Supreme Court rejects bail for ex-IPS officer Sanjiv Bhatt. Here's why…

Mint29-04-2025

A Supreme Court bench comprising of Justices Vikram Nath and Sandeep Mehta on April 29 rejected ex-IPO officer Sanjiv Bhatt's bail request in the 1990 custodial death case, PTI reported.
The SC said there was 'no merit' in the bail or suspension of sentence plea, as per the report.
Pronouncing the order, Justice Vikram Nath said, 'We are not inclined to grant Sanjiv Bhatt bail. The prayer of bail is dismissed. The hearing of appeal shall not be affected. The hearing of appeal is expedited.'
Sanjiv Bhatt's plea against his conviction and life imprisonment is pending with the Supreme Court after he moved the apex court challenging the Gujarat High Court's January 2024 order dismissing his appeal.
Then additional superintendent of police, Sanjiv Bhatt on October 30, 1990 detained about 150 people after a communal riot in Jamjodhpur town. The riot happened during a 'bandh' call oppsing the halt of late BJP leader LK Advani's 'rath yatra' for the construction of a Ram temple in Ayodhya.
One of the detainees, Prabhudas Vaishnani, died in hospital after his release and his brother accused Sanjiv Bhatt and six other police officers of causing his death due to torture while under custody.
The Gujarat HC has also upheald Sanjiv Bhatt's conviction under Sections 302 (murder), 323 (voluntarily causing hurt) and 506 (criminal intimidation) of the Indian Penal Code (IPC), along with co-accused Pravinsinh Zala, as per the report.
Further, the HC had also dismissed Gujarat government's appeal to enhance sentences of five other accused, who were acquitted of murder charges but convicted under Sections 323 and 506, it added.
Sanjiv Bhatt was arrested on September 5, 2018, in another case where he is accused of falsely implicating a man for drug possession. The trial in the case is underway.
He is also an accused in a case of alleged fabrication of evidence in connection with the 2002 Gujarat riots cases along with activist Teesta Setalvad and former Gujarat director general of police RB Sreekumar.

Sexual crimes against animals: Plea in HC

New Delhi: Delhi High Court is likely to examine a plea seeking to prosecute those involved in sexual crimes against animals next month. The bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela on May 28 posted the matter for further hearing on July 16 to enable the petitioner to bring more facts on record. The court was dealing with a plea filed by the Federation of Indian Animal Protection Organisations (FIAPO) that highlighted the consequences of the "complete repeal" of Section 377 (unnatural sexual offences) of IPC under the newly enacted Bhartiya Nyaya Sanhita (BNS). While Section 377 of the IPC was read down by Supreme Court in the 2018 Navtej Singh Johar judgment to decriminalise consensual same-sex relationships, its complete deletion from BNS inadvertently decriminalised sexual violence against animals, it said. The parliamentary standing committee on home affairs, the plea said, in its report on BNS highlighted the removal of Section 377, proposing reinstating it to address non-consensual sexual offences against men, transpersons and animals. It submitted that in April 2025 alone, a couple of crimes were reported in Delhi against animals. A man was arrested in Shahdara for allegedly raping several dogs. A pet dog, which succumbed later, was found unconscious on a road in Saket, and a condom was found in its intimate parts. tnn

Telangana HC junks plea challenging Harish Rao's election win

Hyderabad: The Telangana high court on Tuesday dismissed an election petition challenging the election of T Harish Rao as MLA from Siddipet Assembly Constituency, calling the allegations vague, baseless and lacking material facts. Justice K Sarath pronounced the order while allowing an interlocutory application filed by Harish, who urged the court to reject the election petition filed by his political rival, G Chakradhar Goud, who had contested against Harish in Siddipet. Chakardhar had alleged malpractices, including improper acceptance of nomination, suppression of criminal cases and discrepancies in property disclosures. The court noted that Chakardhar failed to raise objections during scrutiny or provide evidence of improper nomination acceptance. The MLA had disclosed pending criminal cases and convictions in his affidavit (Form 26), while the petitioner provided no specifics on alleged suppression. The complainant's claims that agricultural land was misrepresented as non-agricultural land lacked authenticated revenue documents, the court said. Though he made allegations against Harish's poll expenditure, he did not submit records or demonstrate violations. The judge also looked at allegations of manipulated voting percentages (45% to 85% in an hour) and said that there was no booth-wise data or copies of the complaints made to the authorities to substantiate these allegations. The election petition lacked concise material facts as required under the Representation of the People Act, 1951, the judge said. He also said that Chakaradhar's reliance on unverified WhatsApp audio and video clips without corroborative evidence was insufficient. Citing Supreme Court precedents in Kanimozhi Karunanidhi, Harishankar Jain cases, the judge said bald allegations without triable issues warrant summary dismissal.
