Internet can't be regulated like TV. Look at how UK, Australia are doing it

At the heart of the debate is a long-standing demand to transpose TV-style regulation to digital, owing to a perceived uneven playing field. At the recently concluded World Audio-Visual and Entertainment Summit, the chairperson of the Telecom Regulatory Authority of India also said there is a regulatory imbalance between traditional TV and digital services.
Digital creators and social media companies are increasingly scrutinised, shadow-banned, or dragged to court for their content. Courts have evolved principles to guide the interpretation of reasonable restrictions on speech on the grounds of decency and morality. In 2014, the apex court held in Aveek Sarkar that a naked photograph of Boris Becker with his fiancée in a magazine was not obscene because it would not incite lustful thoughts in the average person in contemporary society. Yet, in 2025, we find that every other movie or social media post hurts morality and decency.
Late last month, a Supreme Court bench led by incoming Chief Justice BR Gavai asked the Union government to 'consider appropriate legislation' to curb obscene content on digital streaming platforms and social media. The petition before the Court felt familiar: Web series are polluting our morals, and social media is degrading our public square.
Yet the central government did not simply extend TV-style content strictures to digital when it framed rules for streaming apps in 2021, because the two media operate under fundamentally different conditions.
In India, TV viewing is typically a household activity, whereas individuals consume social media and streaming content privately on their phones. Everyone receives the same pre-packaged broadcast content from TV, while digital users select material from personalised feeds. Consequently, standards for obscenity and decency on TV are stricter, as they must account for a wide, unsupervised audience. Digital services, by contrast, offer tools such as age gating and parental controls that minimise the risk of unintended exposure to inappropriate content.
Most countries recognise these inherent differences in public versus private consumption and the technological controls that mediate audiences' exposure, and therefore adopt separate regulatory standards.

Drawing the right line
State enforcement should reflect varying degrees of harm that stem from speech, just as content standards vary according to intended purpose and form factor. Legal scholar Evelyn Douek advocates a shift from absolutism and blanket prohibitions to calibrated, proportionate obligations that match the gravity of the risk posed by such content. Global best practice shows how.
The United Kingdom's Online Safety Act, now in force, obliges services to assess and mitigate 'priority illegal content' — terrorism, child-sexual-abuse imagery, violent threats — and provides the media regulator, Ofcom, with the power to impose fines of up to £18 million and, as a last resort, to block non-compliant sites.
Australia's Online Safety Act empowers the eSafety Commissioner to issue removal notices for child-abuse, non-consensual nudity, or extremist material, and also to levy hefty penalties. Canada's proposed Bill C-63 would create a Digital Safety Commission with a regulatory remit extending to sexual exploitation of children, non-consensual intimate images, self-harm content, hate, and extremism.
None of these regimes treats generic 'offence' as an equal evil; they target speech that demonstrably harms democratic life. India, too, places higher obligations on social-media services to proactively monitor and take down child-sexual-abuse imagery and terrorist content.

Institutional resilience
Instead of spending precious and limited state capacity on policing obscene content, India should invest in media literacy and public-service broadcasting to build a mature society that is resilient to the effects of harmful speech. And this is exactly what other democracies are doing.
The European Union emphasises the importance of media literacy for navigating the digital media environment and spotting disinformation. The Audiovisual Media Services Directive (AVMSD) mandates Member States to promote media literacy and to report on their efforts every three years. Canada's Digital Citizen Initiative (DCI) funds projects aimed at improving civic, news, and digital media literacy. India's National Education Policy likewise encourages critical thinking and problem-solving, alongside social, ethical, and emotional capacities—but who will bell the cat?
Globally, hybrid oversight models are taking root. The Global Internet Forum to Counter Terrorism coordinates industry databases of extremist content, supervised by public-interest boards. India's Information Technology Act already allows for voluntary codes backed by statutory orders. The primary regulatory goal should therefore be to ensure that the loudest microphones cannot freely amplify the most harmful forms of speech: hate speech, child sexual-abuse material, terror content, and so on. Civil-society organisations must also be more involved in flagging such material.
Obscenity may offend but hate speech can kill. Enforcing existing legal provisions with the seriousness they deserve, and ensuring a more inclusive, proportionate governance process, would do far more to preserve the Republic's moral core than yet another crusade against lewd punchlines.

