
Board backs draft land strategy
A strategy to guide how the Central Otago District Council deals with endowment land in Cromwell has been signed off by the ward's community board.
After approval by the Cromwell Community Board at a meeting last week, the draft land investment strategy will go to district councillors for adoption.
In a report presented to the community board, CODC staffer Saskia Righarts said the document would "underpin all future land developments in Cromwell", and could be something of a template for the development of other council land assets across the district.
CODC elected decision-makers were expected to be presented with a proposed plan for council land in Bannockburn Rd shortly.
That land was rezoned under Plan Change 18, with an aim of development, the revenue generated to be earmarked for the Cromwell hall project.
The draft strategy said its goal was to "create an enduring framework" for making "strategic investment decisions that are based on evidence, are clearly tethered to agreed principles and which achieve desired outcomes".
It outlined the "principles", under the headings CODC mission, purpose of the endowment land, longevity and consistency, stakeholders and community, and decision-making — and the "investment outcomes", under the headings sustainable growth, economic resilience, prudent financial management, and a healthy community.
The issue of Cromwell's endowment land came to a head last year.
Some Cromwell opponents to council moves towards district-wide funding claimed an "asset grab" was at play. Although it was difficult for anyone to put a figure on its worth, some claimed the value of Cromwell's endowment land was in the hundreds of millions of dollars.
During the meeting's discussion, deputy mayor and Cromwell councillor and community board member Neil Gillespie pushed for inclusion of a review cycle for the strategy, and one was decided on and included.
The wording of the strategy also noted it was intended to be a "living document".

PHOTO: ODT FILES The Dunedin City Council would have been vulnerable to a High Court challenge if Cr Jim O'Malley had not recused himself from a hearing about a cycleway, its lawyers concluded. Cr O'Malley had made a series of comments that were critical of businessmen who fought the potential loss of carparks in the Albany St Connection project and this led to questions about whether he could consider consultation feedback with an open mind. The council asked law firm Anderson Lloyd for its advice after property owner Greg Paterson took issue with Cr O'Malley's involvement in the hearing. The councillor accepted the law firm's recommendation he recuse himself and Cr O'Malley then went further and quit altogether as hearings committee chairman. Anderson Lloyd said if Cr O'Malley had chosen to stay involved on the Albany St matter, this would have created a moderate level of legal risk a challenge to the High Court about the council's process would have been successful. "This means such a claim should be expected to succeed, resulting in council's decision-making process being found to be invalid." The Albany St project has been a stop-start affair, which has been hampered by funding uncertainty and criticism about inadequate consultation. In the end, nine carparks were added back in and an additional round of consultation was run about limited aspects of the project. Yesterday's hearing went ahead but with Cr O'Malley not taking part there was little decision-making headway, as the two other panel members, deputy mayor Cherry Lucas and Cr Mandy Mayhem, were split about what to recommend to the council. Anderson Lloyd's assessment was Cr O'Malley had made repeated public statements indicating he was frustrated with where the process had landed. His comments "strongly indicate that he is unlikely to alter the view he formed when making his first decision on the project and gives the clear impression he is not prepared to fairly consider feedback from consultation from those who seek further carparks on Albany St".

