In its detailed order rejecting a discharge plea by Walmik Karad, the main accused in the murder of a sarpanch in Maharashtra's Beed district, a special court has said that there is prima facie evidence to show that he is a member of an organised crime syndicate. The plea was rejected on July 22, and the full order was made available this week.
Karad – a close aide of former NCP minister Dhananjay Munde – and others have been booked under the stringent Maharashtra Control of Organised Crime Act (MCOCA) for the murder of Santosh Deshmukh on December 9, 2024.
'Validity of prior permission or sanction shall not be doubted at this juncture. Thus the statements of witnesses, material, technical, digital, scientific and forensic evidence prima facie reveal that the offence is committed by the applicant and co-accused persons,' the detailed order by special judge V H Patwadkar said.
The prosecution said that between October and December 2024, the accused, including Karad, conspired and demanded ransom from a company to run their business in the district. When Massajog sarpanch Deshmukh intervened, a plan was made to abduct and murder him. Deshmukh was subsequently killed. The prosecution has claimed that the co-accused videographed the act and also made a video call to Karad.
The prosecution cited 20 previous crimes filed against Karad, including that of unlawful assembly and attempt to murder, and said he was also convicted in one case. It added that the other accused were following the instructions of Karad, who is a member of the crime syndicate.
Karad had filed the discharge plea stating he was falsely implicated for political reasons, and there was no crime syndicate as claimed by the police. He also questioned the validity of the sanction under the MCOCA given in February, claiming that due procedure was not followed while invoking the Act.
He said no role was specified when it came to his involvement in the crime. Karad said the police deliberately hid the fact that among the cases cited, he was cleared in almost 15 of them, including the case in which he was convicted, and that the Bombay High Court had acquitted him in the appeal stage.
Special Public Prosecutor Ujjwal Nikam submitted that the sanction for MCOCA was taken as per procedure and if it is dropped, the crime syndicate will continue its work, resulting in a grave law and order problem.

Meghalaya Chief Minister Conrad Sangma has written to his Chhattisgarh counterpart, Vishnu Deo Sai, raising concern over the arrest of two nuns from Kerala by the Chhattisgarh Police. The National People's Party president, whose coalition government in Christian-majority Meghalaya also includes the BJP, wrote that the NPP believes this to be a 'case of harassment and false allegations'. The letter asked the BJP-led Chhattisgarh government to consider revoking the case lodged against the nuns. The two nuns, Preeti Marry and Vandana Francis, and another person, Sukhman Mandavi, were arrested last Friday at Durg railway station in Chhattisgarh. The FIR, registered under sections of the Chhattisgarh Religious Freedom Act and the Immoral Traffic (Prevention) Act, was based on a complaint by a local Bajrang Dal worker. The complaint alleged that they converted three women from Narayanpur and were attempting to traffic them. One of the three women had earlier told The Indian Express that she was threatened and assaulted by a woman associated with a right-wing outfit and forced to change her statement. In his letter, Sangma wrote that the nuns were arrested 'under allegedly false charges and pressure from right-wing groups'. 'The situation arose when the nuns were accompanying three girls from Chhattisgarh to Agra. A Travelling Ticket Examiner (TTE) questioned the girls, who said they didn't have tickets and were travelling at the nuns' request. The TTE alerted local activists, who then alleged the nuns were attempting to take the girls for forced religious conversion. This claim sparked a protest, and the police detained the nuns and girls based on the activists' complaint,' Sangma wrote. He requested CM Vishnu Deo Sai to ensure a fair investigation in the case, safeguard the rights of religious minorities in Chhattisgarh and consider revoking the case lodged against the nuns. 'A case has been lodged against the nuns under serious sections. We believe that this is a case of harassment and false allegations. Hence, we urge you to intervene and ensure justice. The Catholic Bishops' Conference of India (CBCI) has also requested the Hon'ble Prime Minister Shri Narendra Modi ji and Hon'ble Home Minister Amit Shah ji to intervene in this matter,' he wrote.

The Centre on Friday informed the Delhi High Court that it was withdrawing its decision granting nod to the release of the film 'Udaipur Files - Kanhaiya Lal Tailor Murder', which is scheduled to hit the theatres on August 8. A bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela, which was hearing two pleas challenging the Centre's decision allowing the release of the movie, directed the parties to the revision plea to appear before the government on August 4 and make their submissions.
