'No misappropriation of Marris funds by Kedah govt'
ALOR STAR: The High Court here was informed that there is no misappropriation of the Malaysian Road Record Information System (Marris) funds by the Kedah government.
Lawyer Yusfarizal Yussof, instead, informed the court today that it was part of the account reconciliation process by Menteri Besar Datuk Seri Muhammad Sanusi Md Nor's administration.
"There is no issue of Marris account management flouting the law, and this was confirmed in the Auditor General's Report between 2021 and 2023.
"Secondly, it is clear that the application submitted by the state government to the Finance Ministry was not meant to use Marris funds for development.
"It is just a reconciliation of funds. However, many people might get confused on this matter."
Yusfarizal later asked Home Minister Datuk Seri Saifuddin Nasution Ismail whether he agreed that Sanusi had never used Marris funds for development projects.
Saifuddin replied that he agreed, but with further comments based on the Auditor General's Reports.
Saifuddin was testifying as a witness in the trial of a defamation suit filed by Sanusi against him.
Sanusi filed the writ of summons and statement of claim through Faizi and Associates at the Alor Star High Court on Aug 3, 2023.
He alleged that Saifuddin, who is also Pakatan Harapan secretary-general, defamed him by claiming he had misused RM1.6 billion in Marris funds and accused him, in his capacity as MBI chairman, of stealing rare earth element minerals in Kampung Chong, Sik.
According to the statement of claim, Saifuddin allegedly made defamatory statements in a speech at the Unity Tour Programme and the launch of the Kedah Unity Machinery in Yan, at 8.30pm on July 15, 2023.
The speech was part of a political campaign by PH and Barisan Nasional in the lead-up to the state elections in August 2023.
Yesterday, Sanusi, who is also Jeneri assemblyman, testified in cour t that the allegations made against him had significantly damaged his reputation and political standing.
Sanusi is represented by lawyers Yusfarizal, Wan Rohimi Wan Daud, Mohd Faizi Che Abu and Nur Iffah Hizwani Omar, while the defence team comprises lawyers Navpreet Singh, William Leong and Sakina Siraj.
Yusfarizal informed the court that the account reconciliation process was done to correct errors made by the previous administration.
"If we study the (Marris) account, it should contain RM1 billion, but the actual amount in the account was less than that.
"This is because the previous administration had used the funds without proper accounting," he said.
Judge Datuk Dr John Lee Kien How @ Mohd Johan Lee has set May 11 as the next hearing date.
Yusfarizal said he believed that Saifuddin had agreed, albeit with comments, that Sanusi had never used the Marris funds for development.
"That is the crux of the issue because the plaintiff, in his political rally, alleged that Sanusi had breached all financial governance by using the funds for development."

In a joint statement today, DAP chairman Gobind Singh Deo and secretary-general Loke Siew Fook also urged Dusuki to review the decision by the Attorney-General's Chambers to classify the investigation into Teoh's 2009 death as requiring no further action, or NFA. Advertisement 'The attorney-general, and no one else, has the discretion to prosecute under the Federal Constitution,' they said. 'He must explain why he is unable to do so in this case, particularly in light of the decisions of the Court of Appeal and civil proceedings in the High Court.' Gobind and Loke said DAP has been consistent in its call for action to be taken against those responsible for Teoh's death. The statement follows a letter dated May 30 from Dusuki to the family's legal representative, Ramkarpal Singh, seeking to explain the AGC's rationale for classifying the case as NFA. Advertisement In the letter, Dusuki said there was 'insufficient evidence' to support a criminal prosecution. Teoh died on July 16, 2009 at the fifth floor of Plaza Masalam in Shah Alam after being questioned for hours by the Selangor Malaysian Anti-Corruption Commission headquarters. Last month, police informed Teoh's family that their latest investigation into the case had been classified by the AGC as NFA. On Nov 21 last year, the High Court directed the police to complete their long-delayed investigation into Teoh's death. At an inquest, the coroner returned an open verdict. However, the Court of Appeal ruled in 2014 that the death was caused by 'one or more persons unknown', including MACC officers. In 2019, police launched an investigation under Section 342 of the Penal Code for wrongful confinement. Before 2018, two special investigation teams had been set up – one in 2011 and the other in 2015 – to look into the incident, but both cases were classified as NFA by the public prosecutor. Gobind and Loke noted that DAP assisted Teoh's family in a civil suit which resulted in the government and the MACC admitting liability for negligence leading to Teoh's death. An award of RM600,000 was made to the family, with costs of RM60,000. They said both the findings of the Court of Appeal and the civil court provided a basis for the police to conduct further investigations into the search for the perpetrators behind Teoh's death. 'While the duty to investigate the case and to identify those responsible in this case is with the police, it is for the attorney-general to decide his next step based on the police's investigations,' they said. Noting that Teoh's family is considering challenging the NFA in court by way of judicial review, Gobind and Loke said they support the action. Sarawak group calls for dedicated ICSS funding, UEC recognition, inclusion in national education

