Viorel Doroscan (23), of Bay Meadows Square, Hollystown, West Dublin, and Otniel Richardo Clejan (24), with a former address at Verdemont in Blanchardstown in Dublin 15, have pleaded not guilty to the murder of Mahamud Ilyas on December 9, 2022.
Mr Ilyas was allegedly beaten to death after a row over a stolen bag of cannabis, sustaining depressed fractures to his head which a State pathologist said were 'typical of hammer blows'.
At the Central Criminal Court today, trial judge Mr Justice Tony Hunt briefed the jury before they watched the Snapchat video, saying that they must approach the evidence in an 'unemotional and dispassionate' manner, despite its potentially upsetting contents.
The video showed a man lying on the ground, face up, with visible blood on his face and a large blood stain on the wall behind him. Read more
The short clip showed the video-taker moving in closer to the head of the man on the floor and the shoe of the video-taker can be seen briefly.
Detective Inspector Liam Donoghue, of Blanchardstown Garda Station, told prosecution counsel Eoin Lawlor SC that he contacted Snapchat's office in the United States to request that they preserve data in regards to Mr Doroscan, Mr Ilyas and Mr Clejan. He said he believed Mr Doroscan had possession of a video relating to Mr Ilyas.
The witness proceeded to show a comparison of the shoe in the video and CCTV footage of Mr Doroscan on the same day, wearing shoes that Det Insp Donoghue said visually matched those in the video.
He said the video, which was posted as a 'Memory' on the Snapchat app, was confirmed to have come from Mr Doroscan's account and metadata provided by Snapchat said that the clip had been taken on 2.51pm on December 9, 2022 in the area of the Verdemont estate in Blanchardstown.
Assistant State pathologist Dr Margaret Bolster previously told Mr Lawlor SC that the cause of Mr Ilyas' death was blunt force trauma to the head.
She said the application of force to the head was from a blunt object such as a hammer, blows, and kicks.
Last week, witness Abdi-Aziz Mohamed testified that he met Mr Doroscan on December 9 2022, where the accused allegedly told him that 'we hit Mo with a hammer' - meaning the deceased Mahamud Ilyas - during a fight before leaving him 'on a field'.
At the opening of the trial Mr Lawlor said the prosecution intended to show that Mr Doroscan and Mr Clejan were involved in the sale and supply of drugs.
On December 8, 2022, counsel said, a house at Verdemont in Blanchardstown, Dublin 15 was being used to store cannabis. That evening Mr Ilyas called to the house and was seen leaving carrying a shopping bag containing cannabis. Mr Lawlor said Mr Ilyas 'wasn't supposed to' take the cannabis and then tried to sell it to others.
The following afternoon, Mr Lawlor said Mr Doroscan made contact with Mr Ilyas and told him he wished to speak to him urgently. Mr Ilyas went into the house at Verdemont at about 2.41pm.
Witness Vlady Ndosimau previously told the trial that he was at the bottom of the steps when Mr Ilyas went inside but ran up and barged through the door after hearing a loud banging noise. Inside, he said he witnessed Mr Ilyas sitting on the floor, with his back against a radiator, looking as if he had been beaten and with blood coming from his nose. His hands and feet were tied using a rope or a zip tie and he was moaning while Mr Clejan and Mr Doroscan shouted at him, the witness said.
Mr Doroscan, holding a fruit knife, stood between Mr Ilyas's legs while Mr Clejan stood close to his head with a hammer in his hand, the witness said. Mr Doroscan, he said, kept on shouting "where is the stuff" while Mr Ilyas responded by "groaning and groaning".
The trial continues tomorrow before Mr Justice Tony Hunt and a jury of five women and seven men.
Co-accused Lorenzo Cantaragiu (21), of Castlegrange Park, Blanchardstown, faces various charges of impeding the prosecution or apprehension of Mr Clejan and Mr Doroscan, by committing various acts while knowing or believing them to have committed the offence of causing serious harm to Mr Ilyas. He has pleaded not guilty to all charges.

