New Delhi [India], July 11 (ANI): The Chairperson of Joint Parliamentary Committee (JPC) on One Nation One Election and Bharatiya Janata Party (BJP) MP PP Chaudhary on Friday said that most people and leaders across different states support the idea of One Nation, One Election.
After visiting five states and one Union Territory, Chaudhary said that many political leaders, civil society members, and officials backed the proposal, though some had concerns.
He added that the committee is discussing the issue seriously, and former Chief Justices of India will also give their views to help understand if the idea fits within the Constitution.
Speaking to ANI, PP Chaudhary said, 'We went on a study tour to five states and one Union Territory to gather opinions on the idea of One Nation, One Election. In Maharashtra, we met with the Chief Minister, Deputy Chief Minister, Speaker, leaders of political parties, government officials, and civil society members. Most of them supported the idea, though some political parties had concerns, mainly about national and state issues. Everywhere we went, we saw that committee members from all parties are showing genuine interest in this issue. We are all thinking about what is best for the country, beyond party lines. Former Chief Justices of India, Justice Khehar and Justice DY Chandrachud, will also be speaking to us. Their guidance will help us understand if this idea fits within the Constitution.'
Chaudhary said elections were held together, like in 1967 and 1957. He added that the Election Commission has the power to hold elections together under the law, and the committee will now discuss key issues like federalism and democracy with former Chief Justices in Delhi.
'From what we've seen so far, many people across the country support One Nation, One Election. In the past, general and assembly elections were held together, like four elections were held together in 1967. In 1957, you will see that about seven legislative assemblies were dissolved to conduct seven elections. Now, under the Constitution, the Election Commission has the power to notify elections for Parliament and state assemblies six months in advance, under Sections 14 and 15 of the Representation of the People Act. It also has some flexibility to hold elections together within a few months. So today, as we meet in Delhi, we will be discussing important issues like federalism and democracy with the former Chief Justices, and committee members will raise their questions,' Chaudhary said. The Supreme Court on Monday (July 28, 2025) pushed harder for the Election Commission of India (ECI)) to accept Aadhaar and the Elector's Photo Identity Card (EPIC) as identity documents in the Bihar Special Intensive Revision (SIR), saying 'mass inclusion' and not 'en masse exclusion' should be the outcome of the exercise in the poll-bound State. With three more days left for the publication of the draft electoral roll on August 1, the ECI continued to resist the court's suggestion, saying Aadhaar, EPIC and ration cards could be forged easily. On July 10, the apex court had asked the Election Commission to consider these three documents to ward off the spectre of mass disenfranchisement even as petitioners, ranging from activists to political parties, called the SIR a 'citizenship screening'. That can be take up on a case-to-case basis… For that matter, any document on this earth can be forged,' Justice Surya Kant, accompanied by Justice Joymalya Bagchi, addressed the Election Commission (EC). Justice Kant said Aadhaar and EPIC have a 'presumption of correctness'. Aadhaar has a system of being authenticated when in use. EPIC was issued by the EC itself. 'So, proceed with Aadhaar and EPIC… Include these two documents in the list of 11,' Justice Kant said. Justice Bagchi reasoned that none of the 11 'indicative' documents acceptable as proof of identity were of a conclusive nature, be it residence or caste certificates. 'According to you none of these 11 documents are conclusive. They are just documents to accompany the enumeration forms. So if someone gives an Aadhaar card as proof of identity, why will you not evaluate the claim of the person to be in the electoral roll?' Justice Bagchi questioned the EC's logic. Senior advocates KK Venugopal and Rakesh Dwivedi appeared for the EC. The petitioners were represented by senior advocates like Kapil Sibal and Gopal Sankaranarayanan. The court, which rose early, said it would announce on July 29 an early date and a proper schedule for hearing the final arguments in the case. Mr. Sankaranaraynan alerted the Bench about the proximity of the date of publication of the draft roll, August 1. But Justice Kant was unperturbed, saying 'it was only a draft'. Noting that the petitioners had not insisted on any interim relief of the stay of the publication or a freeze on the SIR exercise, the judge assured the petitioners that publication of the draft roll would not shrink the powers of the court to overturn any decision of the EC, provided the petitioners prove their case. The senior lawyer said the publication of the draft roll would leave 4.5 crore people excluded from it rudderless. The burden would be transferred onto them to prove their identity and citizenship, file objections and even seek a review. At this point, Justice Bagchi drew the counsel's attention to the EC affidavit which stated that voters who were in the existing 2025 electoral roll of Bihar would feature in the draft roll to be published on August 1, provided they submitted their enumeration forms, with or without documents. The existing electoral roll was published in Bihar on January 7, 2015 after a special summary revision of the electoral roll. 