
TNCSC contract computer operators demand regularisation, basic entitlements
At a State-level meeting held in Tiruchi on Sunday, the operators passed a resolution pressing four key demands: immediate regularisation of all contract computer operators, provision of basic amenities for women including functional toilets in all godowns, grant of paid maternity leave, and an end to arbitrary and frequent transfers.
Operators A. Manivannan from Nagapattinam and S. Sivashanmugamani from Tiruppur said the monthly salary, which began at ₹4,500, was revised to ₹13,648 in March 2022. However, they alleged irregularities in deductions made for Provident Fund (PF) and Employees' State Insurance (ESI), with little transparency or accountability.
'Despite the DMK government's electoral promise to regularise contract workers, TNCSC continues to take a hostile approach. We are denied even casual leave. For women, there is no maternity leave, and basic facilities like toilets are missing in many centres,' said Mr. Manivannan.
Workers also alleged that women employees faced arbitrary transfers and punitive actions for minor issues, including discrepancies in attendance records or leave applications. In some cases, they claimed staff were locked out of work without prior notice.

Supreme Court mandates compensation for accidents during office commute
The Supreme Court has ruled that employees and their families will be entitled to compensation under the Employees' Compensation Act, 1923, not just for accidents occurring during the course of work but also for mishaps while commuting to and from their place of employment. The Supreme Court judgment came in a case involving Shahu Sampatrao Jadhavar, a watchman at a sugar factory in Maharashtra.(Vipin Kumar/ Hindustan Times) In a significant verdict broadening the scope of workers' rights and social welfare protection, a bench of Justices Manoj Misra and KV Viswanathan interpreted the phrase 'accident arising out of and in the course of employment' in Section 3 of EC Act to include commuting accidents, provided a clear nexus is established between the time, place and circumstances of the accident and the employment. This liberal interpretation, authored by Justice Viswanathan and delivered in a case involving the death of a sugar factory watchman on his way to work, is a progressive step in expanding the social security framework for millions of workers across India, especially those not covered under the Employees' State Insurance (ESI) scheme. 'We interpret the phrase 'accident arising out of and in the course of employment' under Section 3 of the EC Act to include accident occurring to an employee while commuting from his residence to the place of employment for duty or from the place of employment to his residence after performing duty,' the court said in its July 28 ruling. It clarified that the benefit of this interpretation is contingent on showing a clear nexus between the time, place and circumstances of the accident and the employment. That is, if a worker meets with an accident during a routine and timely commute to or from the workplace, it may qualify as employment-related for compensation purposes. The judgment came in a case involving Shahu Sampatrao Jadhavar, who worked as a watchman at a sugar factory in Maharashtra. His shift on April 22, 2003, was scheduled from 3 AM to 11 AM. While commuting to work in the early hours, his motorcycle met with a fatal accident around 5 km from the factory. He left behind his widow, four children, and his mother. A claim under EC Act was allowed by the commissioner for workmen's compensation and civil judge, Osmanabad, who awarded ₹3,26,140 as compensation along with 12% annual interest, and also directed the employer to pay 50% of the amount as penalty. The employer's insurance company was held liable to pay the compensation. However, the Bombay High Court reversed the award, holding that since the accident occurred outside the precincts of the factory, it could not be said to have arisen out of employment. Setting aside the high court's ruling, the top court restored the commissioner's award and reaffirmed that the commute to work can form an integral part of employment under EC Act if the contextual nexus is established. The court drew from Section 51E of ESI Act, which was introduced in 2010 and explicitly provides that commuting accidents, if there is a connection between the circumstances, time and place, are deemed to have occurred in the course of employment. While EC Act does not have such a specific provision, the top court held that since both statutes are beneficial legislation aimed at social welfare and worker protection, they are 'statutes in pari materia' (dealing with the same subject matter). Hence, the interpretation under one can inform the other. 'Both the EC Act and the ESI Act seek to ameliorate the conditions of workmen and provide them social security benefits,' stated the judgment, noting that EC Act applied to all other employers and employees not covered under ESI scheme. The court cited its own 2016 ruling in Jaya Biswal Vs IFFCO Tokio General Insurance Co to reaffirm that EC Act is a social welfare legislation, meant to secure minimum protection and compensation for workers, with reduced legal formality and regardless of fault.

Labourer killed, four injured as platform collapses in NTPC-Sipat
Raipur: A labourer was killed and four injured after a platform collapsed in an accident that occurred at govt-run National Thermal Power Plant's (NTPC) Sipat thermal power plant in Bilaspur district of Chhattisgarh on Wednesday. The incident took place during maintenance work in Unit-5 of the 500 MW plant of NTPC, when the air pre-heater platform suddenly collapsed. The victims were carrying out a repair work when the balance of the platform reportedly gave way, causing the workers to fall from a height, Gopal Satpathi, Station House Officer (SHO), Sipat told reporters. The deceased worker was identified as Shyam Sahu, 27. The four injured were receiving treatment at hospitals. Police arrived at the scene shortly after the accident to begin an investigation into the circumstances. An official from NTPC management told TOI, "The incident took place at Unit-5 of Sipat station, in which five contract workers were injured. The APH structure platform collapsed where workers were doing their work. They were rushed to hospital and condition of three workers is stated to be stable. " "All injured are being given proper treatment. Investigation is underway. Detailed information will be shared after the investigation," said the officer. There was no immediate clarification on the exact timing or cause of incident. Praveen Ranjan Bharti, Public Relations Officer of NTPC Sipat said in a statement that the incident took place during the overhauling operations when a platform collapsed while contract workers were working on it. Three of the injured were treated at the Sipat station hospital and discharged after receiving medical care. In a meeting held in the presence of district administration officials and public representatives, it was decided that the family of the deceased will receive Rs 5 lakh each from both NTPC Sipat and the contractor company as compensation. Additionally, all benefits entitled under the Employees' State Insurance (ESI) scheme will be provided. The deceased worker's wife will also be offered a job under the unskilled or semi-skilled category on a contractual basis. For funeral arrangements, the contractor has given an immediate cash assistance of Rs 50,000 to the bereaved family. NTPC Sipat has expressed deep condolences over the loss and reaffirmed its commitment to supporting the deceased worker's family in every possible way.

Over ₹ 79,000 seized in Arcot municipality office after worker's complaint
Officials from the Directorate of Vigilance and Anti-Corruption (DVAC) seized ₹ 79,282 unaccounted cash from the office of Arcot municipality in Ranipet on Wednesday. DVAC sources said that the municipality has engaged 102 temporary sanitary workers on contract basis mainly for door-to-door garbage collection from households in the town. As per norms, each worker should be paid Rs 489 for their work on a daily basis. However, it has been alleged by sanitary workers that they were paid only Rs 370 for each worker daily by the civic body. Sanitary workers also complained of non-payment of wages for the past three months by the civic body. Thw workers have complained to DVAC that more money has been deducted from civic officials for Provident Fund and ESI from their wages as against stipulated percentage of wages to it. Based on complaints by affected workers to the Commissionerate of Municipal Administration, a six-member team led by V. Ganesh, Deputy SP, DVAC (Ranipet) conducted the searches between 8. 30 p.m on Tuesday to 4.30 a.m on Wednesday morning. DVAC officials also questioned Municipal Commissioner S. Venketalakshman and other senior municipal officials present during the searches in the office. After hours of search, DVAC officials recovered the unaccounted cash from washrooms and storerooms in the municipal building. As most of the financial transactions are done online, DVAC also seized mobile phones of senior municipal officials for verification of cash transactions. A detailed investigation is underway.
