HC asks MHADA to finalise long pending redevelopment plan
The conflict dates back to 2023 when Kalyan Bhavan, a building situated on Kalbadevi Road in south Mumbai, was declared dilapidated and unsafe to live in. Following this, MHADA issued a notice to the landlord in May 2023, directing him to submit a redevelopment proposal within six months with the consent of 51% of the tenants of the building.
The landlord of Kalyan Bhavan submitted a redevelopment proposal on June 4, 2024, after which MHADA issued a letter of intent (LoI) to him, finalising the redevelopment plan.
Challenging MHADA's decision, the tenants approached the Bombay high court in November 2024, pleading to quash the proposal presented by the landlord, stating that he had missed the deadline. They claimed that an amendment to the MHADA Act made in 2022 gives the tenants the right to redevelop a building in case the landlord fails to take any action within the stipulated timeframe. The high court observed that the tenants' proposal must be taken into consideration, as the landlord had not met the legal timelines.
With no progress in the matter, the tenants approached the Bombay high court again in 2025, urging the court to direct MHADA to finalise their proposal.
The division bench of justices G.S. Kulkarni and Arif Doctor on July 9 directed the MHADA to finalise a redevelopment plan after reviewing the proposals of both parties, within 15 days.
While noting that the MHADA had already started a demolition drive, the court urged the tenants to cooperate with the ongoing demolition and vacate the premises, allowing the MHADA to redevelop the building.

1 2 Cuttack: Orissa high court recently took stock of the ongoing redevelopment of the Cuttack Chandi Temple after a PIL raised concerns over the safety of the idol during re-construction and sought timely completion of the project. The PIL was filed by residents Sukanta Mohanty and Debasis Rout, seeking the court's direction for a time-bound plan for the temple's reconstruction and submission of the detailed project report from the authorities concerned. HC orders tenant to pay double for cheque bounce
Bhopal/Jabalpur: The MP high court has set aside a Bhopal court's acquittal in a bounced cheque case, and ordered the tenant to pay his landlord twice the amount originally due. The court also ruled that a delayed receipt of legal notice can't be held against the complainant. Justice DD Bandal passed the order in a petition filed by Bhopal resident GD Narang, who had rented out a duplex in Shahpura to Ramesh Kothari. Kothari had issued a cheque of Rs 14,400 that bounced. Narang served a legal notice, and filed a complaint under the Negotiable Instruments Act. A court in Bhopal, however, acquitted Kothari, prompting the landlord to move to the high court. The acquittal was based on the ground that he had not served a legal notice on Kothari within 15 days after the cheque bounced. However, he had sent the notice within 15 days by mail, but Koathri received it late. Justice Bandal said the lower court had erred in calculating days in petitioner sending legal notice to the tenant of his house, and ordered Kothari to pay the house owner Rs 25,000. HC: Land pooling policy may hit fertile land & social milieu, notified in haste
1 2 Chandigarh: While staying Punjab's Land Pooling Policy 2025, the Punjab and Haryana high court has held that the land sought to be acquired is among the most fertile in the state, and it is possible that "it may impact the social milieu. " In its order released on Saturday, the HC stated that the Land Acquisition Act, 2013, bars the acquisition of multi-cropped land, and such acquisition is permissible only in exceptional circumstances. The court was also of the view that no timelines have been prescribed, nor has any mechanism been provided to address the grievances of the affected persons. "We are prima facie also of the view that the policy appears to have been notified in haste and all concerns, including social impact assessment, environmental impact assessment, timelines, and redressal grievance mechanism, should have been addressed at the very outset in the policy, before its notification," the HC observed while staying the policy until Sep 10. A division bench comprising Justice Anupinder Singh Grewal and Justice Deepak Manchanda passed these orders while hearing a petition filed by Gurdeep Singh, 72, a resident of Ludhiana district. He sought directions to quash the notification dated June 4, 2025, along with the Land Pooling Policy 2025, being ultra vires and an act of colourable legislation, violating fundamental rights. The judge also observed that payment of subsistence allowance has been provided to the landowners, but there is no provision for the rehabilitation of those landless labourers, artisans, and others who are dependent on the land. "It has also been submitted before this Court that the state's statutory bodies shall themselves develop the land, but no budgetary provisions appear to have been made, nor has anything been put forth before this Court to indicate that the state has adequate resources to finance the development project under the policy," the HC observed. In its nine-page order, the bench also mentioned that the court has come across several instances wherein the owners surrendered their land to the state development authority under the earlier land pooling policy, but the developed plots have not been allotted even after 10 years.