Councillor off Albany St panel after ‘ill-judged outbursts'
Jim O'Malley. PHOTO: ODT FILES A councillor who lashed out at businesses has been forced off a hearings panel deciding on a contentious central Dunedin cycleway. Cr Jim O'Malley, who was due to chair today's panel considering the Albany St project, stood aside after property developer Greg Paterson said his "ill-judged outbursts" showed he was biased and not fit for the job. Mr Paterson's objection came after Cr O'Malley last month hit back at concerns from property investor Jason La Hood about the Albany Street Connection project. Cr O'Malley told the Otago Daily Times at the time he was so tired of accusations from those "same businessmen" he had considered quitting local politics. Property owners and local businesses have previously raised concerns about improper consultation on the project. Mr Paterson, who submitted on the project in addition to Mr La Hood, said it was important any future decisions regarding Albany St were made by a committee comprised of "fair-minded objective councillors". "To that end, I would submit Jim O'Malley should recuse himself from not only chairing, but also being a member of the committee as it is clear from his many somewhat ill-judged comments/outbursts in the press as of late that he is no longer able to apply or display any objectivity in relation to the decision-making process." There was a public perception that Cr O'Malley was "determined to 'ram home' the complete removal of all of the carparks" in the street, Mr Paterson said. "It is vital for the ratepayers of Dunedin and for the future of the city that important decisions are seen to be made in a fair, considered and balanced manner to which due process has been properly followed and for that reason I believe Jim O'Malley must recuse himself from any further involvement in the decisions going forward as to the Albany Street Connection." In a statement, Cr O'Malley said to avoid the potential for legal action he had decided to recuse himself. He maintained had he stayed on the panel he would have remained objective. "A committee member and especially the chair must leave any matters that are not related to the evidence presented at a hearing at the door. "If I had remained to consider this item, I would have done that," Cr O'Malley said. The Albany St project aims to provide a safe walking and cycling connection between the shared Te Aka Ōtākou harbour path, Dunedin's tertiary area and the CBD. In late 2023, the hearings committee voted 2-1 to proceed with the then recommended proposal to remove 68 carparks in the area. The council last month announced it had reintroduced nine carparks to the design, public consultation on suggested parking restrictions for the new carparks concluding last week. A report released this week said the most common themes in the responses received included "disappointment that a new consultation was required, and that the cycleway had not progressed already". A total of 53% of respondents were in support of four new five-minute carparks near the University of Otago's Central Library, and 57% favoured the five proposed opposite Hyde St. A submission from the Otago University Students' Association (OUSA) said, while it supported the overall direction of the project, it was concerned aspects did not adequately reflect the lived experience of students and might "lead to increased costs, stress and displacement for those already struggling with housing, transport and living costs". The nine reintroduced carparks would not meaningfully compensate for the loss of unrestricted or flexible-duration carparks in the street, it said. Many students did not have access to off-street parking — often renting older flats lacking driveways or garages — lived in overcrowded housing and worked irregular hours to make ends meet. Students depended on being able to park close to where they lived or studied. "By removing or heavily restricting parking without offering an accessible, affordable alternative, the council risks making Albany St and its surrounds functionally unlivable for many students." OUSA recommended the council retained at least the current number of unrestricted or all-day carparks in residential sections of Albany St and adjoining streets. Submissions on the project, as well as on proposed Sunday paid parking changes, will be heard at a meeting today.

Assessment of draft water plan not far off
PHOTO: ODT FILES A government assessment of a "rough working draft" of its water services delivery plan is expected soon, the Waitaki District Council says. At the latest weekly update on Tuesday, councillors and WDC staff provided further information on water service delivery plan requirements and the capital expenditure programme, needed to establish the planned ring-fenced, in-house water services unit as part of Local Water Done Well legislation. Last week the council submitted a draft plan to the Department of Internal Affairs (DIA), and is awaiting feedback. "We're expecting to be able to share some feedback next week, but we do know that we've got more work to do on our water services delivery plan before it is ready to be submitted," council chief executive Alex Parmley said. Presentations at Tuesday's workshop were made by the Local Government Finance Association (the main lender to local councils), representatives from Morrison Low, and district council infrastructure manager Joshua Rendell, together with assets planning manager Paul Hayes. There was also information on the introduction of water metering for water users in the district. That would see users move to a volume-metric charging system, based on water usage. WDC staff pointed out water metering had been shown in other areas to result in lower bills for the majority of households, excepting those with very large families. It had also resulted in a reduction of water wastage. It was also recommended that metering should be free for at least one year to help establish usage behaviour and identify any water leaks. The council will continue to work on creating a financially sustainable water services delivery plan. The deadline for providing internal affairs with a final water services delivery plan is September 3. The presentation given at the workshop is available on the council's website together with the working draft water services delivery plan. The next public workshop is scheduled from 3.30pm to 4.30pm on Tuesday, August 12 at the Council Chambers in Thames St.
