Centre seeks info from Raj govt on organ transplants

Time of India06-07-2025
Jaipur: The Centre has asked the Rajasthan govt to provide detailed information on the state's organ transplant infrastructure and practices. This includes data on govt and private hospitals equipped to perform multi-organ transplants such as liver, kidney, heart, lungs, and pancreas.
The state has also been asked to outline efforts to raise public awareness, whether financial aid is provided to donors or recipients, and if families of brain-dead patients are informed about the option of
organ donation
.
On July 5, Punya Salila Srivastava, secretary, Ministry of Health, reminded the state that the required details—first requested on May 6—are still awaited. The Centre has asked Rajasthan to furnish a complete response by July 7, 2025, as the information must be submitted to the Supreme Court before July 18.
The data is linked to a pending case, Indian Society of Organ Transplantation vs Union of India & Others, concerning organ donation and transplantation in India.
The state has also been asked whether it has adopted the Transplantation of Human Organs and Tissues Act, 1994.
In addition, the Centre is seeking statistics on the percentage of transplants from cadaver versus live donors, and data on gender disparity—male vs. female donors and recipients—and steps being taken to address such imbalances. Govt must detail organ allocation process and list hospitals with transplant infrastructure, equipment, and trained personnel. TNN

Gujarat HC extends temporary bail of Asaram till Aug 21; cites his critical health condition Ahmedabad

The Gujarat High Court on Thursday extended till August 21 the temporary bail plea of self-styled godman Asaram, who was sentenced to life imprisonment by a Gandhinagar court in a 2013 rape case. The division bench of Justices Ilesh Vora and PM Raval extended Asaram's temporary bail till August 21 on medical grounds after observing that he was in ICU at a private hospital and his health condition was critical. While granting him temporary bail for the third time, the court noted an order passed by the Supreme Court on July 30 granting him liberty to approach the HC for temporary bail extension mainly on the ground of deterioration of his health. 'The applicant presently is in ICU with Jupiter Hospital at Indore and as per the records, he was diagnosed with very high troponin level and according to the treating doctor, his condition is critical. In such circumstances, pending this application, the temporary bail granted earlier is extended till August 21 on the same terms and conditions,' the HC order stated. The court had earlier granted him an interim extension till July 7, and then extended the relief for another month. While granting him extension then, the court had clarified that no further prayer for extension of temporary bail will be entertained on medical grounds. Asaram had first approached HC when interim bail granted to him by the Supreme Court till March 31 on medical grounds was coming to an end, as the apex court had directed him to do so if he needed any extension. The division bench of HC had then delivered a split verdict, after which a third judge to whom the matter was referred granted him three-month temporary bail. In January 2023, a court in Gandhinagar had sentenced Asaram to life imprisonment in a rape case. He is also serving life sentence in another case of raping a minor girl at his ashram in Rajasthan in 2013. The court convicted Asaram in a case registered in 2013 for raping a woman disciple, who hailed from Surat, on several occasions from 2001 to 2006 when she was living at his ashram at Motera near Ahmedabad. He was convicted under Indian Penal Code sections 376 2 (C) (rape), 377 (unnatural offences), 342 (wrongful detention), 354 (assault or criminal force to woman with intent to outrage her modesty), 357 (assault) and 506 (criminal intimidation).

Soldier's refusal of surgery can't cost him disability pension: Punjab and Haryana high court