Union Civil Aviation Minister K Ram Mohan Naidu on Saturday stated that the data from the black box of the Air India plane that crashed and killed more than 270 persons on Thursday was being analysed. In the first press conference after the crash, Naidu stated that the Union government will look into all possible theories of what could have caused the disaster. He added that an extended surveillance of all Boeing 787 flights operational in India would be conducted. On Thursday, the Boeing 787-8 Dreamliner aircraft, which was en route to London's Gatwick airport from Ahmedabad, crashed just 33 seconds after taking off. This is being viewed as the world's worst aviation disaster in a decade. There were 242 people aboard the aircraft. One passenger survived with ' impact injuries '. A total of 274 bodies had been sent for postmortem, according to The Times of India. This included 33 persons who were killed on the ground when the aircraft crashed into the hostel building of the BJ Medical College in Meghani Nagar area of Ahmedabad. Here is more on this and other top updates: In the aftermath of the crash, eight of the Boeing 787 aircraft have so far been inspected following the directive issued Friday by the aviation safety regulator Directorate General of Civil Aviation, said Naidu during the press conference. Later in the day, Air India announced that it had completed one-time safety checks on nine out of 33 of its Boeing 787 aircraft. It added that the checks were still underway for the remaining 24 aircraft and warned that this could 'lead to higher turnaround time and potential delays on certain long-haul routes, especially those to airports with operating curfews'. The Tata Group has announced that the families of the 33 persons who died on the ground will also receive a monetary compensation of Rs 1 crore. Beside the medical expenses for the injured will be fully covered, The Indian Express reported. An unidentified official told the newspaper that 'nothing has been decided' about providing jobs to the next of kin. The DNA samples of 11 of the persons who died in the crash have matched, Dr Rajnesh Patel, the head of surgery at Ahmedabad Civil Hospital, told The Hindu. One body has been handed over to the family. On Friday, a police officer had said that six bodies were handed over to the family after identification. Congress president Mallikarjun Kharge visited the site of the crash on Saturday and also met those were injured and are being treated at hospitals. 'My deepest condolences and thoughts are with the families of the victims, crew, pilot and people on the ground who have lost their lives, including medical students,' Kharge said on social media.

Campuses In Navi Mumbai: In a major step towards making Mumbai a global education hub, the University Grants Commission (UGC), in the presence of Union Education Minister Dharmendra Pradhan and Maharashtra Chief Minister Devendra Fadnavis, handed over Letters of Intent (LoIs) to five globally acclaimed universities to set up campuses in Maharashtra. These include the University of Aberdeen, University of York, University of Western Australia, Illinois Institute of Technology, and Istituto Europeo di Design (IED). Held at the Taj Mahal Palace in Mumbai, the event marked the beginning of the Maharashtra government's flagship 'EduCity' initiative, which will be located in Navi Mumbai as part of the planned 'Third Mumbai' — a project close to Chief Minister Fadnavis. 'No Dream Will Be Killed Anymore': Fadnavis Welcoming the institutions, Chief Minister Fadnavis said, 'We've heard for 20 years that esteemed global universities would come to India — today, we witnessed it happen. Thanks to Prime Minister Modi and the Union Minister of Education for leading this revolution. These five universities are coming to Maharashtra and opening the door to global students. It will give more accessibility and affordability to deserving students who otherwise couldn't go abroad. Now an ecosystem is being created so that no dream is killed.' Fadnavis also acknowledged UGC, CIDCO, and the Urban Development Department for enabling the project. 'This is just the beginning. We will not stop at five universities — we will create one of the biggest ecosystems of foreign universities in India, right here in Mumbai.' Dharmendra Pradhan: 'India is Being Positioned as a Global Knowledge Destination' Union Education Minister Dharmendra Pradhan highlighted how reforms under the National Education Policy (NEP) 2020 enabled foreign universities to operate in India. The UGC's policy was amended last year to facilitate this, and a similar model is already functional in Gujarat's GIFT City. He added that nine foreign universities have received LoIs so far, with six more in the pipeline. All classes are expected to begin by the next academic year, focusing on priority areas like STEM and business education. The government, he said, will not provide financial support but will act as a facilitator, ensuring global academic standards at lower costs for Indian students. Voices From the Universities Siladitya Bhattacharya, professor at the University of Aberdeen, the first Scottish university to branch out in India, called it a "significant milestone" and said many more institutions are keen to follow. Lindy Cameron, British High Commissioner to India, called it a proud moment for the UK-India relationship, especially in education. Charlie Jeffrey, Vice Chancellor of the University of York, said the institution would maintain its research-intensive model in India, with a focus on AI, healthcare, and agriculture, embedded in local industries. He also drew a cultural connection, recalling how Sachin Tendulkar was the first overseas player signed by Yorkshire in 1992. Guy Littlefair, Deputy Vice Chancellor of the University of Western Australia, highlighted the tie-up between Gondwana University in Gadchiroli and Curtin University in WA, pointing out shared expertise in mining — a key area for Maharashtra. Illinois Institute of Technology became the first US university to set up a campus in India. President Raj Echambadi, a Tamil Nadu-born American, said he was proud to bring the institution to the 'land of Nalanda.' He credited the NEP for enabling such global collaborations.
