State triumphs as court rejects Section 174 application
The Pretoria High Court, sitting in the Benoni Magistrate's Court, dismissed a Section 174 application brought by accused one, former commanding officer Major Leon Louis Van Den Berg (75), and accused two, former sergeant Abraham Hercules Engelbrecht (61).
The pair sought to be discharged from the charges against them on the grounds that the State had no case.
The two, along with their co-accused, former sergeant Pieter Stander (60), face a murder charge for allegedly killing student activist and Congress of South African Students (COSAS) member Caiphus Nyoka.
It is alleged that on the evening of August 23, 1987, the three men — members of the SAPS Reaction Unit — met to plan Nyoka's killing.
Under the command of Major Van Den Berg, a plan was devised to raid Nyoka's home.

In the early hours of August 24, 1987, at about 02:30, Stander, Engelbrecht, and other Reaction Unit members, who are also charged separately, arrived at Nyoka's homestead and stormed his room.
They found Nyoka and three friends asleep. After identifying him, they removed the others from the room and shot him nine times. He died on the scene from multiple gunshot wounds.
The State called five witnesses during the trial: Nyoka's sisters, Alegria and Mothasi Nyoka; Exodus Nyokane, one of Nyoka's friends present that night; Dr Rousseau, an expert witness and TRC researcher; and the investigating officer, Lieutenant Colonel Beukman.
Mahanjana said the court dismissed their application, and thereafter, Van Den Berg opted to remain silent and closed his case.
The matter was postponed to September 8–19 for the defence case of Engelbrecht and Stander.
The case against former Reaction Unit member Johan Marais (65), who pleaded guilty and was convicted of the same offence, will return to court for sentencing proceedings on June 5 and 6.
Mahanjana described the court's decision as encouraging, noting that the State had overcome a significant hurdle in the defence's attempt to halt the trial.

Image: Nomonde Zondi The advocate had come to Durban on behalf of SARS for the tax inquiry concerning the tax affairs of Andile Mpisane and 13 others. Mpisane is the son of Durban's controversial businesswoman Shauwn 'MaMkhize' Mkhize. The pair was arrested in December last year in Cape Town, and they are currently in custody after the Durban Magistrate's Court denied them bail. During their bail application, the investigating Warrant Officer Praved Maharaj said the attempted murder of Naudé was carried out brazenly, and the men used no form of disguise. He said the duo had no consideration for the public. 'There was a security guard present when the shooting occurred, and he had to flee for his life,' Maharaj said. According to the police officer, the State has a prima facie case against the duo. Maharaj said that in 2016, Mbulwana was convicted of assault and is currently facing charges of unlawful firearm possession. Additionally, Runeyi is said to have a warrant of arrest for two cases, one for theft of a motor vehicle and one for possession of a stolen motor vehicle.

Cape Town cop accused of kidnapping, murder to await bail application outcome
CAPE TOWN - A Cape Town law enforcement officer accused of kidnapping and murder will have to wait until next week to find out if he'll be released on bail or not. Thandile Khesa made a brief appearance at the Blue Downs Magistrates Court on Thursday, alongside four of his co-accused. The group is accused of kidnapping a man in Kraaifontein on 16 May 2025, when he responded to an online advert for a car on sale but ended up dead. The prosecution's case suggests that 43-year-old Khesa met with the deceased in Bellville, kidnapped him, and drove in a State-branded car to an open field near Khayelitsha. It's further alleged that Khesa, together with Mogamat Samuels, Thokozani Kamnjunga, Existing Mudivari and Yaseen Jele, then demanded a ransom of R100,000 from the victim's family for his release. When the family couldn't come up with the ransom money, the amount was reduced to R5,000, which was paid into a bank account provided by the accused. Detectives were able to trace Samuels, Kamnjunga, Mudivari, and Jele to addresses in Philippi and Kleinvlei a day after the alleged kidnapping took place. One of the accused led detectives to the crime scene between Monwabisi Beach and Macassar, where he pointed out a shallow grave where the victim was buried. The law enforcement officer's bail application has been postponed until next week on Tuesday, while his co-accused will apply for bail later on Thursday.

IOL reported on Wednesday that the case of murder against the first suspect, 39-year-old Mduduzi Trevor Mnisi, who is also accused of killing Likhona Fose, was postponed to June 18 for a formal bail application. Mnisi appeared before the Roodepoort Magistrates Court on charges of murder with the State indicating that it plans to oppose bail to Mnisi, who has a previous attempted murder conviction against him. In the latest development, City of Johannesburg's member of mayoral committee (MMC) for public safety, Dr Mgcini Tshwaku, told broadcaster Newzroom Afrika that the community played a pivotal role in the arrest of the Pakistani man. 'We were actually tipped off, and through the interrogation of Mduduzi and through the community, we managed to establish the link between Mduduzi and the Pakistani man," he said. Reports indicate that the family suspects hate crime to be the motive in the murder of the Grade 8 pupil, who identified as a lesbian. Tembe, who was greeted to protesting community members and anti-gender-based violence activists, extended his condolences to the bereaved family, stating: "Her tragic and brutal killing, suspected to be linked to occult practices, has shaken the community.
