Coatbridge woman wins claim against LG after fire

Denise Parks secured an award of almost £150,000 but more than £140,000 will go to insurers who dealt with the damage.
Denise and her husband Robert were in bed at the house in Forge Drive, Coatbridge, in North Lanarkshire, when a fire broke out in the living room about 3 am October 31 in 2018.
A laptop and two mobile phones, a Samsung Galaxy S7 and LG K8, were left charging on a couch before the couple retired for the night.
The LG phone was severely damaged in the subsequent fire with more limited damage to the other phone and the computer.
Mrs Parks was treated for smoke inhalation after the fire and her history of panic attacks and anxiety worsened following the incident at her home.
As a result of the fire she was off work between November 2 in 2018 and February 7 the following year.
She raised an action against LG Electronics UK Ltd at the personal injury court at Edinburgh Sheriff Court seeking damages, with liability being contested.
A sheriff has now ruled on the balance of probabilities that the LG phone, supplied to Mrs Parks by her employer North Lanarkshire Council, was the source of ignition for the fire.
Sheriff Robert Fife found that there was a defect in the LG phone and that Mrs Parks established liability against the makers. He also found that she has proved she sustained injury because of the fire.

The sheriff ruled that Mrs Parks, a home support carer with the local authority, was entitled to damages in the sum of pounds 149,496.
Sheriff Fife said in a judgement: "At the time the fire started, the LG was in normal use, being charged by a suitable charger, and in circumstances in which a standard product would not have failed."
"The court was entitled to draw an inference that the LG was defective. The LG did not meet the standard of safety that persons generally are entitled to expect," he said.

Cops are now carrying out an investigation to establish the full circumstances behind the incident. A spokesperson for Police Scotland said: "Around 10.45pm on Tuesday, 12 August, 2025, we received a report of a disturbance at a premises on Clerk Street, Edinburgh. 'Emergency services attended and one man was taken to the Royal Infirmary of Edinburgh for treatment. Enquiries are ongoing.' It comes as a man was arrested and charged following the sexual assault of a woman just along the road on Sunday night. On Sunday August 10 at around 11.15pm, officers raced to Nicolson Street after being made aware of the incident. ‌ The male was also charged in connection with the assault of a man, along with resisting arrest and an assault on two police officers. Adams was previously caught when police raided his home and uncovered a sick stash of 18,000 child abuse images and videos. The material, featuring boys as young as four, was found on his home computer alongside a written proclamation stating he and other paedophiles should be recognised as a"minority group" whose legal and human rights should be respected. Adams, 54, stated he was not ashamed of being a paedophile and asked: "Why should I respect a law which doesn't respect me?" Adams, of St Catherine's Square, Perth, has now admitted breaching his notification requirements by failing to give police vital basic details for his annual review in April. Solicitor Linda Clark, defending, said: "Unfortunately his mother died in April 2025. He had been living with her in Blairgowrie. "Inevitably, council sympathy did not extend to him and he was told the tenancy would be removed from him. He was effectively going to be homeless. "That triggered numerous issues for him and he's now in temporary accommodation. He simply forgot about attending." Edinburgh Sheriff Court had previously heard police uncovered a stash of sick videos and images featuring boys as young as four when they raided Adams' home in Dalkeith. Officers also found his manifesto, which stated: "I believe I was born a paedophile. There's nothing anyone can do about it. "I'm not proud of this but I'm not ashamed either. I am more ashamed of the bigoted and close-minded way that society and the law treats people from my community." Adams also wrote society should recognise paedophiles as "another minority group" and respect their human rights.

More info An East Lothian woman assaulted and forced a young child to take cold showers during a seven-year campaign of abuse. Stacey Peters, 31, also allowed the child to live in filthy conditions when the youngster stayed over at her former home in Musselburgh. Edinburgh Sheriff Court was told the furniture and window sills in Peters' house were covered in cat excrement and the rooms were strewn with rubbish. The court heard the property was 'not fit for a child to live in' and at one point was so dirty police were forced to seal the house off until improvements were made. Prosecutor Xander van der Scheer told the court investigations began after the child disclosed to a teacher at their primary school that the woman 'hits her and [they] hit her back' when she stayed at the property. The youngster showed the teacher scratches on their arm and the school's head teacher was informed and child protection procedures were put in place in November 2023. The child was subsequently interviewed by social services where they said Peters would 'put [them] in a cold shower when [they] misbehaved' and she would also strike them on the bottom. The child told the social worker they had to put packets of frozen vegetables on their behind to soothe the injuries. Police attended at Peters' home and found the flat to be 'full of rubbish and cat litter everywhere'. Mr van der Scheer said officers found cat excrement on the furniture and window sills and a decision was made to seal the property off for cleaning after they deemed it 'not fit for a child to live in'. The court heard on one occasion the child was found in tears while locked out and sitting on the doorstep of the property while Peters was inside. The court was told the child does not visit or stay over at the woman's home anymore and is said to be 'scared' of her. Peters, who has since moved to Whitecraig, East Lothian, pleaded guilty to wilfully neglecting the child in a manner likely to cause them unnecessary suffering or injury to health when she appeared at the capital court last month. Court papers also state Peters forced the child to live in an environment detrimental to their health, on one occasion locked them out of the property, forced them to have cold showers and struck and scratched them, all between February 2016 and November 2023. She returned to the dock for sentencing where lawyer David Allan, defending, admitted his client is facing 'a serious charge' and that 'the custody threshold has been met in this case'. But Mr Allan said the social work report was positive and added: 'Ms Peters takes full responsibility for her behaviour and does not seek to minimise it in any way.' Sheriff Fergus Thomson said: 'I have listened very carefully as to what has been said on your behalf and this is a sad situation altogether. 'These are serious offences but there is an alternative to custody here.' Peters was placed on a community payback order where she will be supervised for the next 12 months and will have to carry out 90 hours of unpaid work in the community as punishment.
