HC sets aside cop's plea to quash trial court order in 2015 rape case

1 2 Cuttack: Orissa high court has refused to set aside the cognizance order passed by the court of sessions judge, Khurda, against a police officer, who is accused in the 2015 rape of a woman colleague. Justice Sibo Sankar Mishra, while refusing to entertain the officer's plea seeking to quash the Dec 2019 trial court order, allowed the officer the liberty to move the trial court seeking discharge or any other legal remedy. The trial court has been directed to consider all materials on record independently, without being influenced by the high court's observations. On Oct 23, 2024, Justice Mishra had issued an interim stay on further proceedings in connection with the case before the trial court. Though a charge sheet had been filed, charges are yet to be framed against Swain. The case will now proceed before the sessions court. In Tuesday's order, Justice Mishra observed that at the stage of cognizance, the trial court is not expected to conduct a detailed scrutiny of evidence. "The court is only required to examine whether a prima facie case is made out based on the police report and accompanying materials," the judge noted. It also emphasised that serious allegations under the IPC and the SC/ST Act require judicial caution before exercising inherent powers to quash proceedings. The inspector was accused of raping a woman sub-inspector in 2015. The FIR was lodged in Jan 2018 at Mahila Police Station. Following investigation, police submitted a final charge sheet on Dec 12, 2019, charging the officer under various IPC Sections and that of the SC/ST (Prevention of Atrocities) Act. The petitioner argued that the FIR was lodged with a mala fide intent arising from professional dispute, and that key electronic evidence such as social media messages had not been considered by the lower court. It was also submitted that the complainant's version lacked consistency and was not supported by independent or medical evidence.
