
Eshwar Khandre recommends suspension of IFS officer
Bengaluru: A case has been filed in the Supreme Court seeking permission to denotify HMT forest land worth over Rs 14,000 crore, and action has been recommended against a retired IAS, IFS and two sitting IFS officers, Forest, Ecology and Environment Minister Eshwar B Khandre said.
Speaking to reporters who met him in Bengaluru on Friday, he said that the land in the possession of HMT has not been converted to non-forest purposes. 'Therefore, according to several judgments given by the Supreme Court and the Forest Conservation Act, 1980, it remains a forest even today. However, this land is alienated, real estate companies have built hundreds of flats. Shooting of serials and films is going on. The land is being used for commercial purposes. How this was allowed is questionable', he said.
Responding to a journalist's question about why no action has been taken even after seven months of giving notice to officials in the case of IA for denotification of HMT forest land without the permission of the cabinet, the minister said that the forest land in the possession of HMT is the property of 7 crore Kannadigas, which a few officials did not even bring to the attention of the then Forest Minister and applied for denotification without seeking the prior permission of the cabinet. He said that notices have been issued to four officials, including two retired and two serving ones, and that he has recommended action to the Chief Minister.
Additional Chief Principal Conservator of Forests R Gokul has written a letter to the CBI seeking protection, saying that he is being victimised because he got the ruling party MLAs punished in the Belikeri case. Responding to a journalist's question whether the government is victimising officials, Khandre said that this is a completely false allegation made against the government.
'On September 24, 2024, I sent a written note to the Additional Chief Secretary, asking for a show cause notice to the officers who had issued IA without the prior approval of the Cabinet and asked them to take action' the Minister said.
'A month after the notice was given, the verdict was delivered in October 2024. R. Gokul wrote a letter to the CBI to cover up his mistake, making false allegations against the government, which could also be considered misconduct by the officer or a threat tactic', he said. He personally visited the HMT forest land area, where there is still 280 acres of plantation. However, the IA was submitted by giving false information to the Supreme Court that the said land has lost its forest status.
The officer writing the letter to the CBI in his defence questioned why he did not write a letter to the Chief Minister saying that there is forest on the HMT land. It cannot be submitted as an IA because it has lost its forest status. A high-level committee headed by the Chief Secretary was formed in 2015 to discuss and recommend to the government the forest land held by other institutions in Bengaluru. Without even bringing it to the attention of that committee, a petition was filed in the Supreme Court on June 20, 2020, seeking permission for denotification without the permission of the Cabinet.
In just 25 days, i.e. on 15 July 2020, a high-level meeting was held to decide the issue 'I have asked the Additional Chief Secretary, Forest, Environment and Ecology Department to submit a proposal for denotification of such forest areas after seeking the opinion of the Advocate General regarding the sanction of areas to various/government institutions before 1980 for a decision.'
However, he said that ex-post facto permission was not obtained for this. Hence, notices were issued to four officers. He said that he has now submitted a file to the Chief Minister to suspend Gokul and conduct an inquiry, conduct a departmental inquiry against another officer and take action against a retired IAS officer and an IFS officer as per the rules. As soon as this matter came to his notice, an application was filed in the Supreme Court to withdraw the IA. The Cabinet's permission has also been obtained to withdraw the IA, said Eshwar Khandre.
The government's intention is to build another huge park in North Bengaluru on the forest land in the possession of HMT. 'Our goal is to save breathing space for the next generation' Eshwar Khandre said and added that he had made this point clear even before filing an application in the Supreme Court to withdraw the IA.

