IGP gets nod for committal proceedings against Papagomo again
KUALA LUMPUR: The High Court has once again permitted the Inspector-General of Police Tan Sri Razarudin Husain to initiate committal proceedings against controversial blogger Wan Muhammad Azri Wan Deris, also known as Papagomo. Judicial Commissioner Gan Techiong made the ruling after hearing submissions from lawyer Raam Kumar, who appeared for the top cop today. This is the third contempt of court application filed by Razarudin against Wan Muhammad Azri over a video published on May 1, a day after the latter issued a public apology to both the court and Razarudin on April 30. The video, published on social media, featured court statements accompanied by background music from P. Ramlee's classic film 'Pendekar Bujang Lapok', which Razarudin described as satirical and insincere. According to Razarudin, the video demonstrated that Papagomo "felt no remorse" for breaching the injunction and had only issued the apology to create a "false impression" before the court. He further contended that the video falsely implied that Papagomo had successfully deceived the court into accepting his apology and that Razarudin had acted maliciously by seeking to have him imprisoned at Sungai Buloh Prison. "The statements made by the defendant in the video contradict the written and oral apology read in court on April 30 in compliance with the committal order," Razarudin stated. He argued that Papagomo's conduct constituted contempt of court and warranted committal proceedings. The apology stemmed from a RM3 million defamation suit filed by Razarudin over allegedly defamatory remarks, which also involved Prime Minister Datuk Seri Anwar Ibrahim. Razarudin first filed for committal on Jan 24, seeking for Wan Muhammad Azri to be jailed or fined for contempt of court after allegedly violating an injunction granted on Jan 10 by publishing statements about Razarudin on YouTube, TikTok, X, and Telegram. On Jan 31, the High Court granted an injunction prohibiting Wan Muhammad Azri from making defamatory statements against Razarudin on any social media platform pending the outcome of the main defamation suit. On 9 May, the High Court again granted leave to commence committal proceedings after finding there was a prima facie case. In that second instance, Razarudin sought committal on the grounds that Wan Muhammad Azri had failed to unconditionally publish his apology on YouTube, TikTok, and X, and also failed to remove a Jan 14 post and an edited image of the IGP. Razarudin filed the RM3 million defamation suit on Dec 26, last year, over remarks by Wan Muhammad Azri allegedly labelling him a "prostitute of honourable inmates" and a "bootlicker" of Anwar.

IGP allowed to commence second committal proceeding against Papagomo
KUALA LUMPUR: The High Court here today allowed an application by Inspector-General of Police (IGP) Tan Sri Razarudin Husain to commence a second committal proceeding against blogger Wan Muhammad Azri Wan Deris for violating the terms of his apology previously ordered by the court. The application is related to a RM3 million lawsuit filed by Razarudin against Wan Muhammad Azri, also known as Papagomo, over alleged defamation, which also involved Prime Minister Datuk Seri Anwar Ibrahim. Judicial Commissioner Gan Techiong decided the matter after hearing the submissions by lawyers Raam Kumar and Muhammad Rafique Rashid Ali, representing Razarudin and Wan Muhammad Azri, respectively. 'The inter-parte (both parties) hearing for the committal order is set for June 30, at 10 am, and the presence of the defendant (Wan Muhammad Azri) is mandatory,' said the judge. The court also ordered Wan Muhammad Azri to file the affidavit-in-reply on or before May 23, while Razarudin was given until June 6 to do so. They are also ordered to submit the written submissions on or before June 20. Raam Kumar, in his submission, said that argued that Wan Muhammad Azri should have remained silent after the apology was made in court on April 30. 'On May 1, the defendant deliberately published a video via TikTok (Papa Azri) and YouTube (Sir Azri), and the statement contradicted the written apology that had been agreed to in the previous committal order. 'The apology was not sincere and was not published through the same social media account as ordered by the court. The apology on social media, accompanied by the background music of 'Maafkan Kami' from a clip from the film 'Pendekar Bujang Lapok' directed by the late Tan Sri P. Ramlee, was a joke,' said the lawyer. Meanwhile, Muhammad Rafique said his client had no intention of defying the court's order and that the apology had already been posted on the defendant's social media accounts and reported by the media. Last Monday (May 5), Razarudin filed a notice of an ex-parte application seeking a committal order for Muhammad Rafique to be arrested and brought to court and imprisoned for contempt of court. Razarudin filed the application on the grounds that Wan Muhammad Azri failed to comply with the conditions to delete the publication of videos dated Jan 14 and 15, related to defamation suit filed against him, in addition to not posting the apology that was read out in court last April 30 on his social media platforms YouTube, TikTok, X and Telegram. On Feb 10 this year, the court granted Razarudin permission to commence committal proceedings against Wan Muhammad Azri for allegedly failing to comply with the injunction order on January 10 by posting about Razarudin on the YouTube, TikTok, X and Telegram applications. However, on April 30, Wan Muhammad Azri issued an unreserved apology to Razarudin for violating the injunction order. The injunction prohibits Wan Muhammad Azri or his agents from publishing or disseminating defamatory content in any form concerning Razarudin, whether in his official capacity as IGP or as an individual. This includes written, verbal, videos, online or instant messaging platforms such as WhatsApp and Telegram The court also ordered Wan Muhammad Azri to retract and delete videos posted on Dec 14,15, 20 and 22 last year on his YouTube, TikTok, Facebook, Telegram and X accounts, which were deemed defamatory.

