
To regularise illegal houses, Goa govt plans bill to bypass comunidade
Panaji: State govt is likely to introduce two different bills in the monsoon session of the Goa legislative assembly, scheduled to be held from July 22, to regularise illegal structures on comunidade land and govt land.
The govt, through the bill, will empower the administrator of the comunidade to decide on the application — bypassing the comunidade — to regularise the illegal structures on the respective comunidade, not exceeding an area of 300sqm.
Initially, govt wanted to issue an ordinance, but as the assembly was being summoned, state govt decided to introduce bills in the monsoon session.
In 2012,

govt tried to consider regularising illegal houses that were built up to the year 2000 on comunidade properties in Goa, but it did not see the light of day as no comunidade gave any no-objection certificates (NOCs) to applicants.
State govt has started discussions, and already three meetings have been held to finalise how illegal houses and encroachments can be legalised on govt and comunidade land.
'We held three meetings. Govt will bring two bills to legalise illegal houses and encroachments on govt and comunidade land. There will be a few more meetings to finalise the bills,' a senior govt official said.
The bills are likely to give powers to the administrator of the comunidade to decide on applications to regularise structures on comunidade land.

In terms of govt land, the bill is likely to give power to collectors to regularise. Collectors will decide on applications and collect the market price amount for the land from the applicant. Once the money is paid, govt will issue a sanad.
'On comunidade land, the deputy collector will issue an order, collect the amount, and issue the sanad. The comunidade will not have any role to play, but the money will be deposited in the respective comunidade once the land has been regularised,' a senior officer said, noting that this is still under discussion.
While some ministers are pushing to finalise as soon as possible, there is opposition from other ministers in the cabinet as it will encourage illegalities in the state. 'The govt wants to have a cut-off date of 2025, which means all the illegalities will be legalised in the state,' the senior official said.
In his budget speech, chief minister
Pramod Sawant
decided to regularise illegal structures up to 1,000sqm in urban areas and 600sqm in rural areas by amending the Goa Regularisation of Unauthorised Construction Act, 2016.
In 2012, BJP govt tried to consider regularising illegal houses that were built up to the year 2000 on comunidade properties in Goa, but it did not see the light of day. Similarly, in 2001, BJP attempted to regularise the illegal houses. The govt even issued a notification in 2001, but the effort was in vain because govt did not take comunidades into confidence.
In 2001, govt said that the comunidade had to give a NOC to legalise illegal structures on comunidade land, but not a single comunidade gave an NOC to encroachers.

Even as the new caste census is waiting to take-off, the BJP, as expected, has not stopped its trenchant criticism in this regard. They not only accuse the government of having been dishonest with the earlier report but allege that the new caste survey announcement is to divert attention from the monumental stampede tragedy which rocked the state and the cricket-loving country in the first week of June. The official reason is still that the new socio-economic and educational survey would be more inclusive as the earlier one was found deficient in certain aspects. This opinion too has not gone uncontested as some OBC castes seem to be content with the findings of the earlier survey and have agreed to its implementation. With the High Command in Delhi setting a deadline of less than three months to complete the re-enumeration exercise as of present, the Karnataka government may take it up expeditiously. Moreover, with the bragging rights still with the GOP for initiating this contentious exercise and coming up with a report, however contentious, it would want to hold on to its head start in this regard. Meanwhile, opposition to the findings of the earlier report was not just from various caste groups in the State, but also from ministers, representing different castes, who feared that the ground would slip from beneath their feet if they allowed implementation of the survey report. Interestingly, Yathindra, Congress MLC and son of the incumbent Chief Minister, said something similar that highlights the collective backing for the earlier survey report among the non-Vokkaliga, Lingayat formations. He even explained in detail how the backward classes, including the minorities, accounted for 75 per cent of the population, while decrying the fact they were not adequately represented in society. In the 1990s, the BJP had used 'Kamandal', a reference to the Hindu sentiment to blunt the rise of Mandal Commission fallout to come to power in various states, before optimally exploiting it to seize control at the Centre in 2014. No new tariffs after Bilateral Trade Agreement: India wants US assurance
India wants an assurance from the US that no additional tariffs will be imposed by the Donald Trump administration once the bilateral trade agreement (BTA) is finalised, said people familiar with the matter. The deal is in the final stages of negotiation and both sides are hopeful of reaching accord quickly. India has sought concessions for labour-intensive sectors such as leather and textiles. 'We have put everything on the table,' said one of the persons, adding that India wants stability in tariffs once a deal is rolled out. Trade agreements typically include renegotiation clauses, or compensation from the partner effecting a tariff increase. India would like the pact to provide for such a mechanism. 'This would ensure the agreement is ring-fenced from prospective changes,' said another person. The US President on April 2 announced a reciprocal tariff of 26% on goods imports from India as part of its trade levies all over the world. These tariffs were paused for 90 days until July 9. However, the baseline tariff of 10% remains in force. 'We are working on the early tranche, and there is a date (July 9), before which we would like to conclude this. The progress is good,' commerce secretary Sunil Barthwal said on Monday. A US trade team is in India last week to firm up the contours. India has made it clear that any meaningful expansion in bilateral trade will require a significant reduction in US tariffs. Both sides aim to more than double such trade to $500 billion by 2030. However, a Delhi-based trade expert cautioned, 'India should rethink its proposed BTA with the US. The US has a history of incomplete trade deals, such as the Trans-Pacific Partnership and the Transatlantic Trade and Investment Partnership. It has retracted its WTO commitments also. Moreover, the future of the Indo-Pacific Economic Framework for Prosperity hangs in the balance with the US-China trade deal.'
