Stringent law needed to curb menace of wheeling on public roads: Karnataka High Court
Taking note of the alarming rise in incidents of wheeling, a motorcycle stunt, on public roads, the High Court of Karnataka has said that it is the duty of the State and its law enforcement agencies to legislate necessary legal provisions and to take stringent measures to suppress this perilous activity by plugging the loophole in the law.
A plain reading of the provisions of the Motor Vehicles Act, 1988, and the Indian Penal Code, 1860, it is found that the existing statutory provisions are not adequate for enforcement agencies to effectively curb the menace of 'wheeling', the court said while pointing out that perhaps, at the time of enacting these laws, the legislators did not foresee or specifically contemplate that a two-wheeler would be driven on the hind wheel alone, and hence no express penal provision was envisaged to advert the said mischief.
Justice V. Srishananda made these observations while refusing to grant bail to Arbaz Khan, 29, a resident of Gangavati in Koppal district, who was arrested on the charge of manhandling the police who tried to stop him and his accomplices while they were indulging in wheeling on a public road.
No specific provisions
'At present, such acts are booked within the ambit of the general offences of reckless or negligent driving. However, it is to be noted that the absence of a specific and necessary provision has resulted in a legislative vacuum, affecting the efficacy of law enforcement agencies in curbing the menace of wheeling, as the offence of reckless driving is bailable in nature,' the court observed.
The court said, 'It [wheeling] is a trending menace in the public road which not only endangers the rider and pillion rider of the motorcycle, but also general public at large'.
Not acts of bravado
It is also pertinent to note that act of wheeling, initially confined to urban areas on sufficiently wide and arterial roads, has extended its tentacles even to rural areas, the court said, while pointing out that the 'younger generation riders of the motorcycle are under the misconception that the act of wheeling is bravado and indulge in such perilous stunts being unaware of the grave risks involved in the said act'.

Gurgaon: In three years, 102 claims have been filed by families or victims of hit-and-run accidents, of which compensation has been disbursed for only two of them. Two cases are in the final stages of processing, and the remaining – 98 – are still being investigated by police. This slow pace of resolution has left families of accident victims in the lurch, with some waiting for years after they applied for aid under the 2022 Hit-and-Run Motor Accident Compensation scheme. The scheme, which falls under Section 161 of the Motor Vehicles Act , came into effect from April 1, 2022. It offers Rs 2 lakh as compensation in cases of fatalities, and Rs 50,000 for serious injuries. The scheme is only applicable for hit-and-run accidents, in which police have not been able to identify the errant driver or vehicle. Sunita, a city resident whose husband died in a hit-and-run accident on the Delhi-Gurgaon Expressway this year, told TOI she has been waiting for compensation for months. "The regional transport authority (RTA) secretary has been directed to expedite the data collection process, ensuring that claims are processed swiftly and efficiently. The goal is to provide timely financial assistance to victims, alleviating some of the burdens they face in the wake of these tragic incidents," the DC had said, directing all involved agencies to expedite the process. According to the norms, a hit-and-run accident victim or a victim's family can apply for compensation under the scheme before the sub-divisional magistrate. They have to submit a death certificate, post-mortem report, or hospital treatment documents as proof. Accidents aren't uncommon on city roads, particularly the Delhi-Gurgaon Expressway, or NH-8. Last year, Gurgaon recorded 1,026 road accidents that led to 428 fatalities. Around 44% of the accidents were on national highways in the city, and the largest chunk of fatalities involved two-wheelers, traffic police data showed. In accident cases in which the errant driver/vehicle has been identified, victims and their families can approach the Motor Accident Claim Tribunal (MACT) and file a case to seek compensation. The tribunal, after hearing both sides, determines the amount of compensation that may be paid to accident victims or their families. In many cases, the company that insured the errant driver's vehicle is asked to provide compensation.

Over 17k challans pending against Hyd police vehicles; fine amount Rs 1.3cr
1 2 Hyderabad: At a time when citizens are turning traffic vigilantes, law keepers are found breaching regulations. As per a RTI filed by city-based traffic educator Lokendra Singh, a fleet of vehicles registered under the Director General of Police Telangana have accumulated 17,391 challans — some pending since 2017. Incidentally, though the total challan amount stands at around Rs 68 lakh, the department might have to cough up a penalty of Rs 1.36 crore. This, as Section 210B of the MV Act, 2019, states that if an authority empowered to enforce the Motor Vehicles Act commits an offence, they are liable to a penalty twice the amount corresponding to that offence. These challans, issued to police vehicles with registration series TS 09 PA XXXX and TS 09 PC XXXX, are in use by senior police officials including some of additional SP, additional DCP rank. Most of the violations are related to over-speeding. When TOI checked for details on the portal, it found that a majority of these police vehicles (Innova) had 10 to 15 challans each. Surprisingly, some vehicles had unpaid challans pending since 2018. For instance, one police vehicle TS 09 PA XX88 had 11 challans starting from Oct 2018 to April 2023. The total outstanding amount: Rs 11,385 "The majority of traffic fines against police vehicles are automatically generated by speed detection cameras that monitor vehicles exceeding speed limits. We will forward these fines to the respective officers and ask them to provide evidence justifying their speed violations," said Rahul Hegde BK, deputy commissioner of police (traffic), Hyderabad commissionerate and public information officer, traffic branch. He added: "The fines will be withdrawn if we find that the vehicles were responding to emergency situations, conducting patrol duties, or were involved in VIP escorts." Lokendra Singh, a volunteer with Hyderabad City Security Council said such traffic violations set a bad example for the public. "When they see police personnel flouting regulations, it diminishes their trust in the system and leads them to question the necessity of following rules. I have also noticed that many police vehicle drivers often do not use seat belts while driving," said Singh. BOX: City police issues Over 50 lakh challans Hyderabad city police issued as many as 56.3 lakh challans in 2024, with most violations involving riding without helmets and driving on the wrong side. The authorities collected Rs 46.6 lakh against these challans — 82% of the total amount.

49-Year-Old Man Dies After Cement Mixer Detaches from Tractor, Hits Moped
Nagpur: A 49-year-old man lost his life in a freak road accident on Tuesday morning after a cement mixer reportedly detached from a speeding tractor and collided with his two-wheeler at Vaishno Devi Chowk, near Deshpande Layout. According to the police, a tractor being driven recklessly by Santosh Mangal Shahu (29), a resident of Garib Nawaz Nagar, was moving in the same area when the iron bar of the attached cement mixer reportedly broke loose. As per the initial police complaint, the detached cement mixer barrel violently struck Verma's moped, causing him to fall and suffer serious injuries. He was immediately rushed to Government Medical College and Hospital (GMCH) for emergency treatment, but the doctors declared him brought dead. The complaint was lodged by Verma's son-in-law, Swapnil Khobragade (35). Based on his statement, Nandanvan police registered a case against the tractor driver under Sections 281 ( ), 106(1) of the BNS and Section 184 of the Motor Vehicles Act, which pertains to dangerous driving, endangering life or public safety. Nandanvan police confirmed the case and stated that further investigation is underway to determine whether the tractor was structurally unsound or if the cement mixer was improperly secured. The tractor and the mixer have been seized for inspection.