Delhi HC rejects plea by Lalu Prasad Yadav to stay trial proceedings in land-for-jobs scam case
The Delhi High Court has dismissed a petition filed by Rashtriya Janata Dal leader and former Bihar Chief Minister Lalu Prasad Yadav seeking to stay proceedings in a trial court in connection with a money-laundering case linked to the alleged land-for-jobs scam. Yadav had filed a petition in the High Court seeking to quash the first information report filed against him by the Central Bureau of Investigation in 2022. In addition, he had also sought a stay on the proceedings in the matter in the trial court while the petition was pending. In an order issued on May 29, Justice Ravinder Dudeja said that he found no compelling reasons to stay the proceedings in the trial court. 'The present matter is stated to be listed before the learned special judge for arguments on charge,' the order said. 'Notwithstanding, the pendency of the present petition, petitioner would be at liberty to urge all his contentions before the learned trial court at the stage of consideration of charge.' Dudeja said that the trial proceedings would be 'an added opportunity' for Yadav to 'put forth his point and get the same adjudicated'. In an earlier submission, advocate Kapil Sibal, representing Yadav, had told the High Court that the CBI did not to obtain mandatory prosecution sanction under Section 17A of the Prevention of Corruption Act against Yadav before registering the FIR. This section stipulates that no investigation can be conducted by a police officer into an offence alleged to have been committed by a public servant under the Act without prior approval from an appropriate authority. Sibal also said that the offences that Yadav were accused of were allegedly committed between 2004 and 2009. However, the FIR was lodged only in 2022 after a delay of almost 14 years, he pointed out. Sibal also said that the matter was listed before the Rouse Avenue Courts on the framing of charges on June 2. He added that if the charges were framed, then the present petition would lose its purpose. Senior Public Prosecutor DP Singh, on the other hand, told the High Court that the question on the applicability of Section 17A was under consideration before a larger bench of the Supreme Court. Yadav could also make similar submissions before the trial court at the stage of the framing of charges, Singh added. The CBI has named 78 accused persons in the case, including 30 government officials. The case centres on allegations that between 2004 and 2009, when Yadav was the Union railway minister, land was illegally acquired at reduced prices in exchange for appointments to Group-D positions in the Indian Railways. The agency alleges that land parcels were transferred to Yadav's family members, including wife Rabri Devi and daughters Misa Bharti and Hema Yadav, at prices significantly below the market value.

Kerala: PV Anvar to contest Nilambur bypolls as TMC candidate
Malappuram (Kerala) [India], June 1 (ANI): All India Trinamool Congress (AITC) has fielded their Kerala state coordinator, PV Anvar, as their candidate for the upcoming Nilambur bypolls, set to be held on June 19. Anvar had raised corruption allegations against Chief Minister Pinarayi Vijayan's officials and claimed that he would not be contesting the bypolls, supporting the Congress candidate instead. The byelections were necessitated after Anvar submitted his resignation on January 13 to Assembly Speaker AN Shamseer, days after holding talks with TMC leaders, including Abhishek Banerjee and TMC supremo Mamata Banerjee. Talking about their candidate, a post by TMC read, 'Under the inspiration and guidance of Hon'ble Chairperson Smt. Mamata Banerjee, we are pleased to announce the All India Trinamool Congress candidate for the impending Kerala Legislative Bye-election scheduled for 19th June, 2025.' A few months ago, Anvar had accused CM Vijayan's political secretary P Sasi, and ADGP M R Ajith Kumar, claiming they were involved in phone tapping of ministers and journalists and also accused the ADGP and IPS officer Sujith Das of misappropriated seized gold. Anvar had claimed that there was RSS influence in the home department and Muslim youths were being framed in false cases. Following the accusations, Anvar, then an independent MLA but aligned with the ruling Left Democratic Front (LDF) in the state, vowed to work for ending the Pinarayi Vijayan-led government. 'I will not contest the Nilambur by-election. I will give full support to the Congress candidate to end the Pinarayi government. The Congress should field a candidate from Nilambur. Malappuram DCC president Joy is the suitable candidate,' Anvar had told mediapersons on January 13. The byelection has political significance as it is a precursor to next year's state assembly election and will test the popularity of the current government led by CM Vijayan. Anvar has also raised the issue of human-animal conflict in the state, and also apologised to Congress MLA VD Satheesan for raising corruption allegations against him, saying that CM Vijayan's political secretary had asked him to raise those allegations. 'CM's political secretary asked me to raise corruption allegation against opposition leader VD Satheesan in the assembly. He has prepared the matter to present in the assembly. The allegation that VD Satheesan received Rs 150 crore was raised in the assembly with the permission of the Speaker. I don't know whether there was a conspiracy. I apologise to opposition leader V D Satheesan and the public for this,' he told reporters. Anvar has been the Nilambur MLA since 2016, backed by the LDF in both the 2016 and 2021 assembly elections. Notably, LDF has announced M Swaraj as their candidate, meanwhile Bharatiya Janata Party is fielding Mohan George and the United Democratic Front (UDF) announced Aryadan Shoukath. (ANI)
