Stay vigilant to safeguard Constitution: PM on Emergency

Prime Minister Narendra Modi
on Sunday recalled the 'dark chapter of Emergency' imposed 50 years ago and urged citizens to remain vigilant to safeguard the Constitution.
In his monthly
Mann Ki Baat
radio address, the PM quoted three prominent politicians from different ideologies, including two former prime ministers, to showcase how people from all walks had joined hands against imposition of Emergency in 1975.
Modi played archival audio recordings of speeches by former prime ministers Morarji Desai and Atal Bihari Vajpayee, and former home minister Jagjivan Ram, recounting the atrocities faced by people during the Emergency period.
The PM quoted Desai as saying, 'The oppression that happened for two years... reached its peak when Emergency was imposed on people and people were treated inhumanely.'
Modi added, 'This is the voice of the former PM of the country, Morarji Bhai Desai, who spoke about the Emergency in a brief but very clear manner.'
'You can imagine what that period was like. Those who imposed Emergency not only murdered our Constitution but also had the intention to keep the judiciary as their slave,' he said.
The PM noted that over one lakh people were jailed, and politicians like George Fernandes were chained, with many enduring 'severe torture' under the Maintenance of Internal Security Act (MISA).
He mentioned Jagjivan Ram, who called the post-Emergency election 'a great campaign to strengthen the foundation of democracy', and Vajpayee, who described it as 'a peaceful revolution' that 'threw the killers of democracy into the dustbin of history'.

Separately, the Justice Department issued a sweeping directive to US attorneys to prioritise denaturalisation proceedings against naturalised citizens accused of crimes or national security threats. 'The Department of Justice may institute civil proceedings to revoke a person's United States citizenship if an individual either 'illegally procured' naturalization or procured naturalization by 'concealment of a material fact or by willful misrepresentation,'' wrote Assistant Attorney General Brett Shumate in a June 11 memo. Shumate instructed prosecutors to focus on individuals linked to terrorism, espionage, and serious human rights abuses: 'The benefits of civil denaturalization include the government's ability to revoke the citizenship of individuals who engaged in the commission of war crimes, extrajudicial killings, or other serious human rights abuses,' he stated. He added that such cases would also 'prevent convicted terrorists from returning to U.S. soil or traveling internationally on a U.S. passport.' The memo detailed several priority categories for civil denaturalization, including: Individuals convicted of human trafficking, sex offenses, or violent crimes. Those who committed financial fraud against the government, such as PPP loan fraud and Medicare scams. Members or associates of gangs, drug cartels, or transnational criminal organizations. Individuals engaged in fraud against private individuals or corporations. Shumate emphasised that attorneys should take an aggressive approach: 'The Civil Division should prioritise and maximally pursue denaturalisation proceedings in all cases permitted by law and supported by the evidence,' he wrote.

State names special courts in Panaji, Margao to deal with land grab cases

Panaji: State govt on Tuesday designated two courts, one in each district, as special courts to ensure proper prosecution and speedy trials in land grab cases. The special investigation team (SIT) probing these cases registered over 44 FIRs and arrested 56 persons. The notification issued by Amir Parab, undersecretary, law, said that govt designed the courts of district judge-1 and additional sessions judge, Panaji and Margao, as special courts to deal with land grabbing cases, both existing and future registrations, until new legislation is enacted. He said the notification was issued on the recommendation by justice V K Jadhav, who heads the commission of inquiry, and with the concurrence of the high court. TOI has earlier reported that the high court granted approval to state govt's proposal to designate two special courts to ensure proper prosecution and speedy trials in land grab cases. The chief justice had directed the designation of these two courts to deal with land grab cases. On Sep 9, 2022, govt appointed a commission to study complaints/FIRs regarding illegal land transfers/land grabbing with the use of forged documents. Govt sought recommendations to tackle the menace and submitted the same. The SIT is currently investigating these cases, with some already being chargesheeted and others nearing disposal.