'In substance, each elector included in the 2025 electoral roll shall form part of the draft roll merely on submission of the enumeration form,' the 88-page ECI affidavit had submitted. The electors who were unable to submit their enumeration forms with documents in time for the draft roll had another opportunity to be included in the final roll. 'This claims period is stipulated for another period of 31 days after publication of the draft roll, ie, till September 1, 2025,' the ECI clarified. The final roll would be published on September 30, 2025. 'Even after the publication of the final roll, new electors can be enrolled up to the last date of nominations of the forthcoming Bihar elections… Any apprehension of huge disenfranchisement is misleading and non-existent,' the ECI has assured. Further, the ECI said electors whose names already feature in the electoral roll of Bihar in 2003, when the last intensive revision was held, were exempted from furnishing documents to prove their eligibility. 'They are only required to file the partially pre-filled enumeration form along with the extract of the 2003 roll,' the affidavit had said.

Supreme Court stays HC order pausing West Bengal govt's OBC quota notification

The Supreme Court on Monday stayed the Calcutta high court order, pausing the West Bengal government's notification extending reservation benefits to 140 communities under the Other Backward Classes (OBC) category, terming it 'erroneous'. The Supreme Court called high court's reasoning surprising. (AFP) A bench of Chief Justice of India (CJI) Bhushan R Gavai and justices K Vinod Chandran and NV Anjaria expressed surprise over the June 17 order staying a June 10 classification notification in the absence of legislation. It said that a nine-judge Supreme Court bench in the Indira Sawhney case (1992) allowed the executive to identify socially and educationally backward classes for reservation through executive notification. The observation came in the context of the high court observation that the state acted with 'undue haste' through an 'executive fiat' without placing the matter before the legislature. 'We will stay the order…It is very surprising to read the reasoning given by the high court. Prima facie, we feel the order is erroneous,' the bench said. The bench, which was initially inclined to return the matter to the high court by ordering status quo, posted the matter for hearing after two weeks. The lawyers, appearing in the case, insisted that the Supreme Court hear and decide the matter. Senior advocate Kapil Sibal, who appeared for the West Bengal government that challenged the June 17 order, said the state is facing contempt proceedings as it has to fill 900,000 posts based on the June 10 notification. Three individuals and an organisation challenged the notification, arguing that the state had not ascertained the economic conditions for extending the reservation and that it was not backed by law. A high court bench of justices Rajasekhar Mantha and Tapabrata Chakraborty passed an interim direction staying the June 10 notification until July 31. Senior advocates Ranjit Kumar and Guru Krishnakumar, who appeared for the petitioners in the high court, told the Supreme Court about a similar exercise to classify 77 castes as OBCs, mostly Muslims, since 2010. The high court struck down that exercise in May last year. The state appealed, but the Supreme Court refused to interfere. In March, the state government withdrew its appeal, saying a revised exercise was being conducted. Kumar and Krishnakumar argued that one and a half months is too short for ascertaining the eligibility of the communities to be added as OBCs on the state list. Krishnakumar pointed out that the law mandates the state to consult the backward class panel and carry out an extensive survey of the communities intended to be added to the OBC list. Sibal cited the Constitution's Article 342A(3) and said states are entitled to prepare and maintain the OBC list. The high court order said prima facie it appears the government was proceeding in hot haste and attempting to bring in the self-same classes and re-introduce the percentage of reservation, which had been struck down, by executive orders and not in exercise of the state's legislative functions. The May 2024 high court order struck down the state's decision, relating to 77 communities, citing the same reasoning that the legislature, and not the executive, can carry out this exercise.
