Google, Meta escape Buffalo shooter lawsuit
Reversing a lower court ruling, the state Appellate Division in Rochester said defendants including Meta Platforms' Facebook and Instagram, Google's YouTube, and Reddit were entitled to immunity under a federal law that protects online platforms from liability over user content.
The case arose from Payton Gendron's racially motivated mass shooting at Tops Friendly Markets on May 14, 2022.
Relatives and representatives of victims, as well as store employees and customers who witnessed the attack, claimed the defendants' platforms were defective because they were designed to addict and radicalise users like Gendron.
Lawyers for the plaintiffs did not immediately respond to requests for comment.
Other defendants included Alphabet, Amazon.com, Discord, 4chan, Snap, and Twitch, all of which Gendron used, the mid-level state appeals court said.
Writing for a 3-2 majority, Justice Stephen Lindley said holding social media companies liable would undermine the intent behind Section 230 of the federal Communications Decency Act, to promote development of and competition on the internet while keeping government interference to a minimum.
While condemning Gendron's conduct and "the vile content that motivated him to assassinate Black people simply because of the color of their skin," Lindley said a liability finding would "result in the end of the Internet as we know it."
"Because social media companies that sort and display content would be subject to liability for every untruthful statement made on their platforms, the Internet would over time devolve into mere message boards," he wrote.
Justices Tracey Bannister and Henry Nowak dissented, saying the defendants force-fed targeted content to keep users engaged, be it videos about cooking or puppies, or white nationalist vitriol.

Fantano concluded the video by criticising DJ Akademiks, whose affiliated page helped circulate the clips. He stated he will no longer appear on platforms that share or support ideas he fundamentally disagrees with.

Russian missile attack injures seven in Mykolaiv, Ukraine says
A Russian missile strike on the city of Mykolaiv in southern Ukraine injured at least seven people and destroyed or damaged dozens of homes and civilian infrastructure buildings, the regional governor said on Sunday. Two of the injured were hospitalised as a result of the late Saturday attack, Mykolaiv Governor Vitaliy Kim said on the Telegram messaging app. Kim posted photos showing single residential buildings almost destroyed, with building debris spread around. He said 23 private homes, 12 apartment buildings and a post office were damaged. Reuters could not independently verify the report. There was no immediate comment from Russia about the attack. Both sides deny targeting civilians in the war that Moscow launched with a full-scale invasion on Ukraine in February 2022. Ukraine's air force said on Telegram that Russia had launched 76 attack drones and seven missiles targeting Ukraine overnight, striking eight locations throughout Ukraine. Ukraine's air defence units destroyed 60 of the drones and one missile, it said. In the early days of the war, the Mykolaiv region stood on the front lines, facing frequent artillery strikes and aerial attacks. Even after Russian forces were pushed back in late 2022, drones and missiles have remained a constant danger to communities. Ukraine's drone attack sparks fire at oil depot in Russia's Sochi, governor says
More than 120 firefighters were trying to extinguish a blaze at an oil depot in the Russian city of Sochi that was sparked by a Ukrainian drone attack, regional Governor Veniamin Kondratyev said early on Sunday on the Telegram messaging app. In the Krasnodar region on the Black Sea where Sochi is located, a fuel tank with a capacity of 2,000 cubic metres (70,000 cubic feet) was on fire, Russia's RIA news agency reported, citing emergency officials. The Russian defence ministry said in its daily morning report on Telegram that its air defence units destroyed 93 Ukrainian drones overnight, including one over the Krasnodar region and 60 over the waters of the Black Sea. The ministry reports only how many drones its units destroy, not how many Ukraine launched. Rosaviatsia, Russia's civil aviation authority, temporarily halted flights at Sochi's airport to ensure air safety before saying on Telegram that flights resumed as of 0200 GMT on Sunday. Reuters could not independently verify the reports. There was no immediate comment from Ukraine. The attack, which Kondratyev said was in the Adler district of the coastal resort city, would be Ukraine's latest on infrastructure inside Russia that Kyiv deems key to Moscow's war efforts. A woman was killed in the Adler district in a Ukrainian drone attack late last month, but attacks on Sochi, which hosted the 2014 Olympic Winter Games, have been infrequent in the war that Russia launched in February 2022.