Dublin thief posted videos of stolen €90,000 on Snapchat, court told

Stephen McMullen (27) stole €90,000 from a shop manager using "extreme threats of violence", it is alleged A HAMMER-wielding robber stole €90,000 from a shop manager using "extreme threats of violence" and later sent videos of the cash to his friends on Snapchat, it is alleged. Stephen McMullen (27) is accused of brandishing the hammer while ordering the manager to take cash from safes in a supermarket in Co Kildare. He was granted bail despite garda objections and the case against him was adjourned at Dublin District Court today. Mr McMullen, of Rowlagh Gardens, Clondalkin, is charged with robbery and production of a hammer capable of inflicting serious injury at Costcutter, Castle Village Drive, Celbridge, Co Kildare on July 17 this year. Objecting to bail, Garda Jennifer Finnegan told Judge John Brennan the store manager was opening up at 4.53am when two men arrived in a Ford Transit van that had been stolen in an earlier burglary in Maynooth. They entered the shop and one, alleged to be the accused, had a hammer. According to the prosecution, he 'threatened the store manager's life' and told him to open two safes. He also allegedly told the manager to destroy the CCTV. Footage showed a man armed with a hammer who was a similar height and build to the accused, Gda Finnegan said. In a later search of the accused's home address, some €27,870 was found in a Lidl bag in the attic. The money was wrapped in 'distinctive white bands' identical to those used by the alleged victim, the garda said. It was alleged the accused was seen on CCTV arriving at the address in a taxi carrying a Lidl bag. A phone alleged to be Mr McMullen's was seized at the address and, according to the gardai, it had "pinged" off a mast in Celbridge less than 2km from the shop, 13 minutes after the alleged robbery. It was alleged Mr McMullen had posted videos of the stolen cash on Snapchat and told friends he 'got €90,000 in a robbery.' The garda said the accused flew to Lanzarote 24 hours after the robbery and did not take the booked return flight but came home on another flight to attend his brother's funeral. Gda Finnegan believed the accused was a flight risk and would flee if bailed. She also feared he had access to the outstanding €63,000 cash and would dispose of it, and that he would contact the alleged victim to intimidate him. Applying for bail, defence solicitor Catherine Dolan said Mr McMullen, who was presumed innocent, made no admissions in interview. There was no forensic evidence linking him to the hammer, the stolen van or the cash found at his family home. There were five other adults there and he was living in a granny flat with a separate entrance, she said. Mr McMullen denied the Snapchat account was his and there was no evidence linking him to it, other than a username that did not require any identification to set up, Ms Dolan said. The accused had gone to Lanzarote for a holiday with his girlfriend who was pregnant and flew home early when his brother died in 'tragic circumstances." Judge Brennan said the charges were serious but granted bail with a €3,000 independent surety, to be approved by the court. Under conditions, the accused must surrender his passport, sign on daily at Ronanstown garda station and keep a night-time curfew. He was remanded in custody to appear in Cloverhill District Court next week. Stock photo Today's News in 90 Seconds - August 19th

Student, 20, accused of 14 counts of rape and sexual assault of male

A 20-year-old student has been charged with multiple counts of rape and sexual assault of another male in Dublin four years ago. The man, who cannot be named for legal reasons, was aged 16 and a juvenile, at the time of the sexual abuse over a three month period in 2021. He was arrested yesterday and charged with six counts of rape and eight for sexual assault at a specific address in south Co Dublin. He appeared before Judge John Brennan at a late sitting of Dublin District Court. Detective Garda Liam Conway said the young man replied "No" when each charge was put to him. The court heard that the Director of Public Prosecutions has directed that the man would face "trial on indictment". That means, due to the nature of some of the charges, he will be tried in the Central Criminal Court. Detective Garda Conway confirmed that the accused was a minor when the alleged offences occurred and there was no objection to bail provided he obeyed a series of conditions. Judge Brennan ordered him to provide gardaí with a contact phone number, remain contactable at all times, notify them of any address change, sign on at a north Dublin Garda station, and surrender his passport. Furthermore, he told the man that it was as conditions of bail that he must not communicate with the complainant, directly or indirectly, including by social media. Defence counsel Kevin McCrave consulted with the accused who did not address the court, before telling the judge that his client consented to those terms. Judge Brennan warned there would be consequences for breaching them and the barrister stressed that he would explain that to his client, who has yet indicate a plea.
