'Wait, what?': Judge delivers wrong verdict to man on trial in deputy's death

USA Today17 hours ago
A Georgia judge mistakenly delivered a guilty verdict this week, confusing the courtroom with his announcement.
Alton Oliver, 26, went to trial last week on charges in connection with the 2022 fatal shooting of Fulton County Sheriff's Office Deputy James Thomas Jr. Thomas, who was 24, was found dead in a crashed vehicle.
Oliver was charged with six criminal counts, officials said, including three counts of murder. On Aug. 15, he was found not guilty and cleared of all charges by a jury of his peers, Judge Henry Newkirk announced.
According to 11Alive and Fox 5 Atlanta, Oliver testified he shot Thomas Jr. in self-defense after the deputy propositioned him to get into his vehicle for sex multiple times as he walked home from work at about 4:30 a.m.
Oliver's attorneys claimed self-defense throughout the trial, as prosecutors argued his account of events was inconsistent, noting he did not mention any sexual advances when first questioned by police, Fox 5 Atlanta reported.
The jury found Oliver not guilty, but Newkirk initially announced a guilty verdict on all six counts.
Shortly after, at least two members of the jury were heard saying from the jury box, "Wait, what?" The judge paused, footage from the trial shows, then he reread the verdict.

'Didn't I say 'not'?'
Before realizing the mistake, the judge responded, 'Didn't I say 'not'?' He then reread the correct statement, acquitting Oliver of all six criminal charges.
"We the jury find the defendant not guilty of all counts," the judge said after correcting himself.

Who was Deputy James Thomas Jr.?
A Mississippi native, Thomas Jr. served with the sheriff's office for less than a year, Sheriff Patrick Labat said in a statement after the shooting.
"Deputy Thomas served Fulton County residents with honor and distinction," the sheriff said. "His death is a tragic reminder of the dangers of this job that our deputies are willing to accept every day."
According to a GoFundMe created by Briana Lampkin of Dallas, Thomas' dream had been to become a law enforcement officer.
"He did just that; followed and lived vividly through his dream guided with love, integrity, and passion," Lampkin wrote on the fundraiser page. "Please keep our family in your prayers and we thank you for continuing to honor (him)."
USA TODAY contacted the sheriff's office and Lampkin on Wednesday, Aug. 20, but has not received a response.

Update on senior Dachshund Stolen From Blind Man in Chicago Has Everyone in Tears

Update on senior Dachshund Stolen From Blind Man in Chicago Has Everyone in Tears originally appeared on Parade Pets. When dogs are lost or stolen, their parents do everything in their power to find them. Reaching out to others to help in the search often brings positive results. Angel Santiago, a legally blind man in Chicago, spread the word when his 14-year-old Dachshund was taken from his yard and his efforts paid off in the best way. The YouTube video from Fox 32 Chicago shared how the service dog named Bam Bam was stolen from Santiago in Logan Square at 4 AM on June 5. Santiago revealed that two people had taken the dog after accessing his yard through a gate. He tried to intercede but was unsuccessful. The Chicago resident is legally blind due to glaucoma and Type 2 diabetes. Bam Bam is his emotional support dog and an integral part of his life. The devoted Doxie dad walked up to seven miles per day in search of Bam Bam and handed out flyers with the dog's picture. Santiago's neighbors assisted him in the search and helped him file a police report. A GoFundMe raised almost $20,000 to support rescue efforts that included reward money, pet detective services, flyer printing and organizing volunteer groups to increase the search area. "Bam Bam means the world to me and I feel my body draining away," Santiago shared as he pled for his dog's return. "I can only do so much. I promised that I will keep walking and walking, yelling his name out. But if you could just help me with your own eyes and see if you could spot him for me. Let your eyes be mine and look out for Bam Bam for me please. I beg of you to help me," Santiago said. Bam Bam Is Going Home The news Santiago hoped for recently came when Bam Bam was returned to a police station. "Police at the 16th district say that a male and female walked in with the dog, would not answer any questions, and they left," Joanie Lum reported on Fox Bam appeared to be in good health and detectives are now investigating the dog's disappearance. The Doxie will soon be reunited with his eagerly awaiting dad. Santiago refused to give up and got the help he needed from others who also hoped for Bam Bam's return. "It makes me feel really happy inside that I do have people that want to help and are backing me up," Santiago said. 🐶🐾🐾 Update on senior Dachshund Stolen From Blind Man in Chicago Has Everyone in Tears first appeared on Parade Pets on Aug 20, 2025 This story was originally reported by Parade Pets on Aug 20, 2025, where it first appeared.
