Former Liberal staffer Bruce Lehrmann is fighting to quash a civil finding he likely raped colleague Brittany Higgins, which led him to become 'probably Australia's most hated man'.
The former federal political staffer is appealing his defamation loss against Network Ten and journalist Lisa Wilkinson over an interview with Higgins on The Project in 2021.
Justice Michael Lee found Higgins' claims she had been raped in parliament house in 2019 were substantially true in a ruling against Lehrmann in April 2024.
But Lehrmann, 29, claims the judgment was rife with errors which will be ventilated during a three-day appeal hearing that got underway Wednesday.
He arrived at the Sydney courthouse more than an hour before the hearing, wearing his trademark rectangular glasses and navy suit, carrying a brown briefcase.
His lawyer Zali Burrows told the panel of judges that Justice Lee's serious ruling resulted in Lehrmann probably being 'the most damaged man in Australia'.
Media attention, aggravated by commentary from Channel Ten and Wilkinson, had led to a flood of hateful social media comments aimed at Lehrmann, she said.
'He's pretty much become a national joke,' Ms Burrows said. 'He's probably Australia's most hated man.'
The ex-Liberal staffer alleges he was denied procedural fairness because the events found by the judge were 'starkly different' from the case run by Ten.
'The primary judge found that the rape occurred in a particular way that wasn't put to Mr Lehrmann in evidence and he was taken by surprise as to the nature of the rape,' Ms Burrows said.
Lehrmann was accused of committing a violent rape but Justice Lee found it was a 'non-violent' rape.
'I'm not sure that's a concept I understand,' Justice Craig Colvin said when questioning whether that had been the finding.
Ms Burrows noted the judge had not been satisfied about a number of the violent elements argued by Ten, including that Lehrmann had held open Higgins' legs or pinned her to the sofa.
She said there had been 'a really unfair denial of natural justice' because her client was not questioned on the details of rape found by the judge on the balance of probabilities.
But Justice Michael Wigney noted Lehrmann had denied the sexual intercourse took place, so quizzing him on additional factors would have been fruitless.
'This is not a different case. This is a case where much of what was identified was found,' he said.
The trial judge found Lehrmann had been so 'hell-bent' on having sex with Higgins that he was reckless as to whether or not she was consenting.
But Justice Lee's definition of rape has been criticised by Lehrmann, who claims it is inconsistent with the meaning conveyed to an ordinary person.
Ms Burrows asked the court to reassess the finding that Lehrmann would only be entitled to $20,000 in damages, if he was found to be defamed.
She said it was inadequate and a much higher figure was needed to address the reputational damage of the very serious imputations of what she has dubbed a false charge of rape.
Lehrmann continues to deny he sexually assaulted Higgins and a criminal case in 2022 was abandoned without any findings against him.
'Having escaped the lions' den, Mr Lehrmann made the mistake of going back for his hat,' Justice Lee said in his decision in 2024.

U.S. Attorney for the District of Columbia Jeanine Pirro once labelled her fellow Fox News anchor Sean Hannity an 'egomaniac' and bragged about helping President Donald Trump, according to newly-released bombshell text messages. Pirro is at the center of a lawsuit brought by the voting machine manufacturer Smartmatic against Fox, in which the former is seeking $2.7 billion in damages for what it alleges do the network's anchors spread falsehoods and conspiracy theories about its products in the aftermath of Trump's defeat to Joe Biden in the 2020 presidential election. Fox settled a similar defamation lawsuit with Dominion Voting Systems in 2023 for $787.5 million but has insisted that Smartmatic's suit is without merit. 'The evidence shows that Smartmatic's business and reputation were badly suffering long before any claims by President Trump's lawyers on Fox News and that Smartmatic grossly inflated its damage claims to generate headlines and chill free speech,' the network said in a statement. 