IGP gets leave to cite Papagomo for contempt

KUALA LUMPUR: The High Court was told that an apology by blogger Wan Muhammad Azri Wan Deris to Inspector-General of Police (IGP) Tan Sri Razarudin Husain was insincere and a joke.
Lawyer Raam Kumar, representing Razarudin, said Wan Muhammad Azri, or Papagomo, had published a video containing a statement that was supposed to be an unconditional apology on April 30 with the song "Maafkan Kami" from P. Ramlee's Pendekar Bujang Lapok in the background.
"The apology was a joke. It must be remembered that this is a court matter where the defendant must show intent.
"He should be apologising unconditionally and then keep to himself, but instead, he made a clarification on the apology," Raam Kumar said on Friday (May 9).

Judicial Commissioner Gan Techiong then granted leave to Razarudin to initiate committal proceedings against Wan Muhammad Azri after hearing the submission in the ex-parte application.
The court also fixed June 30 for an inter-parte hearing for parties involved.
This is the second time Razarudin filed the leave application claiming that Wan Muhammad Azri had failed to obey several matters outlined in the committal order dated April 30.
In the ex-parte application, Razarudin said Wan Muhammad Azri had published a video online via his social media platforms TikTok ("Papa Azri") and YouTube ("Sir Azri") on May 1 where the defendant made several statements.
He said the defendant's statements in the video were contrary to the written apology that was agreed upon and read before the High Court on April 30.

"The apology made by the defendant on April 30 was insincere and without remorse, despite being made unconditionally," Razarudin said.
The breach in the April 30 committal order, Razarudin said, constituted "a second act of contempt" against the High Court.
"The defendant's contempt of the committal order renders him liable to committal proceedings for contempt of court," he added.
A check on the court's e-filing system showed that the leave application would be heard before JC Gan on Friday.
On April 30, Wan Muhammad Azri issued an unreserved apology to the IGP over defamatory and demeaning remarks made earlier this year.

The apology pertains to two media postings published in January, despite a court order issued on Dec 31 prohibiting him from making such statements.
JC Gan, in delivering the court's decision, said the apology, which was read aloud in court, must also be published on YouTube, TikTok, X, and Telegram for at least seven days.
He also ordered the blogger to pay RM5,000 in costs.
During the proceedings on April 30, the court was originally scheduled to hear contempt of court proceedings initiated by Razarudin against the blogger, but both parties were advised to seek a resolution, which led to Wan Muhammad Azri's apology and subsequent purging of the contempt.
On Dec 26, Razarudin filed a RM3mil defamation suit against Wan Muhammad Azri, which also named Prime Minister Datuk Seri Anwar Ibrahim as a related party.

In a joint statement today, DAP chairman Gobind Singh Deo and secretary-general Loke Siew Fook ​also urged Dusuki to review the decision by the Attorney-General's Chambers to classify the investigation into Teoh's 2009 death as requiring no further action, or NFA. 'He must explain why he is unable to do so in this case, particularly in light of the decisions of the Court of Appeal and civil proceedings in the High Court.' Gobind and Loke said DAP has been consistent in its call for action to be taken against those responsible for Teoh's death. ​​The statement follows a letter dated May 30 from Dusuki to the family's legal representative, Ramkarpal Singh, seeking to explain the AGC's rationale for classifying the case as NFA. Teoh died on July 16, 2009 at the fifth floor of Plaza Masalam in Shah Alam after being questioned for hours by the Selangor Malaysian Anti-Corruption Commission headquarters. Last month, police informed Teoh's family that their latest investigation into the case had been classified by the AGC as NFA. On Nov 21 last year, the High Court directed the police to complete their long-delayed investigation into Teoh's death. At an inquest, the coroner returned an open verdict. However, the Court of Appeal ruled in 2014 that the death was caused by 'one or more persons unknown', including MACC officers. In 2019, police launched an investigation under Section 342 of the Penal Code for wrongful confinement. Before 2018, two special investigation teams had been set up – one in 2011 and the other in 2015 – to look into the incident, but both cases were classified as NFA by the public prosecutor. Gobind and Loke noted that DAP assisted Teoh's family in a civil suit which resulted in the government and the MACC admitting liability for negligence leading to Teoh's death. An award of RM600,000 was made to the family, with costs of RM60,000. They said both the findings of the Court of Appeal and the civil court provided a basis for the police to conduct further investigations into the search for the perpetrators behind Teoh's death. 'While the duty to investigate the case and to identify those responsible in this case is with the police, it is for the attorney-general to decide his next step based on the police's investigations,' they said. Noting that Teoh's family is considering challenging the NFA in court by way of judicial review, Gobind and Loke said they support the action. PETALING JAYA: Malaysia's top police official has confirmed that graphic designer and political activist Fahmi Reza faces no formal travel restrictions, following confusion at the airport that prevented his departure to Singapore. Inspector-General of Police Tan Sri Razarudin Husain acknowledged that a procedural error occurred during immigration screening on the previous day, resulting in the activist being wrongly blocked from traveling. The incident unfolded when Fahmi attempted to catch a Singapore-bound flight from KLIA Terminal 2 to attend a punk music event. According to his Facebook post, airport immigration staff informed him that federal police headquarters had not authorised his international travel. Addressing the confusion in an official statement, Razarudin explained that while Fahmi's name appears on an internal monitoring database due to an active police inquiry, this does not constitute a travel prohibition. 'Our department has not implemented any formal travel restrictions against this individual,' the police chief stated. 'His inclusion on our monitoring system serves as an internal reference tool and represents standard law enforcement protocol.' The IGP emphasised that Fahmi remains free to travel internationally, provided he complies with immigration regulations and relevant legislation.
