Businessman in hot water after receiving R1. 4 million from SARS through misrepresentations

Mbongiseni Ngomane, aged 34, has been released on bail after a warrant of arrest was issued against him for allegedly defrauding the South African Revenue Service (SARS).
Lieutenant Colonel Magonseni Nkosi, provincial spokesperson for the Directorate for Priority Crime Investigation, also known as the Hawks, said the crime was committed in 2022 through misrepresentations of the company's income to SARS.
'According to information, Ngomane's misrepresentation led to SARS suffering an actual loss of R1,424,872. Upon receiving a tax refund from SARS, Ngomane allegedly transferred an amount of R200,000 to KC The Princess (Pty) Ltd whose sole director was Khensani Mnisi, 59,' said Nkosi.
Mnisi also transferred money to five different recipients listed by the Hawks as Phindile Shabangu, 30; Dorren Simelane, 49; Thobile Ngomane, 35; Khanyisile Dlamini-Phenyane, 50, and Bafana Singwane, 50. Get your news on the go, click here to join the IOL News WhatsApp channel.
The Hawks' serious commercial crime investigation unit, based in Nelspruit, executed the warrant of arrest, and all suspects appeared before the Nelspruit Commercial Crime Court on Tuesday.
Ngomane was released on R2,000 bail while his co-accused were released on R500 bail each.
The matter was postponed to 8 July 2025 for further investigations.

Last year, IOL reported that the Nelspruit Commercial Crime Court in Mpumalanga convicted and sentenced 44-year-old Mduduzi Steven Mashwama and his company MPG Mash Trading CC on charges of theft and contravention of the Prevention of Organised Crime Act (POCA).
In July 2020, Mashwama and his company fraudulently submitted Value Added Tax claims and claimed undue VAT refunds of R166,850 from SARS.
'The matter was reported to the Hawks Nelspruit-based serious commercial crime investigation (unit) for further investigation. The investigation was finalised and the accused was summoned to appear in court on several occasion until he was sentenced on Tuesday,' Lieutenant Colonel Dineo Lucy Sekgotodi, Mpumalanga spokesperson for the Hawks said at the time.
Mashwama was accused number two in the court case.
On count one, of theft, Mashwama was sentenced to six years imprisonment which is wholly suspended for a period of five years on condition that he is not convicted of theft, fraud and or any offence involving misrepresentation committed during the period of suspension.

'The suspects then threatened the complainant and stole money from the till counter. 'Community members noticed the incident and gathered at the shop, one suspect in reflector was caught. The driver of the supposed gateway car fled. 'The third suspect, the Police Constable, then claimed that his vehicle was stolen. All three suspects were arrested for business robbery, and an amount of R1 020 and a reflector jacket were confiscated,' Hulani said. Hulani said the suspects are expected to appear before Giyani Magistrate's Court on Monday, 18 August 2025. Thohoyandou constable among those arrested in Giyani LIMPOPO – Giyani police have arrested three men, aged between 26 and 38, in connection with a business robbery at a D2 store on Friday (August 15). Police spokesperson Brigadier Hlulani Mashaba says that authorities responded to a complaint after one suspect was reportedly cornered by community members. 'Upon arrival, officers apprehended a man wearing a police reflector jacket. Another man claimed his vehicle had been stolen, but later stated he did not want to open a case, alleging the vehicle was taken by a friend.' Preliminary investigations revealed that the third suspect, a Constable from Thohoyandou Public Order Police (POP), along with the two men, had visited the store claiming to inspect expired food. There, they threatened the store owner and stole money from the till. Community members intervened, capturing one suspect in the reflector jacket while the driver fled. Police subsequently arrested all three suspects and recovered R1 020 in cash and the reflector jacket used during the robbery. The suspects are scheduled to appear in Giyani Magistrate's Court on Monday. Investigations are ongoing.

Gauteng police close probe into missing mayoral chain worth R465 000
Gauteng police have shut down their investigation into the disappearance of Sedibeng's R465,000 mayoral chain, with no arrests made and the symbolic piece of regalia still missing more than two years later. This follows the mysterious disappearance of the R465 000 mayoral chain after the State of the District Address on June 23, 2023. Mayor Lerato Maloka had allegedly placed it on a shelf in her office, but it was never seen again. A case of theft was only officially opened in November 2023, nearly five months after the chain disappeared. The lengthy delay in reporting the matter has fuelled speculation about possible cover-ups and raised questions about why immediate steps were not taken to recover the costly ceremonial item. Gauteng police have since closed their investigation into the missing ceremonial mayoral chain, with no arrests made and the valuable symbol of office still unaccounted for. Police spokesperson Colonel Dimakatso Nevhuhulwi confirmed that no arrests had been made and directed inquiries to the National Prosecuting Authority (NPA). 'A theft case was opened and investigations were conducted, and the docket was brought before the Deputy Public Prosecutor, who declined to prosecute; hence, the matter was closed on 25 July 2025. 'For more information on reasons not to prosecute, kindly contact the NPA. No one was arrested in this matter. Like any other case, should there be new information/evidence, the case can be reopened to investigate the new info.' DA MPL Kingsol Chabalala described the case closure as disturbing, criticising SAPS for failing to provide a clear reason. 'It is disturbing to learn that the SAPS has closed a case relating to the missing mayoral chain in Sedibeng District Municipality without citing the reason. This is a serious matter that leaves suspicions as the case has been suddenly closed without any arrests or recoveries of the mayoral chain. Chabalala has submitted a letter to MEC for COGTA Jacob Mamabolo and Premier Panyaza Lesufi, demanding an explanation for why the investigation was closed without any resolution. He also called on Premier Lesufi's office to initiate an urgent, independent investigation into the disappearance of the mayoral chain, aiming to uncover the circumstances surrounding its loss and why the theft was not immediately reported to the police. Additionally, he requested clarity on why the police closed the case, including access to any documentation or findings that informed their decision. 'The disappearance of a ceremonial asset valued at nearly half a million rand, coupled with the lack of transparency and accountability, undermines public trust in the municipality's leadership. Your intervention is critical to restoring confidence and ensuring that those responsible for any negligence or misconduct are held accountable. I trust that your office will treat this matter with the urgency and seriousness it demands. Please keep me informed of any actions taken or progress made in addressing this issue.' The letter reads. Chabalala further said that political interference may have played a role in the case's closure. He added that if Premier Lesufi is serious about tackling corruption, he must intervene to ensure justice for the mayoral chain, a valuable symbol belonging to the residents of Sedibeng. He also confirmed that questions will be tabled in Parliament to demand answers. The case has sparked public outrage, with the South African Municipal Workers Union (Samwu) holding protests in June 2024 to demand an investigation into the missing mayoral chain. Previously, as reported by IOL, five mayoral chains have been lost across South Africa, including the recently missing Sedibeng mayoral chain. In KwaZulu-Natal, Msunduzi Municipality saw seven out of 34 gold links vanish from its mayoral chain, once valued at R800 000. Kimberley, diamonds donated by Harry Oppenheimer, mysteriously disappeared from the city's chain, later replaced with fakes. Molemole Municipality in Limpopo lost a R100 000 chain in 2011, allegedly at the hands of the mayor's brother, while neighbouring Mogalakwena only realised its chain was gone during a mayoral inauguration in 2011.
