Wan Saiful gets court nod for bank statements in Jana Wibawa trial

KUALA LUMPUR: Former Bersatu information chief Datuk Wan Saiful Wan Jan has been granted access to three bank statements to support his defence in the corruption trial involving the Jana Wibawa project.
Sessions Court judge Rosli Ahmad allowed the application, ruling that the documents were not privileged and should be disclosed to the defence.
Wan Saiful filed the application by naming the public prosecutor, Maybank Taman Tun Dr Ismail branch executive Raja Muhammad Aiman Raja Sa'adi—who is also the 15th prosecution witness—and Maybank Islamic Bhd as respondents.
Wan Saiful is seeking a court order compelling all three respondents to provide three Maybank account statements belonging to Nepturis Sdn Bhd from January 2021 to December 2023, in physical or digital form.
"This court finds that the three bank statements are not privileged documents, and Maybank should provide those documents to the defence.
"If this application is allowed, it will facilitate the cross-examination of the prosecution witness.
"If the application is not allowed and is only granted at a later stage, it would require a fresh application to recall Raja Muhammad Aiman. This would clearly delay the trial process and waste the time of all parties involved.
"It is also in the interest of the first respondent, as the prosecution, to ease the disclosure of documents that favour the applicant," he said in his ground of judgment dated May 29.
The court said the respondents also have a duty to disclose documents favourable to the defence under Section 51 of the Criminal Procedure Code.
"In this case, the applicant is charged with soliciting a bribe from Lian Tan Chuan in return for helping Nepturis Sdn Bhd secure the Central Spine Road project: Sertik to the East Coast Expressway Interchange, valued at RM232,000,000 from the government.
"The applicant is also accused of receiving RM6,962,694.54, which was transferred from Nepturis Sdn Bhd's Maybank Islamic account to a CIMB Bank account belonging to WSA Advisory Group Sdn Bhd, as a reward for assisting the company in obtaining the letter of award for the project.
"The documents requested have the potential to prove the falsity of the charges against the applicant.
"This court agrees with the applicant's argument that these documents are important as they will provide a more comprehensive picture of the case," the court said, adding that the respondents would not be prejudiced if the application is allowed.
In his supporting affidavit, Wan Saiful said Wan Muhammad Aiman when testifying on Sept 19 and 20, last year, had been referred to and verified several documents, including Nepturis's Maybank account statements.
However, the defence was only furnished with bank statements covering the period of July to December 2022 and January to June 2023.
The prosecution opposed the application, contending that the three Nepturis's bank statements requested by the Wan Saiful were not essential to the defence.

Deputy Public Prosecutor Foo Fang Leong appeared for the prosecution. The judge allowed the accused, who is a father of two, bail of RM20,000 for all charges. MUAR: A man allegedly filmed in a viral video linked to a luxury MPV theft in Bakri has pleaded not guilty. Fried chicken seller Muhamad Badry Muhamad Azami, 24, was charged in the Magistrate's Court with dishonestly transferring a stolen Lexus MPV. He denied the charge before Magistrate Suzana Mokhtar. He was allegedly one of two men recorded by CCTV during the May 6 break-in. His alleged accomplice remains at large. The theft involved a Lexus MPV belonging to a 38-year-old man, allegedly taken at Jalan Yong Peng, Chaah, Segamat, around 11.30am on May 6. He was charged under Section 414 of the Penal Code, which carries a sentence of up to seven years' jail and a fine. Deputy public prosecutor Yasmin Mohd Piah led the prosecution, while Sakinah Suhaimi from the National Legal Aid Foundation represented Muhamad Badry. Bail was set at RM4,000, below the RM10,000 requested by the prosecution. Case mention is set for July 23. According to Rocketfuel Entertainment Vice President, Prem Rajahram Anand, the case that occurred in January last year involved the performance of an entertainment event involving their top artist, Hael Husaini. 'From the very start, we just wanted to settle this case amicably. But when we asked the employee to return the money that was supposed to be given to Hael, the employee refused. "Despite meetings, the employee had stated it was better for the court to decide. As this was the case, in the middle of last year, we (Rocketfuel) filed a police report against the former employee who is suspected of embezzling a sum of money for performance that Hael should have received. 'After reporting to the police, we decided to charge the employee in court. Today, we are present for the trial of the case and we are now awaiting the decision,' he said in an interview with the media at Kuala Lumpur Court Complex on Monday (June 16). On Monday evening, the case was adjourned to October. Prem added that Rocketfuel had given the individual involved an opportunity to settle the payment on several occasions but we (Rocketfuel) were told by the ex-employee to resolve the case according to the law. "Before filing a police report, we gave the individual a period of time to repay the money but it was failed to be settled. The ex-employee wanted to resolve the case legally and we took the step. "The case occurred in January last year and we filed a police report in June last year and the first case was mentioned in November 2024," he explained. At the same time, Prem said Hael's presence at the court was to be a witness in the courtroom. Hael said he was at the court to confirm that he has yet to receive the payment for his performance at the stated event. "I have said what had transpired during the hearing. Above than that, I will leave it to my record company Rocketfuel and our lawyer to handle the case from here. I have full confidence in my record company and they have always taken of me well for many years. It is best I leave it to them to handle the issue," said Hael, currently one of the top recording artiste in the country. Also present at the courts were the lawyer representing Rocketfuel Entertainment, Narainasami SM Alagu, and Rocketfuel Entertainment's Head of Music and Content Syakireen Othman.
