The Supreme Court on Monday dismissed a plea challenging an order confirming the five-year extension of the ban imposed on the Students Islamic Movement of India (SIMI).A bench of Justices Vikram Nath and Sandeep Mehta refused to hear the plea against the July 24, 2024 order of the Unlawful Activities (Prevention) Act (UAPA) tribunal.The tribunal was constituted under the UAPA after the Centre on January 29, 2024 decided to extend the ban on SIMI for five years.advertisement
It was set up to adjudicate whether there was sufficient cause for declaring SIMI an outlawed organisation.SIMI was first declared outlawed in 2001 during the Atal Bihari Vajpayee government and, since then, the ban has been extended periodically.SIMI was established on April 25, 1977 in Aligarh Muslim University as a front organisation of youth and students, having faith in Jamait-e-Islami-Hind (JEIH). However, the organisation declared itself independent in 1993 through a resolution.On Monday, the counsel appearing for the petitioner said the tribunal confirmed the Centre's order of January 29, 2024 extending the ban on SIMI for the ninth time.He said since September 2001, the ban was continuing and there were other pending matters in the top court challenging the ban on SIMI.The counsel requested the bench to issue notice on the plea and tag it with the pending matters. When he said the petitioner was a former member of SIMI, the bench said, "Then why are you here? Let the organisation come." After the counsel said the organisation did not exist, the bench asked, "How does it affect you then?"The counsel said there were legal issues that remained in the matter. He said the government did not recognise the fact that SIMI was defunct now. The bench, however, refused to entertain the plea.The tribunal confirmed the five-year extension of the ban imposed on SIMI, saying the outfit had not abandoned its objective of "Jehaad" for the cause of Islam and continued to work for the establishment of Islamic rule in India.While extending the ban on SIMI, the government said the group was involved in fomenting terrorism and disturbing peace and communal harmony in the country.- EndsTune InMust Watch

: The Allahabad high court has directed the state government to file a better counter-affidavit (reply) with regard to compliance with the Supreme Court's guidelines/directions laid down in Tehseen S. Poonawalla v. Union of India (2018) on preventing and addressing incidents of mob lynching and mob violence. (File Photo) A division bench comprising Justice Siddharth and Justice Avnish Saxena sought the affidavit while dealing with a petition filed by the brother of a 37-year-old man killed on suspicion of slaughtering cattle in Uttar Pradesh's Moradabad district last year. The present petition seeks a probe into the alleged incident by a special investigating team (SIT) and ₹50 lakh as compensation for the family of the deceased. The counsel for the petitioner argued that the state had not implemented the mandatory safeguards outlined in the Tehseen Poonawalla ruling, which were mentioned as remedial measures, including the top court's directions regarding prompt FIR registration, nodal officer oversight, timely charge sheet filing and compensation. The high court, in its order, recorded that only the investigating officer had filed a counter-affidavit in the matter, and the U.P. government had not shown any steps taken in line with the binding directions of the apex court. 'Thus, the division bench remarked that the U.P. government should file a better counter affidavit/compliance affidavit keeping in view the directions of the apex court in the case of Tehseen S. Poonawalla within a period of three weeks,' the bench observed. Noting that the FIR should have been lodged by the police under Section 103(2) of the BNS (mob lynching) but was instead registered under Section 103(1) (Murder), the court stayed the investigation in the FIR until the next date of hearing. The court, in its order dated July 10, directed that the matter will now be heard next on August 5. In the present writ petition, the petitioner alleged that the state government has failed to formulate a Lynching/Mob Violence Compensation Scheme in compliance with the provisions of Section 357A of the criminal procedure code (CrPC), despite the explicit and binding direction in the Tehseen Poonawalla case, which constitutes 'grave' and 'wilful' violation of the rule of law. The petition also requested the court to direct the U.P. government to take disciplinary action against the police officials involved in the matter, as per the Supreme Court's directions to ensure accountability. It also requested the court to direct the government of India to launch public awareness campaigns against mob violence and lynching, highlighting legal consequences, as directed by the Supreme Court. At around 3 am on December 30 last year, Shahedeen and a few others were allegedly caught by a mob for slaughtering a cow for meat. While the others managed to flee, Shahedeen was left behind and was brutally beaten by the mob for nearly an hour. He succumbed to the injuries the next day. Later, Moradabad police booked Shahedeen and his alleged accomplices under the Uttar Pradesh Prevention of Cow Slaughter Act.

Vijayawada: CPM Politburo Member BV Raghavulu alleged that the Election Commission (EC) is acting in favour of the BJP by initiating a covert citizenship identification process in the name of voter registration in Bihar. He stated that even while the matter is under consideration by the Supreme Court, the EC has written to other states recommending the implementation of similar processes which are implemented in Bihar. The CPM national leader has demanded for an immediate halt to such actions. Addressing the media at the Balotsavam Bhavan here on Monday, Raghavulu questioned how the EC could announce thatits Special Investigation Report (SIR) in Bihar identified people from Nepal, Bangladesh, and a citizenship identification initiative under the guise of voter registration is inappropriate, said the CPM leader. The Supreme Court had advised using Aadhaar, ration cards, and previous voter rolls to identify voters but the EC is disregarding these guidelines. He warned that by pushing for a Bihar-style SIR in all states even before the Supreme Court's next hearing on July 28, the EC is compromising its neutrality and aligning itself with BJP interests. Other official institutions exist for citizenship matters, and the EC's interference in this domain is unconstitutional, said Raghavulu. Such haste, without reviewing Bihar's experience or awaiting a court ruling, could destroy public trust in constitutional systems, said the CPM leader. The CPM state secretary V Srinivasa Rao stated that farmers in Karidedu are resisting land acquisition for the IndoSol project, cutting across party lines. He alleged that a TDP MLA is trying to divide this resistance and warned the government that forcibly acquiring land without public consent will face backlash. He criticised the government for acquiring land in agency areas for pumped storage power projects without consulting local Gram Sabhas. Over 1.6 lakh acres have already been acquired in the name of development. Many of these remain unused—such as 6,000 acres in Krishnapatnam, 2,500 acres in Prakasam for NIMZ, and 20,000 acres in Donakonda. In Kakinada SEZ, 10,000 acres lie vacant. He questioned whether the real intent is development or mere land grabbing.

10 old thermal plants to be converted into nuclear power units by 2047

The government has identified 10 old or retired thermal power sites for repurposing them into nuclear power units. The move is part of the Centre's ambitious aim to reach 100 GW nuclear power capacity by 2047 from about 8.8 GW currently. Shortlisting of the 10 sites across various states is "preliminary" and a final decision will be taken after inspections by a site selection committee, which has members of Nuclear Power Corporation of India , said people close to the development. One of the sites, Wanakbori thermal power plant in Gujarat, has already been visited by a team, one of the persons said. The site contains seven units of 210 MW each. "The list is raw and a first step in the process. The selection of nuclear plants is much more stringent than thermal, so the process will take time," the person said. The site selection process will hinge on the plants' seismicity, water availability, and nearby habitation, the person added. A government official explained that the key benefits of converting old thermal power plants for nuclear energy generation is the existing availability of land, water, and transmission lines. However, factors such as marking exclusion zones of at least 1 km radius around a nuclear plant, with prohibitions for public habitation, will need to be considered before taking a final decision, the official said. The power ministry is evaluating various modes of nuclear power generation, including installing small modular reactors , in the converted thermal units, based on the size and resource availability, the official added. The government's target for 100 GW of nuclear energy capacity is likely to entail deploying various technologies as part of Viksit Bharat 2047 vision . India is aiming to first reach 22 GW nuclear power capacity by 2032.