This resolution was adopted by the Sarawak United Association of Private Chinese Secondary School Management Board during its recent annual general meeting (AGM). The association said this grant should be available to all ICSS nationwide to help improve educational facilities, campus buildings and teacher training. 'This support is important to raise education quality and ensure fair distribution of resources among schools,' said the association in a statement today. Another resolution called on the Ministry of Education (MoE) to establish a regular dialogue platform involving the federal government, Sarawak govenrment and the association. This platform, the association explained, would enable ongoing discussions on policies, resources and cooperation, helping to address the needs of ICSS, support effective policy implementation and align ICSS development with national talent goals. Additionally, it urged the MoE to revise its policies to formally recognise ICSS as a vital and legitimate part of the national education system. 'The long-standing contributions of ICSS and their dedication to mother-tongue education should be affirmed, with appropriate policy support and official recognition granted,' it said. The association also called on the federal government to fully recognise Unified Examination Certificate (UEC), especially for admission to public universities, civil service recruitment and professional qualification registration. 'Full recognition of the UEC is important to ensure equal opportunities for all students, promote fairness and inclusion and support the nation's commitment to multiculturalism and diverse education pathways.' In another resolution, the association urged MPs to back efforts in Parliament to officially recognise the UEC through laws and policies, which they believe will help create a fair, inclusive and diverse education system. 'We support working closely with both ruling and opposition parties to explain the education goals of ICSS and the importance of the UEC. This is to gain understanding and support from all sides,' it explained. Furthermore, it urged political leaders, public figures and the media to speak responsibly and refrain from making statements that could inflame racial tensions, in line with safeguarding national unity and social harmony. Towards this end, it called upon the federal government to enforce laws and promote multicultural education to create a fair, inclusive and trusting environment for public discussion. The association also encouraged Putrajaya to take a more open and inclusive approach in recognising the important role of ICSS within the national education system, advocating for reforms that provide proper recognition and support to these schools. It proposed that the federal government adopt the Sarawak government's approach toward ICSS and actively engage in dialogue and cooperation with all political parties. 'Only through collaborative efforts across the political spectrum can key policies such as the recognition of the UEC, be advanced to promote educational equity and support diverse development, truly reflecting the vision of 'One Nation, Unity in Diversity',' it said. According to the association, ICSS is an important part of the country's educational and cultural diversity. It believed that formal recognition and support will help close policy gaps, promote unity, develop diverse talents and strengthen the nation's overall competitiveness. 'We remain committed to working together with the federal government, Sarawak government, all political parties and education partners to build a fair, inclusive,and high-quality national education system,' it said. Providing background on ICSS, the association noted that these schools have operated mainly through their own funding, having nurtured many bilingual or trilingual students who perform well academically and have strong moral values. It emphasised that these schools are an important part of the national education system. 'However, the federal government has not yet fully recognised UEC. Because of this, UEC qualifications are not accepted for entry into public universities or the civil service, limiting students' chances for higher education and jobs. 'This has led to a loss of talent and creates a major obstacle to fair education and building a diverse and inclusive talent pool in the country,' added the association.

Sabah MTUC urges immediate re-election and council meeting to restore leadership
KOTA KINABALU (June 7): The Malaysian Trades Union Congress (MTUC) Sabah has called for an expedited re-election process to appoint new officers and restore effective leadership within the organization. Its chairman, Mohd Airy Arin, emphasized the urgent need for a general council meeting to ratify the election process, enabling MTUC to resume its vital role in representing Malaysian workers. MTUC is currently overseen by a special joint committee (JBK), appointed by the High Court on February 21, with a specific mandate to conduct leadership re-elections within 90 days — originally ending on May 22 and later extended until August. Mohd Airy noted that the JBK had issued a statement protesting the government's refusal to recognize MTUC delegates for participation in the International Labour Organization Conference (ILC) in Geneva, Switzerland. He recalled that the High Court's consent order on February 21 required the JBK to hold a Special Delegates Conference (SDC) to elect new leadership. However, the JBK has so far failed to meet this requirement. 'To date, there are still no officers capable of fulfilling the duties of MTUC,' he said in a statement. Highlighting the significance of the ILC as a tripartite platform involving governments, employers and workers, Mohd Airy stressed that the JBK lacks the mandate to nominate representatives on behalf of MTUC. 'Therefore, MTUC Sabah is urging the JBK to concentrate solely on conducting the re-election process and to convene a general council meeting immediately to formalize and ratify the process,' he added.
