Bengaluru: The Union government on Tuesday told the Karnataka high court that X, formerly known as Twitter, complies with takedown laws globally but seeks special treatment in India, as it opposed the social media giant's petition against the Centre's Sahyog portal. X has challenged the Union government's direction asking it to join Sahyog, contending that the portal opens the door for 'indiscriminate censorship.' Senior advocate KG Raghavan, appearing for the social media company, cited a recent case where the Indian Railways asked X to remove a viral video of a woman driving on railway tracks in Telangana. The video had gone viral after the police revealed that the woman was attempting suicide. Questioning how such content was unlawful, Raghavan claimed that under Sahyog portal, 'every Tom, Dick, and Harry' could issue takedown notices. Mehta, however, objected to Raghavan's choice of words and said the officers sending such notices were the competent authority and the Union government will not tolerate anyone calling them names. Justice Nagaprasanna asked the senior counsel to exercise restraint, saying these were officers of the 'government of India' and had 'statutory powers.' The Centre also reiterated that X has no legal right to challenge takedown orders. The government had previously told the court in an affidavit that social media intermediaries did not have the locus to fight for their users in court. It had also cautioned that if X resisted, it might lose safe harbour. Section 79 of the Information Technology (IT) Act, 2000, provides a safe harbour provision for intermediaries, such as X, shielding them from liability for third-party or user content they host or transmit, provided they comply with takedown requests within 36 hours of receiving official notice. X has argued that this provision has been misused to create a parallel blocking mechanism that violates the Supreme Court's judgment in the case of Shreya Singhal vs Union of India, which provides for orders for content removal only under a defined process established under the IT Act. The high court posted the matter on July 8 for further hearing.

BJP appoints six state unit chief; West Bengal and Madhya Pradesh soon
The Bharatiya Janata Party (BJP) on Tuesday appointed chiefs for local units in six states and Union territories, and set the ball rolling for a similar process in two other states such as West Bengal, adding to speculation that the election for the national party chief was on the anvil. BJP appoints six state unit chief; West Bengal and Madhya Pradesh soon As the appointment of new party chiefs has been completed in 22 states, all eyes are now on whether the BJP will appoint new heads in three key states –– Uttar Pradesh, Karnataka and Gujarat –– before it finalises the name for the national president. Under the party constitution, the national president can be elected after elections are held in 50% of the states. India has 28 states and seven Union Territories. On Tuesday, the party announced the appointment of Anil Tiwari as the new BJP state chief in Andaman and Nicobar; Ravindra Chavan in Maharashtra; PVN Madhav in Andhra Pradesh; N Ramchander Rao in Telangana; Mahendra Bhatt in Uttarakhand, and Rajeev Bindal in Himachal Pradesh. In Madhya, Pradesh Hemant Khandelwal filed the nomination for the post of state unit president, which is currently held by VD Sharma. In Bengal, the party announced that the election will be on Thursday. Incumbent Bengal unit chief Sukanta Majumdar is the front runner to retain his post. According to a party functionary, by the end of the week, new state unit heads will be in place in 24 states. 'As on date the requirement of appointing new chiefs in 50% of the total states prior to the election of the national president has been met…the next step is for the election in-charge K Laxman to announce the schedule for the election of the national president,' said a party functionary . Responding to a question on whether the party will pick new presidents for the three big states before it begins the process of selecting incumbent president JP Nadda's successor, the functionary said, 'The process of seeking feedback from the cadre in all the three states is more or less over. There are a few districts where appointments have been stalled, but the delay in announcement is not owing to any major discord.' In Karnataka, there was a division in the party on giving the incumbent BY Vijayendra a second term. A section of leaders wanted the 49-year old Vijayendra to continue while a second group cited the party's stance of not promoting dynastic politics to push for a new name. Vijayendra's father is the former CM, BS Yediyurappa. In Uttar Pradesh, too, the process has been mired in controversy as there are various caste groups pushing for their candidate. 'A section of leaders feel that the representative should be an OBC or SC in keeping with the leadership's push to social engineering and giving the marginalised sections more process was also delayed because of the Maha Kumbh in Prayagraj,' said a state leader. The incumbent president, Bhupendra Chaudhary, comes from the backward castes. In Gujarat, where Union minister CR Paatil is the state president, the party is divided over whether to pick a Patel or a tribesperson for the top slot. While the Patels are a hefty vote bank that the BJP relies on, the party is equally keen to keep the scheduled tribes close as they make up about 14.8% of the population.