Chandigarh: Punjab and Haryana high court has ruled that if Army decides that a soldier's choice to forgo surgery doesn't affect his disability rating, the authorities cannot later use that refusal to deny him a disability pension. A division bench comprising Justice Ashwani Kumar Mishra and Justice Kuldeep Tiwari passed this order while dismissing a petition filed by the central govt, which had challenged a Feb 13, 2023, order of Armed Forces Tribunal (AFT) Chandigarh to grant disability pension to a retired soldier, Havildar Banta Singh. Counsel for central govt challenged the order on the limited ground that the Release Medical Board (RMB) felt that the disability suffered by the soldier could be cured through a surgical procedure, but he had refused to consent to it. Once that be so, AFT is not justified in granting relief, the Centre contended. Opposing the Centre's plea, the former Armyman's counsel informed the court that a circular had been issued on April 16, 2019, by the Director General of Armed Forces Medical Services (DGAFMS), clearly outlining the risk involved in the spinal surgery required. Hence, holding that the ex-Armyman's refusal to undergo such a procedure shouldn't be held against him. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Family Adopted A New 'Dog', But When The Vet Sees It He Calls The Police Undo The counsel also referred to the rules that say, "If the refusal to undergo an operation is reasonable, full disability normally admissible may be granted. Refusal to undergo an operation may be held reasonable when, in the opinion of medical authorities, it is improbable that such an operation would cure the disability or reduce its percentage, or if such an operation may be severe and dangerous to life. Surgeries performed for spinal disorders have the probability to cure the disability. " After hearing the pleas, HC upheld the AFT order. "Once the competent authority of the Army itself has taken the view that refusal to undergo spine surgery would not be a ground to reduce the percentage of disability, we do not find any good ground for the petitioners to assail the order passed by AFT," observed the judges while disposing of the plea.

Vantara offers special rehab centre for elephant Madhuri in Kolhapur, Fadnavis hails move

The specialised facility, to be developed in collaboration with the Jain Math and the Maharashtra government, will adhere to international best practices in elephant care read more Vantara has offered to set up a dedicated elephant rehabilitation facility in Kolhapur for Madhuri, the ageing elephant at the heart of a high-profile custody case that has stirred up religious and cultural emotions in Maharashtra. In a statement, the organisation clarified that it had played no role in initiating Madhuri's relocation and was merely complying with court orders. The proposal to establish a satellite rehab centre in Kolhapur comes amid calls from the Jain community and the Jain Math in Kolhapur to return Madhuri to her traditional home. STORY CONTINUES BELOW THIS AD Maharashtra Deputy Chief Minister Devendra Fadnavis welcomed Vantara's offer, calling it 'a positive step' that honours both legal procedure and public sentiment. Vantara clarifies its role, pledges support for Madhuri's return In its official statement, Vantara said it 'acknowledges the deep religious and cultural significance that Madhuri holds for the Jain Math and the people of Kolhapur.' It noted that her relocation from Kolhapur was carried out solely in compliance with directions from the Supreme Court and the Bombay High Court. 'At no stage did Vantara initiate or recommend the relocation,' the organisation stated, adding that it had no intent to interfere with spiritual traditions. Vantara further said that it would 'extend full support to any application filed by the Jain Math and the Government of Maharashtra before the Hon'ble Court requesting Madhuri's return to Kolhapur.' Subject to judicial approval, the group promised to provide complete veterinary and logistical assistance for her 'safe and dignified return.' A new facility Beyond facilitating Madhuri's return, Vantara proposed the creation of a permanent satellite rehabilitation centre in the Nandani area of Kolhapur. This specialised facility, to be developed in collaboration with the Jain Math and the Maharashtra government, will adhere to international best practices in elephant care. Features of the proposed centre include: A hydrotherapy pond for joint relief A larger water body for swimming Laser therapy and physical rehab facilities A covered night shelter An open habitat for movement without chains A sand pit for natural behaviour stimulation A 24x7 on-site veterinary clinic Rubberised resting platforms and sand mounds to aid recovery from arthritis and foot rot The location of the centre will be finalised after consultation with the Guru of the Jain Math and government authorities. Vantara said it is prepared to begin implementation as soon as land and regulatory clearances are in place. Vantara stressed that the proposal was not aimed at 'credit, recognition, or vested interest,' and it remained fully open to any alternative plans the Jain Math may submit. The organisation also issued a formal apology if its legally mandated involvement caused any hurt or distress: 'Michhami Dukkadam—if any hurt was caused through thought, word, or deed… we seek your forgiveness.'
