
'No doubt' Canadian firm will be first to extract deep sea minerals: CEO
Metal-containing deep-sea nodules, which have the appearance of potato-size pebbles and typically contain nickel and cobalt, are highly sought for use in electric vehicle batteries and electric cables, and the race is on to be the first to extract them from the untapped deep sea.
TMC's chief executive Gerard Barron told AFP in an interview in New York that his company was sure to win the race.
The company turned its back on the International Seabed Authority (ISA), which has jurisdiction over the international seabed, complaining over its slow pace in adopting a mining code that establishes the rules for exploiting seabed minerals.
Instead, TMC surprised everyone when its US subsidiary submitted a request to Washington, which is not an ISA member, to grant it the first commercial mining permit in international waters.
TMC has asked to harvest so-called polymetallic nodules -- deposits made up of multiple metals -- in 9,700 square miles (25,200 square kilometers) of the Pacific's Clarion-Clipperton Zone.
Here is what Barron said about what might lie ahead.
Q: When is your target to start mining?
A: "With the help of the executive order from President Trump,... we're expecting an expedited permitting process. And that hopefully will mean that within this next year, maybe even by the end of the year, we'll see the permission from the US government to move forward."
"We do have our first production vessel, the Hidden Gem,... We've finalized how we turn these nodules into the intermediate nickel and copper and cobalt and manganese products. So we're all set."
"We haven't formally told the market when we'll be seeing first production. But what I'm confident of is that it'll be sooner than people expect."
"If you would have suggested me 2027, I'd say I hope so."
Q: Do you need to first modify the Hidden Gem to increase its production capacity?
A: "The original plan was that we were going to make quite extensive modifications to suit a much higher production number. But (expecting) an expedited permit, our thinking is, let's get the boat into production as quickly as possible, and then focus on the bigger production scale for boat number two, three, four and five."
Q: When do you expect to reach the hoped-for full-scale production of 12 million tonnes of nodules per year?
A: "I hope by 2030-2031."
Q: How important is it to be the first to extract minerals from the deep sea?
A: "It's not important, but it's a fact that we will be... No doubt."
Q: Do you expect this to be seen as a historical step?
A: "I think time will be the judge of just how important ocean metals are going to be to society."

Trump's drive for ocean bed mining threatens law of the sea
Trump last month signed an executive order to accelerate the permit-granting process for deep-sea mining in domestic and international waters, citing an obscure 1980 US law. And the Canadian deep-sea mining frontrunner The Metals Company has already filed an application in the United States to conduct commercial mining on the high seas -- bypassing the International Seabed Authority (ISA). This is the body entrusted by a United Nations convention with managing the ocean floor outside of national jurisdictions. Ocean law is largely guided by that accord -- the United Nations Convention on the Law of the Sea (UNCLOS), first signed in 1982 to prevent "a competitive scramble for sovereign rights over the land underlying the world's seas and oceans," according to Maltese diplomat Arvid Pardo, the convention's forebearer. The United States never ratified the convention, which took effect in 1994, though it has applied many of its clauses. Coalter Lathrop, an attorney at the US law firm Sovereign Geographic, told AFP that the United States is "a huge beneficiary of the parallel set of customary international law rules" despite not being a party to UNCLOS. For instance, the United States has one of the largest Exclusive Economic Zones (EEZ) which gives states sovereignty over maritime areas up to 200 nautical miles (370 kilometers) from their coastline -- protecting them from foreign fishing boats, among other extractive industries. If the US enjoys the benefits of ocean law, Lathrop argues, "but then you disregard the other part of the package deal -- that the seabed and its minerals in areas beyond national jurisdiction are the common heritage of humankind -- that is going to be destabilizing, to say the least, for the general legal order of the oceans." "US unilateral permitting could lead to the disintegration of a system that has been carefully curated and created by the United States, largely for its own benefit," he added. 'Unraveled' The US and Canadian moves sparked an international outcry from ISA member states, including China, whose foreign ministry spokesman warned it violates international law. ISA secretary general Leticia Carvalho expressed similar concern, saying that "any unilateral action... sets a dangerous precedent that could destabilize the entire system of global ocean governance." The Metals Company does maintain contracts with ISA members like Japan -- where it has a partnership with smelting company Pamco. And experts note such ISA member states could invoke their obligation to UNCLOS to enforce maritime law on The Metals Company via these proxies, even if it ultimately receives a permit from the Trump administration. Guy Standing, an economist at the University of London, told AFP: "It's the most dangerous thing he's done so far," referring to Trump. If marine laws "were to come sort of unraveled," Standing said, "you could have a carve up in different parts of the world, with Russia, China and America carving up the Arctic." However, not all scholars in the field are in agreement. James Kraska, a professor of international maritime law at US Naval War College, said "it's naive to think the United States has that kind of influence." "I just disagree with the people that are saying that it's somehow a legal obligation to comply with a treaty that you never joined," he told AFP. "I just can't see any way that it's unlawful. Trump signs executive order to expand US deep-sea mining for rare earth minerals
President Donald Trump signed an executive order Thursday to expand US deep-sea mining for rare earth minerals in domestic and international waters, despite warnings by environmental groups. White House aides say the initiative could see US operations scoop up more than a billion metric tons of deep-sea nodules and pump hundreds of billions of dollars into the American economy. The fast-tracking also flies in the face of a decade-long international effort to set ground rules for the burgeoning deep-sea industry. Commercial deep-sea mining remains in its infancy, but with a global race underway for rare earth minerals -- and the industry dominated by China -- Washington appears set on expanding its collection capacity to benefit its defense, advanced manufacturing and energy industries. Under the order, the secretary of commerce has 60 days to "expedite the process for reviewing and issuing seabed mineral exploration licenses and commercial recovery permits in areas beyond national jurisdiction." The boosted deep-sea mining policy is aimed in part at "strengthening partnerships with allies and industry to counter China's growing influence over seabed mineral resources," it said. 'Environmental disaster' The International Seabed Authority (ISA) is scrambling to devise a rulebook for deep-sea mining, balancing its economic potential against warnings of irreversible environmental damage. The United States is not a member of the UN-affiliated body. Last week the American firm Impossible Metals said it had asked US officials to "commence a leasing process" in a parcel of the Pacific Ocean surrounding far-flung US territory American Samoa. The bid circumvents the ISA by mining within US jurisdiction, rather than international waters. Key seabed resources include polymetallic nodules, potato-sized pebbles found at depths of 13,000 to 20,000 feet (4,000 to 6,000 meters) that contain manganese, iron, cobalt, copper and nickel. A senior administration official told reporters shortly before the signing that the US could retrieve more than a billion metric tons of material, and the process could create some 100,000 jobs and generate $300 billion in domestic GDP over 10 years. Several countries are scrambling to increase capacity for deep-sea mining, seen as a potential boon for industries and the green energy transition. But environmental groups warn the process can cause major ecological damage. "Fast-tracking deep-sea mining is an environmental disaster in the making," Emily Jeffers, a senior attorney at the Center for Biological Diversity, said in a statement. "Trump is trying to open one of Earth's most fragile and least understood ecosystems to reckless industrial exploitation." Canada-based deep-sea mining frontrunner The Metals Company recently stunned industry observers with an attempt to sideline the ISA. After years of pushing the authority to adopt rules for industrial-scale mining, The Metals Company abruptly announced earlier this year it would seek US approval instead.