SC grants 4-week bail extension to Nitish Katara murder convict
The Supreme Court on Tuesday granted a four-week extension of interim bail given to Vikas Yadav, the son of former member of Parliament DP Yadav undergoing life term in the 2002 Nitish Katara murder case. Vikas Yadav is serving life term for abducting and killing Nitish Katara in February 2002. (HT Archive) The court also directed him to surrender after four weeks, saying that he will not be entitled to any further extension of bail on the ground of his mother's ailment. Further, the condition of his bail requiring him to remain confined in his house was modified and he is now allowed to accompany his mother to her hospital visits. A bench of justices MM Sundresh and K Vinod Chandran, passed the order on an application filed by Yadav seeking extension of his bail granted by the top court on April 24. This is the fourth bail extension granted by the court. On past three occasions – May 8, May 19 and June 17, bail was extended to facilitate his mother's spinal operation that took place on May 25. 'We are inclined to extend the bail granted by four weeks making it clear that no further extension on medical ground will be provided. Any application for extension (of bail) can only be filed after surrender,' the bench said. Senior advocate S Guru Krishna Kumar, appearing for Yadav, said the petitioner should not be barred from seeking extension of interim bail on other grounds. His bail was supposed to expire on July 1. The application filed by Yadav pointed out that the Delhi high court order upholding his conviction in Nitish Katara case in 2015, had slapped a fine of ₹ 50 lakh against him. To arrange the same, Yadav stated in the application that he required to dispose immovable properties located in different states, which is a time-consuming and legally intricate process. He pointed out that he does not possess an Aadhaar card as he has remained in jail for past 23 years. Additional solicitor general (ASG) Archana Pathak Dave appearing for the Delhi government informed the court that initially while granting bail, the court was told that his mother needs to be operated. Presently, she said, the operation is over and the petitioner's mother is undergoing physiotherapy. Yadav stated that after undergoing operation, his mother developed serious post-operative neurological complications such as severe radiating pain, numbness in both lower limbs, weakness, and impaired mobility. Krishna Kumar said, 'In these critical circumstances, the presence and support of the petitioner, being the elder son, is indispensable.' Advocate Vrinda Bhandari appearing for Nilam Katara, mother of Nitish Katara, pointed out that no relaxation should be granted to Yadav as due to the petitioner's influence and power, the trial was shifted out of Ghaziabad in Uttar Pradesh to Delhi. 'So long as he is not committing any offence, what is the problem. If he violates the condition, the bail will be cancelled,' the bench observed, maintaining its order of relaxing the bail condition. While granting him bail on April 24, the top court had directed Yadav to furnish bail bond of ₹ 1 lakh with a surety of like amount and imposed a condition asking him to remain confined to his home in Murad Nagar in Ghaziabad while reporting to the local police station during the period of bail. In October 2016, the top court had upheld the conviction against Yadav and others in the 2002 Katara murder with a further direction to consider his remission on expiry of 25 years. The case pertains to the abduction of Katara from a marriage party on the intervening night of February 16 and 17, 2002, and then killing him over his alleged relationship with Bharti Yadav, Vikas's sister. In 2006, the top court shifted the trial of the case from Ghaziabad to Delhi on a petition moved by Nilam Katara. In July 2011, a Delhi court awarded life term to all the accused. This decision was upheld by the Delhi high court in 2015 and later by the Supreme Court in October 2016.
