Penang rules out gazetting Middle Bank Marine Sanctuary to avoid project disruptions

Yahoo21-05-2025

GEORGE TOWN, May 21 — The Penang state government does not plan to gazette the Middle Bank Marine Sanctuary, according to state executive councillor H'ng Mooi Lye.
The state local government, town and country planning committee chairman said the Middle Bank cannot be gazetted as this would classify it as an environmentally sensitive area.
'Any projects implemented within a 500-metre radius of an environmentally sensitive area would require a Second Schedule Environmental Impact Assessment (EIA) report,' he told Malay Mail recently.
He said this could affect planned projects near the area and might also impact the Penang Port expansion project.
H'ng was clarifying his response to a written question by Lee Khai Loon (PKR-Machang Bubuk) at the state legislative assembly regarding the rehabilitation of the Jelutong landfill project. The project involves reclaiming 70 acres (28ha) of the sea, with potential implications for the Middle Bank.
In his reply to Lee, H'ng said the state approved the 70-acre (28ha) sea reclamation to create a work platform for rehabilitation works at the landfill.
'The Jelutong landfill is unsafe because it has long been used as an open dumping ground,' he said.
Lee also asked if the state had an exit clause in case the rehabilitation project failed.
H'ng said the joint development agreement would be cancelled if the project failed to proceed.
'A new tender process would then be initiated through a Request for Proposal (RFP) or open tender procurement procedure,' he said.
However, he noted there was a risk of claims and legal action by the developer against the state government and Penang Development Corporation (PDC).
He added that a new developer would not be able to take over the project until legal procedures were completed, which could take between three and five years.
The Middle Bank Marine Sanctuary spans around 10 square kilometres in the waters of the South Channel between Penang island and the mainland.
It is home to the only seagrass bed in the Straits of Malacca. A study revealed a total of 429 species of seagrass, trees, vegetation, fish, birds, marine mammals, turtles, molluscs, arthropods and echinoderms inhabit the area.
The rehabilitation project has yet to begin as it is still awaiting EIA approval from the Department of Environment (DoE).
The PDC signed a deal with PLB Engineering Bhd in 2020 to rehabilitate and develop the Jelutong landfill at a cost of RM1 billion.
The DoE issued a public notice on its Facebook page on February 12 this year regarding the proposed rehabilitation and reclamation project.

Which businesses got part of Tennessee's $1.5 billion tax refund

Tennessee is revealing which businesses got a combined $1.5 billion in state franchise tax refunds — but the list is only available for a limited time. Why it matters: Lawmakers approved a massive franchise tax cut last year, along with three years of retroactive refunds, which were massive drains on the 2024-25 budget. Refunds are expected to account for about $1.5 billion. The state's public database of beneficiaries will only be available through June 30. Zoom in: The state is not disclosing exactly how much each company received. Instead, the results are grouped into brackets: refunds of $750 or less, refunds ranging from $750-$10,000, and refunds of more than $10,000. More than 58,000 entities are included on the refund list. Many companies have multiple entries, reflecting various subsidiaries that got refunds. Companies listed in the highest refund bracket included FedEx (which had 12 separate entries), Amazon, Dollar General and Gov. Bill Lee's family business the Lee Company. Flashback: Supporters of the tax cut, including Lee, argued the design of Tennessee's franchise tax on businesses violated the U.S. Constitution. They said a cadre of Tennessee businesses could sue the state unless lawmakers approved a change that slashed collections.

NextSource Materials Shifts Battery Anode Facility Plans to Middle East for Accelerated Growth

TORONTO, ON / / June 2, 2025 / NextSource Materials Inc. (TSX:NEXT)(OTCQB:NSRCF) ("NextSource" or "the Company") announces an update to its Battery Anode Facility (BAF) strategy, withdrawing from its Mauritius option to focus on accelerated, larger-scale opportunities in the Middle East. Since November 2022, NextSource has been working closely with its project stakeholders to establish a world-class BAF in Mauritius. The Company leased a potential BAF site and invested in upgrading existing processes to ensure compliance with local regulations and to minimize any environmental impact. Throughout the extensive Environmental Impact Assessment (EIA) review process, the Company continually and promptly met all requests for information. Due to the prolonged and costly nature of the process, along with the remaining risk of post-approval contestation of Minister-approved EIAs, the Company has decided to exercise its option to terminate the lease agreement at the end of May and withdraw its EIA application at no further cost. This strategic decision minimizes financial exposure while leveraging the transportable BAF processing equipment, ensuring cost-efficient redeployment and installation at any suitable new location. The Company is now prioritizing the development of a larger-scale BAF in the Middle East, targeting prospective sites in the Kingdom of Saudi Arabia and the United Arab Emirates. These locations offer streamlined permitting processes, robust infrastructure, and strategic proximity to global EV manufacturers ("OEMs"), enabling the Company to accelerate its timeline and meet growing demand for high-value graphite anode material. NextSource has made steady progress to advance discussions with potential OEMs to secure an offtake agreement, currently under negotiation. These negotiations are centered on meeting the specific requirements of OEMs supported by positive feedback from product qualification trials. The development of larger-scale BAFs aligns with the Company's broader strategy of ensuring a secure and sustainable supply chain of active anode material for global OEM customers. Hanré Rossouw, President and CEO commented, "NextSource continues to progress our commitment to a sustainable and scalable supply chain for battery anode materials. While the decision to terminate our lease in Mauritius has not come lightly, we are excited to pursue larger-scale opportunities in the Middle East, leveraging our expertise and assets to meet global demand more efficiently." A move to the Middle East also aligns with navigating evolving global trade dynamics, including favorable tariff structures in regions like the UAE, which currently faces a 10% US reciprocal tariff compared to markedly higher tariffs on Chinese graphite anode materials. Battery Anode Facilities are value-added processing facilities that are capable of converting smaller size fraction graphite concentrate into a high-value graphite anode product, which is a critical and major component to the battery anode material that is assembled along with cathode material into lithium-ion batteries used in electric vehicles. About NextSource Materials Inc. The first task facing South Korea's next leader: Handling Trump