'Now, in the aftermath of Smartmatic's executives getting indicted for bribery charges, we are eager and ready to continue defending our press freedoms.' The texts gathered by the company concerning Pirro were released as part of an unredacted court filing on Tuesday and paint a fascinating picture of life behind the scenes at Fox. In one message sent by Pirro in September 2020 to Ronna McDaniel, the then-chair of the Republican National Committee, she bragged, 'I work so hard for the party across the country. I'm the Number 1 watched show on all news cable all weekend. I work so hard for the President and party.' In another message on October 27, she told a friend that Hannity had stormed into the Oval Office of the White House 'like he owns the place, throws his papers on the Pres desk and says, you don't mind if I use your private bathroom, and walks into bathroom within Oval and uses it.' She continued: '[He] Looks at me and says, I got to talk to him… It's all abt him, period. No one else matters.' Smartmatic also argues in its suit that Pirro served as an information conduit to Sidney Powell, the self-styled 'Kraken' attorney at the forefront of claims that Biden's victory at the polls was achieved by fraud, citing a message in which she encourages the lawyer to 'keep fighting.' The texts further reveal that Jerry Andrews, the producer of Pirro's show Justice with Judge Jeanine, warned her against making false claims about the election on air. 'You should be very careful with this stuff and protect yourself given the ongoing calls for evidence that has not materialized,' he told her. Pirro was then angered when Fox decided against running an episode on November 7 and wrote to Hannity: 'I'M TIRED OF THE CENSORSHIP AND I'M EMBARRASSED BY HOW THEY CALLED THIS ELECTION.' Hannity replied by observing: 'Fox News promoting u every 5 seconds. It's hilarious.' According to Smartmatic, Pirro otherwise acknowledged in a deposition that the 2020 election was not stolen, agreed that it had been 'fair and free' and that the company did nothing wrong. 'I believe that there's been no showing that Smartmatic engaged in any problems,' she said, according to the filing, which also quoted her as answering 'I do' when asked by the company's lawyers whether she believed Biden was 'legitimately elected.' Elsewhere, Pirro is seen complaining to the president's son Eric Trump that her ex-husband, Albert Pirro, was not initially granted a pardon by Trump over his tax evasion conviction and calling former New York City police commissioner Bernard Kerik, who was granted clemency, 'a selfish bastard,' writing to Kerik's girlfriend: 'I DON'T CARE [ABOUT] ANYONE ELSE.' Other Fox anchors mentioned in the suit include Jesse Watters, who texted his fellow presenter Greg Gutfeld in December 2020: 'Think about how incredible our ratings would be if Fox went ALL in on STOP THE STEAL.' A MAN has claimed his three inch penis is so small he could not have raped a woman in an alleyway at a party, a court heard. Hossein Mohmoudi, 34, is accused of dragging the woman to the ground in Stratford, East London in the early hours of the morning. 1 He then allegedly pulled up her skirt and raped her before he was interrupted by a passing cyclist. But defence counsel David Harounoff questioned whether the woman could have felt Mohmoudi's penis. He told jurors at Snaresbrook Crown Court that Mohmoudi has a small penis and cannot "get it up". Giving evidence, the complainant grabbed a 30cm ruler from beside the witness stand and asked Mr Harounoff if he wanted an exact measurement. He responded: "I'm going to suggest to you what you said is untrue. He has erectile dysfunction. He can't get it up. "It's the defence case that he has erectile dysfunction and his penis is three inches long. "The defence case is it would be physically impossible to have attempted or actually raped you." But the complainant responded: "That's not true." The court heard the woman was returning home from a Christmas party in December last year when the alleged horror unfolded. She had jumped out of a taxi to be sick before boarding a bus to Stratford. Just before 1am, the woman claims she was "dragged" to the floor and raped by a 6ft, "Middle-Eastern-looking" man with "yellowy, pale skin" and a "messy beard". She told jurors: "I just remember thinking he was foul. Really disgusting. Not clean. The smell. He was a smelly man. I think it's still on me. A smoker. Not somebody who looks after themselves.' The woman claims she could not have consented to sex because she did not see her alleged attacker "until it was happening". She also told the court she recalls "freezing" in horror during the 20 to 30 second attack. Mohmoudi has claimed he thought he recognised the woman so approached her to help. He said he then ran off when she "became hysterical" and started shouting at him. CCTV played to jurors showed the woman entering the alleyway before Mohmoudi follows her in. Hidden behind a large gate or fence, she shouts: "Wait, wait, wait. F**k you. F**k off. F**k you. F**k off". A cyclist then passes in the background before Mohmoudi runs away from the scene. Mohmoudi denies rape and the trial continues.
