Don't boycott courts for flimsy reasons, HC tells advocates

A division bench of justice S M Subramaniam and justice A D Maria Clete observed that lawyers are bound to protect the interest of the litigants and the majesty of the courts. Therefore, boycotting the courts frequently for flimsy reasons or based on certain individual grievances of any lawyer cannot be appreciated under any circumstance.
The court was hearing the petition filed by R Jim seeking a direction to the Bar Council of Tamil Nadu and Puducherry to initiate disciplinary action against the erring office bearers of the Tirunelveli Bar Association.
The petitioner also alleged that the members of the association are involved in boycotts for flimsy reasons, causing inconvenience to the people who are longing to secure justice in the court of law.
The judges observed that the petitioner could not establish any wrongdoing against the office bearers of the association. In the absence of any specific complaint regarding misconduct or illegality committed by the office bearers, the Bar Council of Tamil Nadu and Puducherry may not be in a position to initiate appropriate action.

The judges took note of the submission of the petitioner, who stated that he is willing to give a specific complaint against the lawyers who are indulged in such illegal activities or misconduct to the Bar Council. In the event of receiving any specific complaint from the petitioner against the office bearers of the association or any practising lawyers, the Bar Council shall initiate all appropriate actions, as contemplated under the Advocates Act, 1961, and the Rules framed thereunder, including the Bar Council of India Rules, the judges directed and disposed of the petition.

Sundargarh, Ganjam among 100 most accident-prone dists in country: Survey
Bhubaneswar: A recent letter from the ministry of road transport and highways (MoRTH) to the state transport department has identified Sundargarh and Ganjam as two of the 100 most accident-prone districts in the country. The ministry, in reference to a survey carried out by a private road safety agency, ranked Sundargarh in 84th place and Ganjam at 90th for road accidents and fatalities. According to the state transport department, Sundargarh reported 902 accidents resulting in 521 deaths and 701 injuries in 2024. Ganjam witnessed 820 accidents, with 392 fatalities and 710 injuries last year. "Following MoRTH's communication, we convened a meeting with Sundargarh and Ganjam district authorities. We are implementing effective measures to enhance road safety and reduce accidents," state transport commissioner Amitabh Thakur told TOI. Odisha Police sources indicated that two-wheeler collisions accounted for the highest fatalities in Sundargarh, with around 120 deaths (23%), while hit-and-run incidents resulted in at least 106 fatalities (20.3%) in the district last year. Last year, Ganjam reported 171 deaths on national highways and 110 on state highways, police sources informed. The district has 328.81 km of national highways and 491.87 km of state highways. Golanthara, Khallikote, Digapahandi and Sadar police station areas recorded the most accidents in Ganjam. The transport department plans to install cameras under the Intelligent Enforcement Management System (IEMS) to curb traffic violations in Sundargarh and Ganjam. "We also intend to establish Road Accident Investigation and Support Enforcement (RAISE) teams, comprising police officers and road safety experts, to conduct crash investigations and study high accident-prone areas. They will propose comprehensive solutions," a transport official said. "We have asked the police to step up enforcement drives against violators of road safety rules. Local communities and NGOs will be engaged in road safety campaigns. Driving licence of drivers causing severe accidents will be suspended," the official added. The govt has mandated forensic analysis of fatal road accidents to ensure a more scientific approach to crash investigations. Submit action plan to verify correctness of property tax assessments: HC
Madurai: Madras high court on Wednesday directed the Madurai district collector to coordinate with the city corporation commissioner to work out an effective modality for surveying properties, and submit an action plan to verify the correctness of property tax assessments of all buildings in Madurai city. As asked by the court on Tuesday, the corporation commissioner filed a report on Wednesday, stating that there are nearly 3,49,741 property tax assessments within the corporation limits. Pursuant to the court's order, a committee/team with 11 officials was constituted under the deputy commissioner (revenue) of the corporation to ascertain whether any irregularity or under-assessment was made. The team would carry out inspections regarding the assessment, and if any irregularities are found, necessary actions would be taken, stated the corporation commissioner. They said an action plan would be helpful for finding out illegalities or under-assessment in the matter of property tax. Hence, the judges directed the district collector to coordinate with the corporation commissioner to work out an effective modality for conducting field inspections, surveying properties, and verifying the correctness of property tax assessments. If necessary, the assistance of deputy tahsildars could be availed to constitute sub-committees in all five zones of the corporation. The judge directed the district collector and corporation commissioner to submit an effective action plan regarding the property tax assessments for the court to ensure that the efforts are taken in a fruitful manner. The judges also made it clear that the special investigation team (SIT) headed by DIG, Madurai range, Abhinav Kumar, should continue investigation into the scam independently. The hearing in the case was adjourned to Aug 26. The court passed the order while hearing a public interest litigation filed by AIADMK councillor T Ravi, of ward 83, stating that a huge scam in the assessment of property tax in the corporation came to light in 2024. He alleged that several corporation officials, in connivance with zonal chairpersons, were involved, resulting in a loss of over Rs200 crore to the corporation. He stated that police had taken action only against low profile people and left out the real culprits who have political influence. During the earlier hearing, the court observed that a scam of this magnitude had to be investigated by an IPS officer, which should be monitored by higher authorities to ensure there are no lapses and no higher-level people are left out from the ambit of prosecution. ED searches properties linked to SAD man, his sugar mill partners
Jalandhar: The Enforcement Directorate (ED) in Jalandhar searched the properties linked to former Markfed chairman and SAD functionary Jarnail Singh Wahid, along with those of his Phagwara sugar mill partners Sukhbir Singh Sandhar and Jaswinder Singh Bains. All of them, along with others, were booked by the vigilance bureau in connection with alleged misappropriation of govt land of the mill in Phagwara, causing financial loss to the state govt. ED is conducting a money-laundering investigation against M/s Wahid Sandhar Sugars Ltd, and related entities and persons. Wahid is the managing director of Wahid-Sandhar Sugar Mills, Phagwara. His wife and son are directors, and his son is also a director in Sugar Mill Plaza Private Limited, Phagwara. As the mill ran into rough weather and payments to the cane-growers were due, its operations were being handled by Rana Sugars. The ED reached the residences and other premises of Wahid and Sandhar in Phagwara, and Bains in the village of Rawalpindi in the morning, with the search continuing till evening. ED officials also searched the sugar mill and examined old records, including a gym owned by Wahid's family. During the VB investigation, it was found that Wahid-Sandhar Sugars misused the Muafi land, which was initially allotted by Maharaja Jagat Jit Singh of the erstwhile Kapurthala princely state in 1933. The said Muafi land was intended to be used for running the sugar mill as per the conditions of allotment, and the mortgage or further sale of the said land was not allowed. Their company acquired the rights to run the sugar mill on the Muafi land in 2000, and the company breached the conditions by mortgaging and selling the said Muafi land.