When South Koreans elect a new president Tuesday, it will end months of domestic political turmoil — but their choice could bring big changes to the country's relationship with the United States. Lee Jae-myung, leader of the liberal opposition Democratic Party, had a clear lead in polls going into the election, which is being held six months to the day after then-President Yoon Suk Yeol plunged the East Asian democracy of more than 50 million people into turmoil by abruptly declaring martial law. Since lawmakers impeached Yoon in December over the short-lived martial law order, South Korea has been stuck in a leadership vacuum, churning through a series of acting presidents. The uncertainty has also constrained the U.S. ally in Washington even as President Donald Trump slapped it with a 25% 'reciprocal' tariff, among other levies. The presidential by-election, which was triggered in April when South Korea's Constitutional Court upheld Yoon's impeachment, promises a return to stability, and South Koreans have turned out in record numbers for early voting. 'A lot of people just want to move on, because it's been a long six months,' said Jennifer Lee, a principal at the Asia Group corporate consultancy in Washington, who recently returned from a trip to South Korea. Lee Jae-myung, 61, who narrowly lost to Yoon in 2022, has been seen as the most likely next president since Yoon was impeached. But public support for Lee has been driven more by anger at Yoon's conservative People Power Party, which has declined to condemn his actions, than by agreement with Lee's policy positions, said Rob York, director for regional affairs at Pacific Forum, a foreign policy research institute in Honolulu. 'I don't think enthusiasm for him is especially strong,' York said. 'He's not an especially inspiring figure for a number of reasons, but the conservative party is simply so tainted right now.' Further boosting Lee's chances is the fact that conservative votes are being split between Kim Moon Soo, the People Power Party candidate, and Lee Jun-seok, a young lawmaker from the upstart Reform Party who has been generating controversy with his antifeminist remarks. Though Lee has moved toward the center during the campaign, he is generally seen as more open to China and North Korea than his predecessor and less friendly toward Japan, which is part of a trilateral security partnership with the United States and South Korea. Because Yoon was 'so pro-U.S. and hardcore U.S.,' it seems unlikely that the U.S.-South Korea relationship will remain as strong, the Asia Group's Jennifer Lee said. 'I think that there will be some more balancing act between the United States and China,' she said, and if the Trump administration 'comes out hard' on issues such as tariffs or cost-sharing for the 28,500 U.S. troops stationed in South Korea, 'I think there may be a lot more frictions ahead.' Still, Lee the candidate has expressed support for the U.S.-South Korea alliance and already begun reaching out to the Trump administration. In an interview last week with Time magazine, Lee said Trump 'has outstanding skills in terms of negotiation' and that both he and Trump are simply looking out for the interests of their people. Though he doesn't align with Trump's conservative views, Lee has in the past been nicknamed 'Korea's Trump' by supporters enamored with his populist, outspoken style. Like Trump, Lee also survived an attempt on his life last year, having been stabbed in the neck during a visit to the city of Busan. 'Personality-wise I think the two of them, if they're in a room together, would probably get along,' York said. 'Both of them are people who view themselves as dealmakers, and I think they're more concerned with crafting a deal that makes both of them look good.' One of Lee's top priorities will be reaching a deal on tariffs, which have hit South Korea hard. In addition to the 25% tariff, South Korea — the world's 10th-largest economy — is vulnerable to steep duties on some of its biggest exports, such as steel and automobiles. Lee is also facing a more assertive North Korea, whose leader, Kim Jong Un, has been advancing his ballistic missile and nuclear weapons programs. Like Trump, Lee favors greater engagement with the North, pledging last week to restore a military hotline between the two rivals, who technically remain at war. Though Trump has said he'd like to revive his in-person diplomacy with Kim, North Korea appears far less interested in negotiating than it was when the two leaders met in 2018 and 2019. Kim is now receiving crucial economic and military support through a security partnership with Russia, and he said last year that North Korea is no longer pursuing reconciliation with the South. The heightened tensions on the Korean Peninsula come amid reports that Trump is considering withdrawing thousands of U.S. troops from the South, an idea he also floated during his first term. Though Seoul says there have been no such discussions, Pentagon officials say a troop reduction has not been ruled out. Neither South Korea nor U.S. Forces Korea (USFK) were barely mentioned in Defense Secretary Pete Hegseth's speech in Singapore last weekend laying out the U.S. approach to the Indo-Pacific, adding to concerns about where the country stands with Washington. 'The U.S. can unilaterally decide and act on reducing USFK troops. It's their military, after all,' said Bong Young Sik, a North Korea specialist at the Yonsei Institute for North Korean Studies at Yonsei University in Seoul, referring to U.S. Forces Korea. But 'they need to consider and accommodate the situations their security partners are under and facing,' he said. 'If they go with 'What is good for the U.S. is good for the world,' I am not sure how long that approach could work,' Bong said. Jennifer Jett reported from Hong Kong and Stella Kim from Los Angeles.
