Stringent law needed to curb menace of wheeling on public roads: Karnataka High Court

Taking note of the alarming rise in incidents of wheeling, a motorcycle stunt, on public roads, the High Court of Karnataka has said that it is the duty of the State and its law enforcement agencies to legislate necessary legal provisions and to take stringent measures to suppress this perilous activity by plugging the loophole in the law.
A plain reading of the provisions of the Motor Vehicles Act, 1988, and the Indian Penal Code, 1860, it is found that the existing statutory provisions are not adequate for enforcement agencies to effectively curb the menace of 'wheeling', the court said while pointing out that perhaps, at the time of enacting these laws, the legislators did not foresee or specifically contemplate that a two-wheeler would be driven on the hind wheel alone, and hence no express penal provision was envisaged to advert the said mischief.
Justice V. Srishananda made these observations while refusing to grant bail to Arbaz Khan, 29, a resident of Gangavati in Koppal district, who was arrested on the charge of manhandling the police who tried to stop him and his accomplices while they were indulging in wheeling on a public road.
No specific provisions
'At present, such acts are booked within the ambit of the general offences of reckless or negligent driving. However, it is to be noted that the absence of a specific and necessary provision has resulted in a legislative vacuum, affecting the efficacy of law enforcement agencies in curbing the menace of wheeling, as the offence of reckless driving is bailable in nature,' the court observed.
The court said, 'It [wheeling] is a trending menace in the public road which not only endangers the rider and pillion rider of the motorcycle, but also general public at large'.
Not acts of bravado
It is also pertinent to note that act of wheeling, initially confined to urban areas on sufficiently wide and arterial roads, has extended its tentacles even to rural areas, the court said, while pointing out that the 'younger generation riders of the motorcycle are under the misconception that the act of wheeling is bravado and indulge in such perilous stunts being unaware of the grave risks involved in the said act'.

The apex court was hearing Elvish's plea challenging the chargesheet and the criminal proceedings against him in the case. What Is The Snake Venom Case Involving Elvish Yadav? Elvish Yadav has been making headlines in connection to the Noida Snake Venom case for a long time now. The YouTuber was arrested by Noida Police in March 2024. The case was lodged under provisions of the Wildlife Protection Act, 1972 and for criminal conspiracy under section 120B of the Indian Penal Code, they said. A day after his arrest, NDTV claimed Elvish had admitted to his crimes. However, no official statement was released. A week later, Yadav was granted bail, on a 50,000 bail bond. Talking about the same, his lawyer Prashant Rathi had said, 'Our arguments in this case was that he was falsely accused and no substance was obtained from him or his friends that violated the NDPS act. The court has granted bail to him (Elvish Yadav) as well as his two friends on two sureties of Rs 50,000 each." The convict was found guilty under Sections 363 (kidnapping) and 366 (kidnapping with intent to compel marriage) of the Indian Penal Code (IPC) and Section 6 (aggravated penetrative sexual assault) of the Protection of Children from Sexual Offences (Pocso) Act. Along with the sentence, the court imposed a fine of ₹50,000 on the convict. Special public prosecutor Sunil Kumar Parmar said the time already spent by the accused in judicial custody will be deducted from the overall sentence, as per court orders. 'The incident occurred on May 6, 2021, when the victim, a Class IX student from a private school in Bilaspur, was found missing by her parents as she failed to leave for school,' Parmar said. After failing to locate her, her father lodged a missing person's complaint with the police. During the investigation, police learned that a man from the same neighbourhood had abducted the girl. However, tracking the duo proved difficult, as the girl did not have a mobile phone, and the accused refrained from using one to avoid detection, officers added. The victim was eventually rescued on July 4, 2021, from Hoshiarpur in Punjab, where she had been held captive. 'Based on her statement, the accused was arrested within hours from Panchgaon Chowk in Manesar,' Parmar said. Parmar added that the minor's medical examination confirmed she was raped multiple times. 'She testified against the accused in court and revealed he had lured her on the pretext of marriage. Other witnesses also supported the prosecution's case,' he said.

Thane: The Motor Accident Claims Tribunal (MACT), Thane, awarded a compensation of Rs 87.13 lakh to the family of a 55-year-old school teacher who succumbed to injuries sustained in a road accident in 2015. The accident occurred on July 31, 2015, near Sunita Apartment in Ulhasnagar-3, when the teacher was riding his motorcycle. According to case records, a tempo driver suddenly opened the vehicle door, causing the motorcyclist to crash into it. The victim suffered a severe head injury and remained in a coma for nearly a year before passing away on July 31, 2016. The tribunal relied on various pieces of evidence, including the FIR, spot panchanama, medical records, and crucial CCTV footage, which was presented in court by the investigating officer. Although the registration numbers and identity were not clearly visible in the footage, the tribunal accepted corroborative statements, including that of the tempo owner, who confirmed the vehicle and driver involved. The tribunal rejected objections raised by the insurer, which challenged the admissibility of the CCTV footage and raised concerns about an alleged policy breach. Member of MACT, Mohite, ruled that strict evidentiary rules under BNS do not apply to claims under the Motor Vehicles Act, and there was no evidence of footage tampering. The court also dismissed the claim of a licensing issue, confirming there was no breach of the insurance policy. The deceased was a permanent teacher at a Ulhasnagar municipal school, earning Rs 63,594 per month. The court considered his income, age, and number of dependents to compute compensation. The tribunal directed the tempo owner and insurer to jointly and severally pay the total amount with 9% annual interest from the date of petition filing until full payment. The compensation will be distributed among the widow and two adult children of the deceased, with part of the amount to be invested in fixed deposits in nationalised banks.
