unable to contact the scammers or verify their situation with the police through official channels. In some cases, scammers have told victims that they could use the Singapore Government Directory (SGDI) to verify the identity of public officers. However, the police clarified that the SGDI is not a valid tool for verifying officials. They also emphasised that government officials will never ask people to transfer money, disclose banking details, install mobile apps from unofficial stores, or transfer calls to the police. According to the Singapore Police Force's Annual Scams and Cybercrime Brief 2024, there were 1,504 reported cases of government officials impersonation scams in 2024, amounting to at least S$151.3 million in losses. The majority of victims were aged between 50 and 64, comprising 28.6% of the cases. Scammers predominantly used phone and WhatsApp to contact victims. A Singaporean man made a police report after he found a Deliveroo order mistakenly left at his door last month. According to Mothership, the man, identified as Lee, "felt unsafe" handling the unfamiliar package and contacted Deliveroo's customer service, who told him to keep or dispose of the food. A picture of the delivery receipt indicated that the order included tomato soup noodles, vinegar black fungus and chicken wings from noodle chain Tamjai Samgor. While the receipt had the original customer's name, it did not have the intended address for the delivery. He said that when he requested to speak with the customer service manager, the call agent left him on hold for five minutes before hanging up. He then called the police, who helped him dispose of the food, and also lodged a report. When contacted by AsiaOne, the police confirmed that an officer helped Lee dispose off the delivery and added that there was no offence and no investigation regarding this incident. Lee also filed a formal complaint with the Consumers Association of Singapore (Case), who said it only assists with negotiations and mediation regarding contractual disputes and that Lee's case was not under their preview, Mothership reported. When Lee reached out to Deliveroo again, he was told that the order was mistakenly delivered to him due to an operational error and hygiene concerns prevented the food delivery platform from collecting back the order. "I am not seeking compensation — only to raise awareness about how delivery mistakes are pushed onto the public, and how our current system leaves people unprotected," Mothership quoted him as saying. A Deliveroo spokesperson told AsiaOne that the company is aware of the incident and understands the concern raised. "In some instances, customers may request for the food to be left outside their door for convenience or safety, which is why occasional confusion can occur," the spokesperson said. On Reddit, netizens expressed their disbelief and ridiculed Lee's actions. "What is this guy on about? He needs a IMH appointment," one comment said.
