Najib betrayed public trust by misusing RM42m, court hears in civil suit against former PM
Counsel Kwan Will Sen, representing SRC International and its subsidiary, Gandingan Mentari Sdn Bhd, in the RM42 million civil suit against Najib, stated that it has been ten years since the money ended up in Najib's personal accounts and now, the two companies want it back.
He made these remarks while delivering the opening statement on the first day of trial in the civil suit filed in May 2022 by SRC International and Gandingan Mentari against Najib (the sole defendant).
'Three courts namely the High Court, Court of Appeal and Federal Court, have already found him (Najib) criminally guilty of these very acts beyond a reasonable doubt.
'Najib was the Finance Minister at the time and had full control over SRC International. He held key positions, including that of Advisor Emeritus. As such, no significant transaction occurred without his knowledge or consent,' he said.
Kwan also stated that the evidence will prove that the RM42 million was transferred from SRC International and ultimately ended up in Najib's personal bank accounts. Of this sum, RM32 million was immediately transferred to two companies that had previously covered shortfalls in Najib's accounts.
'These transfers were made pursuant to instruction letters bearing his (Najib) personal signature. The remaining RM10 million was spent through personal cheques issued by Najib himself,' he said.
'We say that the money trail is clear, the documentary evidence is overwhelming, and Najib's own sworn admissions are damning. We will prove our case under three complementary causes of action; knowing receipt, dishonest assistance, and misfeasance in public office.
'On any of these grounds, justice demands that these public funds be returned to their rightful owners – the Malaysian people,' he insisted.
The court today heard testimony of the first witness, former chief executive officer (CEO) of Yayasan Rakyat 1Malaysia (YR1M), Ung Su Ling, 57, whose appointment was approved by Najib.
The hearing before Judge Datuk Raja Ahmad Mohzanuddin Shah Raja Mohzan will continue on November 6.
This lawsuit, filed in May 2022, accuses Najib of breach of fiduciary duties, knowing receipt of funds, dishonest assistance, tort of misfeasance and abuse of power in relation to the misappropriation of SRC International funds. — Bernama

Vape products worth RM316,000 seized in Perlis as ban takes effect
The sale of vape and electronic cigarettes has been banned in Perlis since Aug 1. PETALING JAYA : Police have seized vape products worth nearly RM316,000 in Kangar, Perlis, as the ban on selling vape and electronic cigarettes takes effect in the northern state. Bukit Aman internal security and public order department director Azmi Abu Kassim said this followed raids on two premises in Kangar on Friday in collaboration with the municipal council. They were acting on public complaints about vape products being sold despite the ban, which took effect on Aug 1, Berita Harian reported. Azmi said 2,083 units of devices and vape liquids worth RM104,150 were confiscated in the first raid, and 4,235 units worth RM211,750 were seized in the second operation. The local council also issued compound notices to the caretakers of the premises for violating the Local Government Act 1976. 'All the items seized are believed to have been for sale, despite the Perlis government enforcing a ban on the sale of electronic cigarettes and vapes since Aug 1,' he said.

Help other Penang estate families get houses, says Ramasamy
Urimai chairman P Ramasamy said the Penang government should show kindness to the Indian families who have toiled for generations in estates across the state. PETALING JAYA : The Penang government has been urged to provide homes at a nominal price to former estate workers and those displaced from other estates. Urimai chairman P Ramasamy praised the state government for honouring its pledge to provide free housing to the 23 families in Ladang Sungai Kechil in Nibong Tebal, but said the state should also show kindness to other Indian families who have 'toiled for generations' in estates across Penang. He said chief minister Chow Kon Yeow was well aware of the plight of former plantation workers in the state. 'Let not overzealous, pro-capitalist elements in the administration prioritise profit over the welfare and dignity of the workers,' he said in a Facebook post. 'If the former Caledonia estate workers were able to purchase low-cost terrace houses for as little as RM10, I fail to see why the same principle cannot be applied to Ladang Sungai Kechil.' Earlier today, Chow said the state government will provide houses in a state-backed development project to 23 families at the Sungai Kechil estate who were facing eviction. Each family will receive a three-bedroom single-storey terrace house of 750 sq ft with parking space in front. In 2019, Penang Chief Minister Inc signed a deal with the Eco World group to build 272 single-storey, low-cost homes and amenities for the families of workers living as squatters in Caledonia estate.

Bukit Aman CID takes over probe into attack on Rafizi's son
The attack on Pandan MP Rafizi Ramli's 12-year-old son occurred at a shopping mall in Putrajaya last Wednesday. PETALING JAYA : The federal police's criminal investigation department has taken over the investigation into the attack on Pandan MP Rafizi Ramli's 12-year-old son on Aug 13. Selangor police chief Shazeli Kahar said the case has been handed over to Bukit Aman to allow for a more holistic and centralised probe to be held, Berita Harian reported. Shazeli Kahar. He also urged anyone with information to contact the nearest police station to assist in the investigation. Yesterday, Shazeli said police found multiple positive leads in their investigation that could help hunt down those involved in the attack, following examination of CCTV footage. Police are also working with the Malaysian Communications and Multimedia Commission to investigate the threatening text messages that Rafizi's wife had received a day after the attack. The attack on Rafizi's 12-year-old son occurred at a shopping mall in Putrajaya at about 2pm on Wednesday. The former economy minister said CCTV footage showed that two men, dressed in black with their faces fully covered by helmets, had followed his wife's car on a motorcycle before the incident. His son, who was dragged and stabbed with a syringe, was rushed to hospital for treatment and a checkup. The assailants escaped. The former PKR deputy president suspected that the attack was planned, and that his wife was likely observed by the assailants for a few days before the attack was carried out. Rafizi said his son will need to undergo six months of medical tests to rule out the possibility that he was injected with anything dangerous.