IGP gets leave to cite Papagomo for contempt
KUALA LUMPUR: The High Court was told that an apology by blogger Wan Muhammad Azri Wan Deris to Inspector-General of Police (IGP) Tan Sri Razarudin Husain was insincere and a joke. Lawyer Raam Kumar, representing Razarudin, said Wan Muhammad Azri, or Papagomo, had published a video containing a statement that was supposed to be an unconditional apology on April 30 with the song "Maafkan Kami" from P. Ramlee's Pendekar Bujang Lapok in the background. "The apology was a joke. It must be remembered that this is a court matter where the defendant must show intent. "He should be apologising unconditionally and then keep to himself, but instead, he made a clarification on the apology," Raam Kumar said on Friday (May 9). ALSO READ: IGP files another leave application against Papagomo for committal proceedings Judicial Commissioner Gan Techiong then granted leave to Razarudin to initiate committal proceedings against Wan Muhammad Azri after hearing the submission in the ex-parte application. The court also fixed June 30 for an inter-parte hearing for parties involved. This is the second time Razarudin filed the leave application claiming that Wan Muhammad Azri had failed to obey several matters outlined in the committal order dated April 30. In the ex-parte application, Razarudin said Wan Muhammad Azri had published a video online via his social media platforms TikTok ("Papa Azri") and YouTube ("Sir Azri") on May 1 where the defendant made several statements. He said the defendant's statements in the video were contrary to the written apology that was agreed upon and read before the High Court on April 30. ALSO READ: Papagomo apologises to IGP over defamatory remarks "The apology made by the defendant on April 30 was insincere and without remorse, despite being made unconditionally," Razarudin said. The breach in the April 30 committal order, Razarudin said, constituted "a second act of contempt" against the High Court. "The defendant's contempt of the committal order renders him liable to committal proceedings for contempt of court," he added. A check on the court's e-filing system showed that the leave application would be heard before JC Gan on Friday. On April 30, Wan Muhammad Azri issued an unreserved apology to the IGP over defamatory and demeaning remarks made earlier this year. ALSO READ: IGP gets injunction preventing Papagomo from issuing further defamatory statements The apology pertains to two media postings published in January, despite a court order issued on Dec 31 prohibiting him from making such statements. JC Gan, in delivering the court's decision, said the apology, which was read aloud in court, must also be published on YouTube, TikTok, X, and Telegram for at least seven days. He also ordered the blogger to pay RM5,000 in costs. During the proceedings on April 30, the court was originally scheduled to hear contempt of court proceedings initiated by Razarudin against the blogger, but both parties were advised to seek a resolution, which led to Wan Muhammad Azri's apology and subsequent purging of the contempt. On Dec 26, Razarudin filed a RM3mil defamation suit against Wan Muhammad Azri, which also named Prime Minister Datuk Seri Anwar Ibrahim as a related party.

IGP granted leave to initiate committal proceedings against Papagomo again
KUALA LUMPUR: The High Court today granted Inspector-General of Police Tan Sri Razarudin Husain leave to initiate committal proceedings for a second time against blogger Wan Muhammad Azri Wan Deris over his allegedly "insincere" apology. Judicial Commissioner Gan Techiong granted the leave after hearing submissions on Razarudin's application to initiate committal proceedings against Wan Azr i, also known as Papagomo, for breaching the terms of the apology previously ordered by the High Court. Earlier, the court was told that Wan Azri's apology to Razarudin was described as insincere and a joke. Razarudin's lawyer, Raam Kumar, said Azri had uploaded the apology to his social media accounts on 30 April, using Maafkan Kami, a song by the late Tan Sri from the classic film Pendekar Bujang Lapok, as background music. "The apology is a joke. Why do we say this? This is a court order. There must be solemnity. You must be serious. "The apology was not re-read, not in still (image) and not done in good faith. "There is no solemnity at all. This is a court matter, not some joke where you play music. "The unconditional apology is not sincere and he had not purged his contempt," Raam said. Raam also said Wan Azri had also committed contempt of court by uploading videos on his YouTube and TikTok accounts explaining his apology in court. "The apology is unconditional, which means the defendant (Wan Azri) cannot make excuses for his apology. "He is supposed to apologise with no conditions attached and he should just keep quiet. Rather than that, he published the videos. "He had said he did not apologise to the IGP, but to the court. He is not acknowledging at all that he has an issue with the IGP, but he is fighting with the court. "In other words, he is not acknowledging at all his contemptuous action against the plaintiff (Razarudin). "He had also said he apologised because he did not want to be jailed. But nowhere in our affidavit or submission we askedfor him to be jailed in Sungai Buloh Prison. "It is mere insertion as we asked only for committal. The issue of the plaintiff wanting to send him to prison did not arise. This is a made up story," he said. Lawyer Muhammad Rafique Rashid Ali said they had sent a letter to Raam's firm, stating that they published the apologies on YouTube, TikTok, X and Telegram; and had removed the Jan 14 and 15 defamatory statements. "The court should take judicial notice that not only was the apology tendered in open court, not only was the apology put up in social media and remaining now, it has been vastly reported by the mainstream media, which confirmed Wan Azri apologised to the IGP," he said. Gan had also questioned Azri's action, saying that the matter should have been over when the first committal proceedings ended. "Why did he not let the matter rest? Why did he publish that video, which is quite negative?" he said. After hearing the submissions, Gan said, "I am of the mind to grant leave for this application." The court set 30 June for the inter partes hearing.
